Aadhaar rebels find easy ways to avoid PAN linkage

Mumbai, Jul 23: In a quiet display of dissent, numerous taxpayers across the country have opted to file their tax returns manually+ , via snail-mail, rather than get an Aadhaar card. Many others filed their returns online early, prior to June 30, when the Aadhaar linkage+ was not mandatory.adar

"Technically you should be able to file online even if you don't have an Aadhaar card, but the e-filing system does not allow it," said docu filmmaker Rakesh Sharma, who considers the Aadhaar requirement a potential violation of privacy and a possible tool for state surveillance and data mining.

The I-T department's e-filing portal+ does not accept returns without an Aadhaar or an Aadhaar application number.

In some instances, even an application number is being rejected - which according to I-T officials could be owing to an error by the tax filer or a temporary technical glitch.

Thus, those without an Aadhaar or its application number are caught in a catch-22 situation, as taxpayers with an income of above Rs 5 lakh have to mandatorily file their I-T returns online.

A Bengaluru-based consultant said she and her husband, as well as many of their friends, refused to get the Aadhaar card and filed their returns in early June. "Aadhaar started off as something optional and we kept reading about data getting stolen. So a lot of us were concerned about giving our biometrics to the private operators given the potential for identity theft." She is also livid about the relentless text messages she receives from her bank threatening to freeze her accounts if she does not link them to Aadhaar, despite the fact that this has not yet been mandated.

Chennai-based environmentalist Nityanand Jayaraman, who is filing manual returns, said he has a problem with Aadhaar as he simply doesn't trust the government. "I do not like the fact that it is bullying people into taking an Aadhaar for everything. If it wants to link Aadhaar with anything, it has to be with voter ID."
"I am debating whether to snailmail my returns to the Bangalore Central Processing Centre or just wait it out until the constitutional bench of the Supreme Court which is currently hearing the matter, passes its order. If they don't accept my I-T return, then I want a physical confirmation of that," said a Mumbai-based media professional.

Section 139AA of the I-T Act has made it mandatory to quote the Aadhaar number or the application number for I-T returns+ filed on or after July 1, this year. On June 9, the Supreme Court (SC) bench upheld this section. As an interim relief, pending hearing of the privacy issues relating to Aadhaar by a constitutional bench, the SC clarified that for those taxpayers who do not have an Aadhaar, their PAN will not be cancelled for the time being. The tax laws had also provided for cancellation of PAN in the absence of intimation of Aadhaar or its application number.

"The SC's order does not give any leeway to taxpayers for filing of I-T returns without Aadhaar or an enrollment number, post July 1. If they don't have an Aadhaar, taxpayers should at least obtain an Aadhaar enrolment number," a senior I-T official said.

An exemption from quoting Aadhaar has been provided for in limited cases only, such as for non-residents, foreign citizens, or individuals above 80 years of age. The exemption is also available to those residing in Assam, Jammu & Kashmir and Meghalaya.

I-T authorities claim that a manual return for those earning above Rs 5 lakh will be void. "I-T officials are not duty-bound to accept manual returns and are unlikely to accept them," a chartered accountant admitted.

"I am asking my clients to pay any outstanding tax dues and just sit back for the time being. Fortunately, the late filing fee of Rs 10,000 introduced by the budget doesn't apply to FY 2016-17," said another CA.

"Taxpayers could also try approaching the I-T commissioner (or any higher level officer) for acceptance of their manual I-T return. However, there must be a genuine reason for not having enrolled for Aadhaar - for instance Aadhaar application made by an aged citizen (exemption is only for those above 80 years) may not have been accepted as his or her biometrics was not legible," the CA added.

According to him, the limited constitutional validity of section 139AA is subject to the final decision of the constitutional bench of the SC. As of now, no penal action, including cancellation of PAN card can take place till the matter is disposed of by the SC. Thus, no I-T return can be rejected for not quoting Aadhaar. Even if these taxpayers manage to file their return manually, it's unlikely that they will get a refund, if any is due. For this, the I-T return needs to be processed online.

