After war, peace: Judge says he knew Tolstoy book was classic

Mumbai, Aug 29: The Bombay High Court on Thursday said it knew that Leo Tolstoy's 'War and Peace' was a literary classic and that it didn't mean to suggest that all the books seized by Pune police in the Elgar Parishad-Koregaon Bhima case were incriminating.

The observation by Justice Sarang Kotwal came a day after media reports said he asked accused Vernon Gonsalves to explain why he kept "objectionable material" like a copy of "War and Peace" at his home.

The purported remarks also stirred up thousands of reactions on Twitter. The hashtag #WarAndPeace has been trending on the social media platform during the day.

Justice Kotwal said, "You have made your point about the books not being banned. Besides, yesterday, I was reading the whole list from the chargesheet. It was written in such poor handwriting. I know War and Peace. I was making a query on the entire list that police has mentioned (as evidence)."

Yug Chaudhary, counsel for co-accused Sudha Bahrdwaj, then told the court that the 'War and Peace' that the court had referred to on Wednesday was a collection of essays edited by one Biswajit Roy, and was titled War and Peace in Junglemahal: People, State and Maoists.

On Wednesday, the court had asked, "War and Peace is about war in another country. Why were you keeping these books at your house."

The judge had also referred to a CD titled "Rajya Dhaman Virodhi" and said the title "clearly suggested" it is material against the state. "Why were you keeping this in your house," he had asked Gonsalves.

Tolstoy's classic novel about Russia during Napoleonic wars became a point of contention during Wednesday's hearing after the Pune Police probing the case claimed that the book was part of the "highly incriminating evidence" it had seized from Gonsalves' house in Mumbai during raids conducted last year.

Pune police had also read out the titles of several other books and CDs allegedly recovered from Gonsalves' house which included CDs titled 'Rajya Daman Virodhi' released by Kabir Kala Manch, 'Marxist Archives' and 'Jai Bhima Comrade'; books 'War and Peace', 'Understanding Maoists' and 'RCP Review', and copies of a circular issued by the National Study Circle.

"The title of the CD 'Rajya Daman Virodhi' itself suggests it has something against the State while 'War and Peace' is about a war in another country. Why did you (Gonsalves) keep objectionable material such as books like 'War and Peace', books and CDs at home? You will have to explain this to the court," Justice Kotwal had said.

Gonsalves was arrested by the Pune police under the Unlawful Activities (Prevention) Act after raids at residences and offices of several activists in connection with the Elgar Parishad case.

The police had claimed provocative speeches made at the Parishad on December 31, 2017 were responsible for the caste violence around Koregaon Bhima village in Pune district the next day during an event to commemorate the 200th anniversary of the Battle of Koregaon Bhima.

One person was killed and others were injured in the violence.

Dalits celebrate the anniversary of the Koregaon Bhima battle every year as they believe that the Army of the British comprising 'Mahars' or scheduled caste soldiers had defeated the forces of the Brahmin Peshwas.

Police are probing alleged Naxal links in organising the Parishad, which was held at historic Shaniwarwada in Pune.

Other arrested accused in the case include activists and academics Shoma Sen, Rona Wilson, Sudha Bharadwaj, Arun Ferreira, and Gautam Navlakha.

New Delhi, Jul 20: Reiterating that China has still occupied India's territory, Congress leader Rahul Gandhi on Monday attacked Prime Minister Narendra Modi saying that he has fabricated a fake strongman image to come to power which has now become India's biggest weakness as he has to protect the idea of 'Chhapan Inch'.

Taking to Twitter, the Congress leader posted a video message and wrote, "PM fabricated a fake strongman image to come to power. It was his biggest strength. It is now India's biggest weakness."

In the video message, speaking on "China's Strategic Game Plan" the Congress leader said: "What is China's strategic and tactical game plan? It is simply not a border issue. The worry I have is that the Chinese are sitting in our territory today. Chinese don't do anything without thinking about it strategically."

"In their mind, they have mapped out the world and they are trying to shape the world. That's the scale of what they are doing. That's what Gwadar is, that is what belt and road is. It is a restructuring of the planet. So when you are thinking about the Chinese you have to understand that that is the level at which they are thinking," he added.

