Aadhar will be 'optional' for availing various govt schemes: Supreme Court

New Delhi, Aug 11: Aadhar card will be optional for availing various welfare schemes of the government, the Supreme Court today said and ordered that no personal information of the holders of such cards shall be shared by any authority.

aadharA three-judge bench, which in the forenoon referred to a larger Constitution Bench a batch of petitions challenging the Aadhar scheme and the issue whether right to privacy is a fundamental right, recorded the statement of Attorney General Mukul Rohatgi that "no personal information of Aadhar card shall be shared by any authority".

The bench, headed by Justice J Chelameswar, which issued a slew of directions, said the Centre shall give wide publicity through electronic and print media that the card is not mandatory to avail the government schemes.

The bench, also comprising Justices S A Bobde and C Nagappan, said, "UIDAI/Aadhar will not be used for any other purposes except PDS, kerosene and LPG distribution system." However, the court made it clear that even for PDS, kerosene and LPG distribution system, the card will not be mandatory.

It directed that the information received by UIDAI shall not be used for any other purposes, except in criminal investigation with the permission of the court.

The court did not allow the interim plea of petitioners, challenging Aadhar scheme, that the ongoing enrolment process for the Aadhar card be stayed.

Earlier in the day, the apex court had referred to a Constitution Bench the batch of petitions challenging the Centre's Aadhar card scheme and decide whether right to privacy is a fundamental right.

Allowing the Centre's plea, the court framed various questions, including as to whether right to privacy is a fundamental right, to be decided by a Constitution Bench.

"If yes, then what would be contours of the right to privacy," the apex court said while referring the matter to Chief Justice H L Dattu for setting up the larger bench.

Attorney General Rohatgi, appearing for the Centre, had earlier said that the matter requires elaborate debate and an authoritative pronouncement is needed in view of the fact that there have been inconsistent decisions as to whether right to privacy is a fundamental right.

He had cited two judgments, pronounced by six and eight- judge benches, which had held that right to privacy is not a fundamental right.

Subsequently, smaller benches had held a contrary view and, hence this matter needed to be decided by a larger bench, he had said.

"Whether right to privacy is a fundamental right guaranteed under Part III of the Constitution of India, in the light of express ratio to the contrary by an eight-judge bench in M P Sharma case and also by a six-judge bench of this court in Kharak Singh's case" has to be decided, Rohtagi had said.

The Centre had sought transfer of the pleas against Aadhar to a larger bench, saying that a two-judge or a three- judge bench cannot decide it. Referring to pronouncements made in historic cases like A K Gopalan, Maneka Gandhi and bank nationalisation, the top law officer had said that inconsistencies with regard to interpretation of certain fundamental rights can only be "squared up" by a larger bench

Mumbai, Jul 16: Poet-activist Varavara Rao has tested positive for Covid-19. The 80-year old, named as accused in the Elgar Parishad case, was shifted to state-run JJ Hospital from Taloja central jail where he was lodged after he complained of dizziness. The hospital conducted tests including one for Covid-19 the results for which confirmed that he is positive.

Dr Ranjit Mankeshwar, the dean of JJ Hospital said, “He has shown no symptoms of Covid-19 so far. He has no breathing difficulty and is stable. We will soon shift him to a Covid hospital.” Rao is likely to be shifted to St George hospital.

Last week, Rao’s family had held a press conference after receiving a call from him from prison. His family had then said that his condition was deteriorating and he should be provided immediate medical aid. He was earlier shifted to the hospital when he fell unconscious in jail in May but was discharged within three days. The family had said that he was not provided proper medical treatment.

Last month, a special court had rejected his interim bail plea where he had cited his susceptibility to the virus due to his age and other medical conditions. The court, however, had said the superintendent of prison has been directed to take appropriate measures in such cases where medical attention is required. Before he was shifted to the hospital on Tuesday, Rao was admitted to the hospital ward of the jail and as he had been unable to do basic chores without depending on other inmates.

An appeal against the special court’s order is pending before the Bombay High Court. The plea is likely to be heard tomorrow.

New Delhi, Aug 4: India witnessed a single-day spike of 52,050 COVID-19 cases as the total cases in the country reached 18,55,746, the Union Ministry of Health and Family Welfare said on Tuesday.

803 COVID-19 related deaths were reported in the last 24 hours. The total cases include 5,86,298 active cases, 12,30,510 cured/discharged/migrated and 38,938 deaths, the Health Ministry added.

Maharashtra continues to be the worst-affected state as it has a total of 1,47,324 active cases and 15,842 deaths. A total of 4,50,196 coronavirus cases have been recorded in the state up to Monday, according to Union Ministry of Health.

Tamil Nadu reported 5,609 new COVID-19 cases and 109 deaths on Monday, taking total cases to 2,63,222 including 2,02,283 discharges and 4,241 deaths, the state Health Department said.

The total cases in Delhi have risen to 1,38,482 including 1,24,254 recovered/discharged/migrated cases and 4,021 deaths, according to the Ministry of Health.

Meanwhile, India recorded the highest single-day testing by conducting over 6.6 lakh tests to diagnose COVID-19 in the last 24 hours.
"In its fight against COVID-19, India scales a new high of 6,61,715 tests in the last 24 hours," said the Health Ministry in a tweet.

A total of 2,08,64,206 samples for COVID-19 have been tested across the country so far, said the Health Ministry.

New Delhi, Jan 1: On the New Year's eve, the railways announced fare hike across its network effective from January 1, 2020, according to an order issued on Tuesday.

While suburban fares remain unchanged, ordinary non-AC, non-suburban fares were increased by 1 paise per km of journey.

The railways also announced a two paise/km hike in fares of mail/express non-AC trains and four paise/km hike in the fares of AC classes.

The fare hike is also applicable to premium trains such as Shatabdi, Rajdhani and Duronto, according to the order.

In the Delhi-Kolkata Rajdhani, which covers a distance of 1,447 km, the hike at the rate of 4 paise per km will be around Rs 58.

According to the order, there will not be any change in the reservation fee and superfast charge and the hike in fares will not be applicable to tickets already booked.

The last such hike was announced in 2014-2015 when fares of all classes of trains were raised by 14.2 per cent and freight charges by 6.5 per cent. However, since then, the railways introduced the flexi-fare scheme which significantly raised fares on select trains and launched trains like Vande Bharat Express and Tejas Express which have relatively higher fares. Trains with dynamic pricing like Suvidha Express were also introduced.
