Is ‘abetment to suicide’ charge against Shashi Tharoor a political conspiracy?

New Delhi, May 14: Over four years after Shashi Tharoor's wife Sunanda Pushkar was found dead in a hotel suite here, the Delhi Police today charged the senior Congress leader with abetting her suicide, claiming there was enough evidence to proceed against him.

Tharoor, 62, dismissed as "preposterous" the nearly 3,000-page charge sheet filed before a city court and asserted he intends to contest it "vigorously" while the Congress stood by the Lok Sabha MP from Thiruvananthapuram and a former international civil servant, alleging it is a "conspiracy" by the Modi government to defame him.

In a blow to Tharoor, the suave Congress leader is the only person to be arrayed as an accused in the case in which the police have concluded that it was a case of suicide and not murder. An FIR was registered by Delhi Police on January 1, 2015 against unknown persons under IPC section 302 (murder).

The police has also alleged that Tharoor had subjected his wife to cruelty.

The Congress leader has been charged under sections 498 A (husband or his relative subjecting a woman to cruelty) and 306 (abetment of suicide) of the Indian Penal Code(IPC). While section 498 A entails maximum punishment of 3 years in prison, the section 306 attracts a maximum jail term of 10 years.

Pushkar's death had created a sensation as it came shortly after a bitter spat between the couple over the twitter, over his alleged affair with Pakistani journalist Mehr Tarar. Pushkar, 51,was found dead in a suite in Hotel Leela, a luxury hotel in Chankayapuri, on the night of January 17, 2014.

The charge sheet in the mysterious death of Pushkar was filed before Metropolitan Magistrate Dharmendra Singh, who will consider it on May 24. The agency while asking the court to take cognisance of the charge sheet said there was enough evidence to proceed against Tharoor. It urged the court to summon Tharoor as an accused.

The couple's domestic servant Narayan Singh is one of the key witnesses in the case.

The charge sheet that includes several annexures noted that Pushkar died within four years of her marriage. The couple had entered into wedlock on August 22, 2010. It was the third marriage for both Tharoor and Pushkar,

According to prosecution sources, the charge sheet has mentioned that Pushkar was allegedly subjected to mental as well as physical cruelty.

After all the possible and material evidence collected and verified, it was felt that his custodial interrogation would not be required in the case at this stage, the charge sheet, which contains several medical reports, said.

Tharoor has not been arrested in the case as he had joined the investigation when required.

The Delhi Police said the charge sheet was finalised on the basis of "medico-legal and forensic evidence".

"On the basis of medico-legal and forensic evidence analysed during investigation as well as opinion of psychological autopsy experts, the charge sheet was filed. The matter is sub judice," said a Delhi Police spokesperson.

Psychological autopsy is a reconstructive mental state evaluation to understand an individual's mental state at and around the time of death for the purpose of identifying the cause of death.

Tharoor took to twitter to respond to the charge sheet.

"I have taken note of the filing of this preposterous charge sheet &intend to contest it vigorously. No one who knew Sunanda believes she would ever have committed suicide, let alone abetment on my part," he tweeted.

"It does not speak well of the methods or motivations of the Delhi Police. In oct 17, the Law Officer made a statement in the Delhi High Court that they have not found anything against anyone & now in 6 months they say that I have abetted a suicide. unbelievable!," Tharoor added.

AICC spokesperson Randeep Singh Surjewala alleged that the charge sheet was a conspiracy to defame and malign Tharoor.

"We won't cow down or bow down," he said, alleging, "This is a conspiracy to defame Shashi Tharoor and malign him and the Modi government is using Delhi police."

"We reject the charges totally... Where is the charge coming from?....It is coming from the BJP headquarters..it is coming from the factory of lies."

The Congress in Kerala described as 'politically motivated' the charge sheet while a state BJP leader demanded the MP's resignation.

Opposition leader in the Kerala assembly Ramesh Chennithala said "using power, an attempt is being made by BJP to suppress and insult congress leaders."

On several occasions, "wrong" reports have been given to the media with regard to the case to "insult" Tharoor, the Congress leader said in a statement.

BJP leader M T Ramesh demanded that Tharoor immediately resign as an MP.

