2002 hit-and-run case: Court orders retrial against Salman Khan

indexMumbai, Dec 5: Eleven years after the hit and run incident in which actor Salman Khan is accused, a sessions court has ordered a retrial in the case with all the witnesses and evidence to be re-examined by a new court.

The court has ruled that all evidence and witnesses in the case need to be re-examined and the hearings will begin from 24 December, reported CNN-IBN.

Sessions court judge DW Deshpande passed the order on a petition filed by the actor who had sought a fresh trial, seeking that the evidence adduced earlier before a magistrate be discarded as he was now facing a more serious charge of culpable homicide not amounting to murder.

In his order, Deshpande said all the witnesses would be examined and cross-examined again during the trial which would be put on fast-track mode.

The judge fixed 23 December for prosecution and defence to submit their lists of witnesses after which a date for fresh trial would be fixed.

Salman’s lawyer Srikant Shivade had argued on 18 Novemberthat the actor had not been given an opportunity in the magistrate’s court to cross-examine witnesses vis-a-vis the additional charge of culpable homicide which was imposed on him recently.

The prosecution had opposed Salman’s plea saying it was an attempt to delay the trial.

A sessions court had on 24 July framed charges against Salman for culpable homicide for which he may face a jail term upto 10 years.

Earlier, he was tried by a magistrate for rash and negligent driving which prescribes a two-year jail term.

Ten years after the accident in which Salman was found involved, the Bandra magistrate held that a culpable homicide charge was made out against the actor and hence referred the case to a higher court for trial as this offence can be tried only by a sessions court.

Apart from section 304(2) (culpable homicide not amounting to murder), the Bollywood superstar has also been charged under sections 279 (causing death by negligence), 337 (causing hurt by an act), 338 (causing grievous hurt), 427 (causing damage or mischief to property) of IPC, and provisions of Motor Vehicles Act and Bombay Prohibition Act.

One person was killed and four others were injured when a Land Cruiser, allegedly driven by Salman Khan, crushed a group of people sleeping on the pavement outside a bakery in suburban Bandra on September 28, 2002.

Mumbai, Jul 19: Mumbai Police have registered an FIR against two Instagram account holders for allegedly threatening actor Rhea Chakraborty, an official said on Sunday.

The location of the two accused is yet to be traced, the official said, adding that the investigation in the case is at primary stage.

Chakraborty on Thursday requested the cyber crime cell to look into the rape and murder threats she has been receiving ever since the death of close friend, actor Sushant Singh Rajput.

Rajput, 34, was found dead in his apartment in suburban Bandra here on June 14, leaving people in the film industry and audiences shocked.

Chakraborty, in particular, was subjected to online hate with users blaming her for Rajput's suicide.

"We registered the First Information Report (FIR) on Saturday under Indian Penal Code Sections 507 (criminal intimidation by an anonymous communication), 509 (intending to insult modesty of any woman) and relevant provisions of the Information Technology Act," Santacruz police station's senior inspector Shriram Koregaonkar said.

"No arrest has been made so far. We are conducting an investigation in the case," he added.

On Thursday, sharing a screenshot of a hate message she received on Instagram, Chakraborty said while she had ignored many abusive texts sent to her in the past month, the harassment was now unbearable.

The 28-year-old actor eventually disabled the comments section of her Instagram page.

Chakraborty, known for films such as "Mere Dad Ki Maruti" and "Jalebi", had tagged the cyber cell and requested the authorities to look into the threats.

On June 18, she was called to the Bandra police station to record her statement in connection with Rajput's death.

Kochi, Feb 7: The younger brother of noted playback singer K J Yesudas was found dead in the backwaters near here, police said.

The body of 62-year old K J Justin, who had reportedly gone missing from his house in Thrikkakara near here on Tuesday evening was found floating in the backwaters near Vallarpadam Container Terminal on Wednesday, they said.

The relatives identified the body, police said adding it was later sent for autopsy at General Hospital here.

A General Hospital spokesperson said the body was handed over to his relatives on Thursday evening after autopsy was performed.

The funeral is expected to be held after the arrival of Yesudas from abroad, police sources said.

Police said the initial investigation suggested it was a case of suicide.

According to police, Jusin's relatives have informed the investigation team that he had been showing signs of suicidal tendency for the last one week as he was allegedly facing some financial problem.

His relatives were not available for comments.

Son of the renowned musician late Augustine Joseph, Justin is survived by his wife.

Justin had been a regular presence at popular ganamela programmes here in the past, sources said.

New Delhi, Feb 11: 'Housefull 4' actor Pooja Hegde will star opposite Salman Khan in his Eid 2021 release 'Kabhi Eid Kabhi Diwali'.

Film critic and trade analyst Taran Adarsh made the announcement on Twitter on Tuesday.

"CONFIRMED... #PoojaHegde opposite #SalmanKhan in #KabhiEidKabhiDiwali... Directed by Farhad Samji... Story and produced by Sajid Nadiadwala... #Eid2021 release," read Adarsh's tweet.

Earlier, Salman Khan had announced the title of the film 'Kabhi Eid Kabhi Diwali' in January, keeping the trend alive of gifting his fans a movie to enjoy on Eid al-Fitr.

The film is being co-produced by Salman Khan, Sohail Khan, and Atul Agnihotri under the banners Salman Khan Films, Sohail Khan Productions and Reel Life Production.

The flick will hit theatres on Eid 2021, which will be around May 21.
