Anti-rape Bill delayed again, referred to GoM

New Delhi, Mar 12: A bill which seeks to make punishment for crime against women more stringent was today referred to a Group of Ministers for further consultations after differences erupted in the meeting of the Union Cabinet on certain provisions, including lowering the age of consensual sex to 16 years.

anti-rapeSources said the hour-long special Cabinet meeting convened to clear the bill could not arrive at an agreement, following which Prime Minister Manmohan Singh referred it to a GoM.

The proposed GoM is likely to have Finance Minister P Chidambaram, Women and Child Development Minister Krishna Tirath, Law Minister Ashwani Kumar, Home Minister Sushilkumar Shinde and Telecom Minister Kapil Sibal, sources said.

While there was unanimity in the Cabinet to pass the Bill, certain issues remained unresolved.

The bill proposes that the age of consent be lowered from 18 to 16. The issue had led to lengthy inter-ministry consultations with some arguing that it should not be reduced. The Women and Child Development Ministry had opposed the move.

Sexual intercourse under the age of consent is considered statutory rape.

Sources also said some senior ministers were not able to agree on issues such as whether the word "rape" - which is more gender specific- should replace "sexual assault" - which is gender neutral - in the proposal, and how to define voyeurism and stalking, which the bill identifies as criminal offences. The two were for the first time defined as criminal offsenses in the ordinance.

Some ministers expressed concern about not enough safeguards against false evidence and testimony.

The bill retains a key provision of the ordinance under which if rape leads to death of the victim or leaves her in a vegetative state, it can also attract death penalty. The minimum punishment is 20 years in jail which may extend upto the "natural life" of the convict.

The Criminal Law (Amendment) Bill, 2013 will replace the February 3 Criminal Law (Amendment) Ordinance.

The Ordinance will lapse on April 4 - six weeks from February 21 when the Budget session was convened.

Since the ordinance is the 'law of the land' as of today, cases of rape and similar crimes will continue to be registered under its provisions till the President signs the new bill to make it into law.

The Criminal Law (Amendment) Bill, 2012 introduced in the Lok Sabha in December last will be scrapped once the new bill is introduced in Parliament, most likely later this week.

Jan 30: BJP leader and West Bengal party head, Dilip Ghosh has yet again made a controversial statement. He said that one has to go to jail in order to gain respect or become a political leader.

"You will not be a leader if you don't go to jail, if Police don't take you, then you must go there yourself. If they don't give you any scope, you do something to go to jail, only then will people respect you. There is no place for soft people in politics," ANI quoted Ghosh as saying.

Earlier, Ghosh had triggered a controversy by saying that anti-CAA protestors in Assam and Uttar Pradesh were shot dead "like dogs", and similar punishment should be given to protestors in Bengal.

New Delhi, Jun 26: Petrol prices in the national capital have reached Rs 80.13 per litre on June 26, up by 21 paise from yesterday’s Rs 79.92 per litre; while diesel prices in Delhi also rose to Rs 80.19 per litre – up by 17 paise compared to yesterday’s Rs 80.02 per litre.

This is the 20th consecutive day that fuel prices have been hiked by oil marketing companies (OMCs). The hikes began from June 8 after a 83-day halt on revised pricing during the lockdown period.

The state government’s increased value-added tax (VAT) on diesel since May is causing the fuel’s prices to soar in Delhi. VAT was increased to 30 percent for both petrol and diesel from 27 percent and 16.75 percent, respectively.

Coupled with the Centre’s hiked excise duty of Rs 3 per litre since March 14 and then Rs 10 per litre on petrol and Rs 13 per litre on diesel since May 5 has affected prices.

The hike on diesel prices is unusual, as the government traditionally keeps the price for the fuel low due to its impact on agriculture and other high consumption economic activities.

New Delhi, Feb 1: India has uplifted 271 million people out of poverty, Finance Minister Nirmala Sitharaman said on Saturday.

In her second Budget presentation, the finance minister said the Budget for 2020-21, is woven around aspirational India, economic development and caring society.

The government aims to achieve seamless delivery of services through digital governance, she added.

"We shall strive to bring ease of living for every citizen," Sitharaman said.