New Delhi, Feb 16: Just an hour ahead of the swearing-in ceremony, Arvind Kejriwal invited the people of Delhi again for his oath-taking ceremony at Ramlila Maidan today.

Referring himself as "son of Delhi", the AAP convener today tweeted saying, "Delhiites, your son is going to take oath as Delhi chief minister for the third time. You must come to bless your son".

The AAP national convener will be sworn-in as the Chief Minister of Delhi for the third time in a row.

Arvind Kejriwal is scheduled to take oath along with other ministers at Ramlila Maidan.

On Saturday, Kejriwal, through a tweet, has said that autorickshaw drivers, students, teachers, doctors, labourers, etc will be the "chief guests".

The guest list put out by the AAP includes ''Delhi ke Nirmata''- people who contributed to the development of the city during the last five years.

These include Sumit Nagal, a Delhi government school student and an international Tennis player, Laxman Chaudhry an auto driver, Manu Gulati a teacher and "one of the many architects of Delhi Governance Model", Dalbir Singh a farmer, Ratan Jamshed Batliboi - the architect of the famous Signature Bridge among others.

By winning 62 seats by cashing in on the plank of development, his party nearly repeated its 2015 performance, sweeping the Assembly polls in the face of a high-voltage campaign by the BJP, which had fielded a battery of Union Ministers and Chief Ministers in its electioneering, spearheaded by Home Minister Amit Shah.

The BJP marginally improved its tally, managing just eight seats from its 2015''s tally of three seats. The Congress failed to open its account in the second successive election.

New Delhi, Jan 11: Chief Minister of Kerala Pinarayi Vijayan on Saturday met JNU Students' Union (JNUSU) President Aishe Ghosh here at Kerala House on Saturday.

This meeting comes at the backdrop masked mob violence by miscreants who entered the university campus recently and attacked the students and professors with sticks and rods.

"I thank the Kerela government for standing by us and extending solidarity. Its fight Citizenship Amendment Act (CAA) shows how standing is standing for its secular ethos. Students Union takes the inspiration from this struggle," said Students' Union President in a statement after meeting Kerala CM.

She also thanked "the youth and comrades of Kerela" and quoted Pinarayi as saying, "go on we will take this fight ahead."

More than 30 students, including Ghosh, were taken to the AIIMS Trauma Centre.

The Delhi Police Crime Branch investigating the case of violence in JNU had identified and released photographs of nine suspects, including that of Aishe Ghosh.

Earlier on Monday, Kerala CM had said that the "Nazi-style attack" on the students and faculty is an appalling display of intolerance running amok.

Thiruvananthapuram, Apr 23: Amid opposition charges, the Kerala government on Tuesday constituted a two-member committee to examine whether the privacy of personal and sensitive data of COVID-19 patients has been protected under the agreement entered by it with US-based IT firm Sprinklr.

The committee, headed by former Special IT Sscretary M Madhavan Nambiar and former health secretary Rajeev Sadanandan, will also ascertain whether adequate procedures were followed while finalising the arrangements with the private company.

The Opposition Congress has been levelling charges that the collection of data by the US firm violated the fundamental rights of the patients.

In its order, state government said it had initiated steps to set up a Data Analytics platform to integrate data from various sources available in the government to meet the "exigency of a massive and unprecedented surge of epidemic".

The committee will also examine whether deviations, if any, are fair, justified and reasonable considering the extraordinary and critical situation faced by the state, it said.

Meanwhile, the Kerala High Court on Tuesday asked the state government to file its reply by April 24 on a plea seeking to quash its contract with the US-based firm.

Expressing concern over the confidentiality of the citizen's data processed by a third party, the court sought to know why the sanction of the law department was not taken before finalising the agreement.

The court hailed the state government's fight against COVID-19, but said it is concerned about data confidentiality.

The government informed the court that the agreement with Sprinklr has safeguards for data protection "as per standard practices of software as a service model."

The ward-level committees, set up by the government for the anti-coronavirus fight, collect information of those under home isolation, the elderly and those at the risk of the disease, using a questionnaire and later uploads it on the server of the private agency.
