Amit Shah’s son’s lawyer fails to appear; Court defers defamation matter till Oct 16

Ahmedabad, Oct 12: A metropolitan court here today adjourned the hearing of the criminal defamation case filed by BJP president Amit Shah’s son Jay against The Wire as the complainant’s advocate was not present in the court.

A lawyer for Jay Shah sought time from additional chief metropolitan magistrate S.K. Gadhvi, saying that senior advocate S.V. Raju could not be present in the court as he was busy in the high court.

The court granted the time and adjourned the hearing to October 16.

Jay Shah had filed a criminal defamation case in a metropolitan court against The Wire on Monday over a report, which claimed his firm Temple Enterprise’s turnover grew exponentially after the BJP came to power at the Centre in 2014.

The magistrate had ordered a court inquiry in the matter under CrPC section 202 (to inquire into the case to decide whether or not there is sufficient ground for proceeding).

In his application, Shah prayed for “criminal action against the respondents for defaming and tarnishing the reputation of the complainant through an article, which is scandalous, frivolous, misleading, derogatory, libelous and consisting of several defamatory statements”.

The seven respondents in the case are the author of the article, Rohini Singh, founding editors of The Wire, Siddharth Varadarajan, Sidharth Bhatia and M.K. Venu, managing editor Monobina Gupta, public editor Pamela Philipose and Foundation for Independent Journalism, a non-profit company that publishes The Wire.

The Wire‘s editors have described the defamation case as an attack on media freedom and said they intend to fight the matter vigorously.

The case seeks action against respondents under IPC Sections 500 (defamation), 109 (abetment), 39 (voluntarily causing grievous hurt) and 120B (criminal conspiracy).

The court will issue summonses to the respondents only after the initial inquiry establishes a case.

Shah is yet to file a civil defamation suit against the respondents. He had earlier announced that he will also file a Rs 100 crore civil defamation suit.

A political storm has erupted after the article was published.

The Congress has demanded an inquiry into the matter and ouster of Amit Shah, while the BJP called the article defamatory.

New Delhi, Jul 6: India's COVID-19 tally neared the 7 lakh mark with 6,97,413 cases after 24,248 new cases were reported in the last 24 hours, said the Union Ministry of Health and Family Welfare.

As per the Health Ministry, there are 2,53,287 active cases in the country while 4,24,432 patients have been cured or discharged. While one patient has migrated.

425 new deaths were reported in the last 24 hours in the country due to COVID-19, taking the number of patients succumbing to the deadly virus to 19,693.

As per the Health Ministry, Maharashtra continues to be the most impacted state from the infection with 2,06,619 cases and 8,822 fatalities due to the virus. Tamil Nadu in second place has a total of 1,11,151 cases and 1,510 fatalities.

The national capital's COVID-19 cases are also nearing the 1-lakh mark with 99,444 coronavirus cases and 3,067 deaths.

The total number of samples tested up to July 5 is 99,69,662 of which 1,80,596 samples were tested yesterday, informed the Indian Council of Medical Research on Monday.

New Delhi, Aug 7: India's COVID-19 cases tally crossed 20 lakh mark with the highest single-day spike of 62,538 cases on Friday, said Union Ministry of Health and Family Welfare.

The COVID-19 tally rises to 20,27,075 including 6,07,384 active cases, 13,78,106 cured/discharged/migrated and 41,585 deaths, according to the Ministry of Health.

Maharashtra with 1,46,268 active cases and 3,05,521 cured and discharged patients continues to be the worst affected. The state has also reported 16,476 deaths due to the infection.

Tamil Nadu has 54,184 active cases while 2,14,815 patients have been discharged after treatment in the state. 4,461 deaths have been reported due to COVID-19 in the state.

Andhra Pradesh with 80,426 active cases is the third on the list. There are 1,04,354 cured and discharged patients and 1,681 deaths reported from the state.

Delhi now has 10,072 active cases and 1,26,116 cured and discharged patients. 4,044 people have lost their lives due to the disease in the Union Territory so far.

Amaravati, Jan 21: Telugu Desam Party president N Chandrababu Naidu and at least 17 MLAs of his party were taken in police custody late on Monday as they tried to conduct a foot march from the state assembly to nearby Mandadam village in violation of prohibitory orders.

TDP leaders started off on the march after staging a sit-in near the assembly main entrance following the suspension of 17 MLAs from the House for the day.

They were protesting the AP Decentralisation and Inclusive Development of All Regions Bill, 2020, that was passed by the assembly, enabling the establishment of three capitals for the state.

The TDP leaders were taken to the Mangalagiri police station.

Meanwhile, tensions prevailed at the Jana Sena Party headquarters at Mangalagiri as police prevented its president Pawan Kalyan from proceeding to the Amaravati region to speak to protesters fighting for the retention of only one capital for the state.

DIG Kanti Rana Tata and other senior police officials reached the Sena office and blocked the exit of Kalyan and political affairs committee chairman Nadendla Manohar, resulting in an argument.

Kalyan asked how could police impose restrictions within his own office.

Scores of Sena workers gathered outside the office even as a large posse of police was posted to thwart Kalyan and other leaders' plans.