There are concerns among expatriates because the number of people infected with the coronavirus and the number of deaths reported in various provinces are increasing at an alarming rate."

"Saudi Government and Health Ministry are taking excellent precautionary measures, however, in the coming days expect to see the number of cases to increase in Saudi Arabia. The Indian government needs to take diplomatic and immediate intervention to ensure the treatment of Indian expatriates considering the number of effected people increasing", He said.

He also urged that the Embassy and the Government of India should ensure qaurantiane faculty for Indian expatriates and arrange special low cost flights to bring back expatriates who would like to return home country.

" Government of India and Indian embassy need to intervene immediately to ensure that the quarantine system is in place for Indian expatriates as the facilities in the rooms where the residents are staying together are very limited. There should also be a mechanism to organize low-cost flight services for expatriates who are ready to go home. The government system should also be able to accommodate the expatriates in special quarantine areas in hometown as soon they arrive in India", he urged.

Bengaluru, Feb 21: Amulya Leona, a college student, who raised to pro-Pakistan slogans to embarrass organisers of a protest against the Citizenship (Amendment) Act (CAA) here on Thursday evening, has been charged with sedition.

The student-activist, who was allowed to talk on stage, suddenly raised pro-Pakistan slogans. She was arrested by police after All India Majlis-e-Ittehadul Muslimeen (AIMIM) chief Asaduddin Owaisi snatched her mike.

Deputy Commissioner of Police Ramesh Bannoth confirmed the girl has been charged with sedition, provoking enmity between groups, and intentional insult to provoke breach of peace.

It was just after Mr. Owaisi’s arrival on the stage at Freedom Park here that the 19-year-old student was asked to speak. After preliminary remarks, she suddenly shouted “Pakistan zindabad” thrice, leaving the crowd and organisers stunned.

Some of the organisers rushed to her and tried to take the mike away and stop her from speaking further. Mr. Owaisi too joined in and snatched the mike. Holding on to the mike, the girl then went on to shout “Hindustan zindabad” twice, before a posse of police personnel and organisers whisked her away from the stage

Soon after the student was taken away, a visibly upset Mr. Owaisi told the crowd: “Whatever has been spoken [by the girl] is wrong. Neither my party nor I has any connection with it. As long as we are alive, we will be raising Bharat zindabad slogans. Never had we any relationship with Pakistan nor will we have anything in future,” he announced.

He further stated: “This is condemnable. The organisers should not have invited such people to this place. If I had known that these kind of things would be said here, I would not have come here.”

It is unfortunate that the organisers have invited such people and a wrong message is going out, he said. “Now, BJP has got an opportunity and will blame me,” he added.

Every speaker, who took the podium after the incident, condemned the pro-Pakistan slogans raised by Amulya.

Janata Dal (S) councillor representing Gurappanapalya, Imran Pasha, one of the organisers of the protest under “Hindu, Muslim, Sikh, Isayi Federation”, claimed that they had not invited the “activist” and were not aware that she would be speaking from the stage. Mr. Pasha said that such statements were “a deliberate attempt to drive a wedge between Hindus and Muslims”.

Meanwhile, the BJP State unit tweeted, “Truth is that protests against CAA are a joint venture between Pakistan and anti-National forces led by INC India.” In a press release, BJP State unit president Nalin Kumar Kateel termed this as an “anti-national act” and urged the police to take action.

Bengaluru, Feb 23: Union Minister of Chemicals and Fertilizers DV Sadananda Gowda on Sunday said that several "anti-national organisations" were misusing the platform of anti-CAA protests.

"We have taken serious note of it and have started an investigation. Several anti-national organisations are misusing the platform of anti-CAA protests and many people are trying to take political advantage of this situation," he told the media on Sunday.

Gowda said that the government is "very serious" about the issue. "We are already working towards this. Both the state and Centre are together investigating into this," he said and added, "We will ensure that we cut this and will not allow this to grow. We will investigate the organisers of the event as well."

"If you are inviting such people (alleged anti-national elements), it means that you either know about it or that you are indirectly encouraging such things. In such situations, the organisers too will be acted upon," he stressed.
