2008 BMW hit-and-run case: Utsav Bhasin gets 2 yrs in prison, survivor unhappy

New Delhi, Jul 16: A Delhi court on Saturday sentenced 30-year-old Utsav Bhasin, to two years in prison for the 2008 BMW hit-and-run case. The court also imposed a fine of Rs 10 lakh for the family of the deceased and Rs 2 lakh for the injured.

The victim, however, expressed dissatisfaction with the sentence. Mrigank Shrivastava, who was at the court proceedings said, “I am very unhappy. Initially, the harsher charges dropped and now two years for killing a person and destroying my life. I have spent around Rs 17 lakh in treatment and I have got just Rs 2 lakh as compensation.” Shrivastav had suffered a leg injury in the accident while his friend Anuj Chauhan had died.

Additional Sessions Judge Sanjeev Kumar passed the order around 4.50pm in a packed courtroom. Utsav Bhasin, son of a Haryana-based businessman, was held guilty of rash driving, voluntarily causing hurt on provocation and causing death by negligence. The court had passed the verdict in May this year. Bhasin was, however, acquitted of charges of culpable homicide, in which the maximum punishment is up to 10 years.

On September 11, 2008, Bhasin, who was driving his BMW car, hit two men — Anuj Chauhan and Mrigank Shrivastava — near Moolchand flyover in south Delhi. The two men, who were on a motorcycle, were returning home after watching the movie Rock On. Chauhan died two days after the accident and Shrivastava suffered leg injuries. At that time, Bhasin was 21 years old and was doing BBA at IILM in Lodhi Colony.

He was, later, arrested from the Interstate Bus Terminus at Kashmere Gate while attempting to flee to Chandigarh. He was later released on bail after giving two sureties of Rs 20,000 each.

In May, the court had convicted Bhasin under Sections 304A (causing death by rash and negligent act), 279 (driving rashly which could endanger human life) and 338 (causing grievous hurt) of the Indian Penal Code (IPC).

He was acquitted of charges under Section 304 (culpable homicide not amounting to murder) citing lack of evidence to prosecute him on harsher terms.

The court observed that the witnesses did not support the charges of culpable homicide not amounting to murder.

Anuj Chauhan, who suffered injuries on cervical spine and later died, was working as a freelance journalist and pursuing a course in graphic designing and animation at a private institution in south Delhi.

Bengaluru, Feb 5: City Crime Branch (CCB) of Bengaluru City have arrested two drug peddlers from Kerala and have seized banned products from their possession.

According to officials the arrested persons have been identified as Shinto Thomas (35) of Wayanad and Tajudden Talat (29) of Thiruvananthapuram.

"We have seized 4 kg 350 grams of Hashish oil, 21.5 kgs of Ganja, Rs. 9300 cash, two mobile phones, two ganja crushing tools, and 625 empty boxes and other articles from them", police said in a statement.

Jan 17: Police have busted a "high- profile" sex racket operating in a three-star hotel in suburban Andheri and arrested a 29-year-old woman and rescued three female artists, including a minor, an official said on Thursday.

The Social Service (SS) branch of the city police conducted the raid at the hotel at Andheri East on Thursday, the official said.

"During the raid, three females, including a minor, were found to have been forced into prostitution. They were rescued and a woman, identified as Priya Sharma, who was operating the racket, was arrested," he said.

"Sharma was running tours and travel agency in Kandivali East. However, she was involved in immoral activities," senior inspector of SS branch, Sandesh Revale, said.

While one of the rescued is a woman actor and singer, who has worked in 'Savdhaan India' TV crime show, he said, another one has worked in a Marathi movie and serials.

The minor has worked in a web series, Revale added.

The offence was being registered against Sharma, he said.

Nagpur, Jan 28: A 19-year-old woman was allegedly raped and an iron rod was inserted in her private parts by a man in the Pardi area here, police said on Monday.

The gruesome incident took place on January 21 and the accused, Yogilal Rahangdale (52), was arrested from Gondia district, they said.

The accused was working as a supervisor in a spinning mill where the woman was employed as a labourer, the police said.

The woman, her brother, the accused and another girl lived in rented accommodations in Pardi.

Inspector Sunil Chavan of the Pardi police station said that the woman's brother and her female friend had gone to their village on January 21 for some work.

As the woman was alone at home, Rahangdale attempted to rape her in the night. When she resisted, he stuffed a piece of cloth in her mouth, he said.

When she fell unconscious, the accused raped her and inserted an iron rod in her private parts, Chavan said, quoting from the complaint filed by the victim.

She narrated the incident to her brother on January 24 and they subsequently lodged a complaint with the police.

An offence was registered against the accused at the Pardi police station.