Now at the tactical level, they're trying to improve their position. Whether it is Galwan, whether it's Demchok or whether it is Pangong Lake. The idea is to position themselves, he said.

"They are disturbed by our highway they want to make our highway redundant and if they are thinking larger scale, they want to do something with Pakistan in Kashmir. So it is not simply a border issue. It is a border issue designed to put pressure on the Prime Minister of India," the Congress leader said.

"And they are thinking of putting pressure in a very particular way. And what they are doing, is that they are attacking his image. They understand that it in order for Mr Narendra Modi to be an effective politician; in order for Mr Narendra Modi to survive as a politician, he has to protect the idea of--Chhapan Inch. And this the real idea the Chinese are attacking. They are basically telling Mr Narendra Modi that if you do not do what we say, we will destroy the idea of Mr Narendra Modi as a strong leader," he added.

Gandhi continued saying, now the question is, how will PM Narendra Modi react. Will he take them on? Will he take on the challenge and say absolutely not, I'm the Prime Minister of India. I do not care about my image I'm going to take you on. Or will he succumb to them?

"The worry I have so far is that the Prime Minister has succumbed. The worry I have is, the Chinese are sitting in our territory today and the Prime Minister has said publicly they are not, which to me tells me that is worried about his image and defending his image," said Gandhi.

"And if he allows the Chinese to understand that they can manipulate him because of his image, the Indian Prime Minister will no longer be worth anything for India," he added.

Nagpur, Aug 8: "He was a great son and always the first one to help others in need. He sacrificed his life for the country," said Neela Sathe, the mother of late captain DV Sathe, who was flying the Air India flight that crash-landed at Kozhikode airport on Friday, claiming 18 lives.

Indian Army Retired Colonel Vasant Sathe and his wife Neela lost both their sons in line of duty. The couple is originally from Nagpur, Maharashtra.

Speaking to news agency, Neela broke into tears and said, "He was a great son and always the first one to help others in need. 

His teachers still appreciate him. During the Ahmedabad floods, he saved the children of the soldiers by lifting them in his arms. I wish God would have called us instead of him."

"Both our children sacrificed their lives for the country," she added.

Remembering DV Sathe's childhood, Neela talked about every that moment when he made his parents proud.

Neela told with great pride that Captain DV Sathe had received the Sword of Honor and had also won eight medals in the Air Force.

Neela last talked to DV Sathe over phone call a few days ago during which captain told her mother not to go out of the house amid COVID-19 crisis as if something happens to her, he won't be able to bear that.

Vasant, captain's father retired as a colonel after serving in the Army for 30 years, following the footsteps of their father, both his sons joined too the Army.

Their elder son Vikas, was in the Army, and at the age of 22, he was martyred in an accident in Ferozepur in 1981. Their younger son Deepak (DV Sathe), who served as a pilot in Air India after serving in the Indian Air Force, died in the plane crash on Friday.

An Air India Express plane carrying 190 passengers including 10 infants skidded while landing at Karipur Airport in Kozhikode on Friday evening.

Raipur, Mar 13: Calling Jyotiraditya Scindia a "power-hungry" leader, Chhattisgarh Minister and Congress leader TS Singh Deo on Friday said that if someone joins another party to occupy the top position of the state that he should never become a Chief Minister.

When enquired if Deo has any plans to join the BJP in the future, he quickly said that he would never be able to relate himself with the "ideology" of the party.

"People may make claims but I will never join BJP, even if I get 100 lives I will never associate with that ideology. A person who joins BJP for not being able to become Chief Minister should never become a Chief Minister," he said while speaking to media in Raipur.

"A single person does not remain as captain forever, Kapil Dev got his chance when Gavaskar was there. Currently, Virat Kohli is the captain but in T20 there are different captains. Will Kohli join Pakistan's team if he is not made the captain? This is beyond understanding."

On Wednesday, Scindia joined BJP in New Delhi in the presence of party President JP Nadda. He had resigned from Congress a day earlier after meeting Union Home Minister Amit Shah and Prime Minister Narendra Modi.

He will file his nomination for the Rajya Sabha elections on March 13.

May it be Scindia or some other, misusing power cheating with citizens mandate for their self benifit  "very soon the fare and best judgement from the creator will be their very soon.  No one is greatro than the creator.
