Aarushi murder case: Court rejects Nupur Talwar's bail plea

Ghaziabad, May 2: In a major setback for Nupur Talwar in the Aarushi Hemraj murder case, the sessions court of additional district judge Shyam Lal on Wednesday refused to grant bail to her, saying she is an "accused in double murders - of her own daughter and a poor servant - Hemraj".

The court denied bail on the grounds that she may tamper with evidence if granted bail.

On Tuesday, Nupur Talwar's lawyer had sought bail for her saying that she is the mother of the daughter who was killed to which CBI had opposed saying that "a poor servant was also killed and nobody was talking about him".

While pronouncing his order, ADJ Shyam Lal said that Nupur Talwar may scuttle the trial in the case despite an order from the Supreme Court and cause hindrance in the process of law.

The court also observed that "prima facie, you (Nupur) are accused in murder and destruction of evidence".

CBI officials say that it is a big victory for them as Nupur Talwar was evading the law for over one year.

Nupur Talwar is presently lodged in the Dasna Jail, after the court refused to grant her interim bail on Monday.

Her daughter Aarushi and servant Hemraj were found killed in their house on May 16, 2008 after which CBI had first arrested three servants - Krishna, Rajkumar and Vijay Mandal. However, in December 2010 agency filed a closure report in the case and presented evidence against the parents.

On April 27, Nupur Talwar was directed by the Supreme Court to surrender before the trial court in Ghaziabad in the twin murder case of her 14-year-old daughter Aarushi and domestic help Hemraj in Noida four years ago.

Refusing to stay the non-bailable warrant issued against her by the special CBI court, a bench of justices A K Patnaik and J S Khehar asked her to approach the trial judge for bail after surrendering which shall expeditiously consider her plea.

The court also turned down her plea for granting protection against any arrest on her surrender.

"We should not anticipate about what the trial court is going to do. You appear before it and the court shall consider your bail. If you do not get bail then there are higher courts," the bench said.

The bench pointed out that her husband also got bail in the twin murder case.

"We are not inclined to stay the operation of the order of NBW issued by the Special Judge, Ghaziabad. But we direct that petitioner (Nupur Talwar) will appear on Monday and move her bail. In case application for bail is moved, the same shall be considered expeditiously," the bench said.

Thiruvananthapuram, Jan 19: The CPI(M) will soon launch a nation-wide house-to-house campaign to explain to the people, the 'link' between CAA-NPR-NRC, party general secretary, Sitaram Yechury said on Sunday.

The intense campaign will take place all over the country, he said while briefing the media about the three-day central committee held at Vilapilsala near here.

The central committee also urged the people not to answer the NPR questions.

"The Central committee has called upon the people not to answer any questions concerning the NPR when the enumerators come to their houses...," the left leader said.

New Delhi, Jul 22: Congress leader Sachin Pilot has served a legal notice to party MLA Giriraj Malinga, for claiming that the former had offered him money to join the BJP.

"Former Rajasthan Deputy Chief Minister Sachin Pilot has served a legal notice to Congress MLA Giriraj Malinga for his Rs 35 crore bribery allegation," a source close to Pilot said.

Earlier, addressing a press conference, Malinga said, "Those MLAs who are stuck either in Haryana or Jaipur, are running after money. To say, they are not, are false claims. Even I was offered the same by Pilot, which I had refused. Came to this party knowing BJP and Congress do not accept money to give tickets."

When asked by the reporters whether he was offered Rs 35 crore, he claimed by saying, "Yes, 35." The MLA claimed he was himself the prove when the reporters asked for the same.

The political situation in Rajasthan is in turmoil after Chief Minister Ashok Gehlot sacked his then-deputy Sachin Pilot and the latter's confidants from his council of ministers. The Congress has also claimed that BJP was trying to buy its party MLAs.

On Monday, the Rajasthan High Court had said that it would hear the petition filed by Pilot and 18 of his loyalist MLAs on July 24, against the disqualification notices issued against them, a lawyer said.

"The arguments in the matter have been concluded. The court has heard the arguments from all the parties. The High Court has slated the matter for orders on July 24," Advocate Prateek Kasliwal told reporters after the hearing.

May 7: Accusing the BJP government in Karnataka of "medieval barbarism" and treating migrants as worse than "bonded labourers", CPI(M) general secretary Sitaram Yechury on Wednesday hit out at the state's decision to stop workers from returning to their homes in different parts of the country citing requirements of the construction sector.

The Karnataka government has withdrawn its request to the railways to run special trains to ferry migrant labourers to their home states, hours after builders met Chief Minister B S Yediyurappa to apprise him of the problems the construction sector will face in case they left.

"This is worse than treating them as bonded labour. Does the Indian constitution exist? Are there any laws in the country? This BJP state government is throwing us back to medieval barbarism. This will be stoutly resisted,” Yechury said in a tweet.

The railways is running Shramik Special trains to ferry to their home towns migrants who were stranded at their places of work during the lockdown.

So far, it has run more than 115 such trains.

The Principal Secretary in the Revenue Department N Manjunatha Prasad, who is the nodal officer for migrants, had requested the South Western Railways on Tuesday to run two train services a day for five days except Wednesday, while the state government wanted services thrice a day to Danapur in Bihar. However, later, Prasad wrote another letter within a few hours that the special trains were not required. Several migrants in the city were desperate to return home as they were out of jobs and money.

Yechury also lashed out at the central government over reports that it owed states and industry Rs 3 trillion and accused the centre of shifting the burden of fighting the pandemic to the state governments.

“While shifting the entire burden of fighting the pandemic on to the State governments, Modi government is not even paying their legitimate dues. After November 2019, Centre has not paid the GST compensation dues for the rest of the financial year, i.e., March 2020.

“Modi government has the right to loot while crores of people & States are left with nothing but the right to starve?,” he tweeted.
