Ban oral, unilateral and triple talaq; stop polygamy: Central govt panel

New Delhi, Mar 31: A high-level committee set up by the Central government to review the status of women in India has reportedly recommended a ban on the practice of oral, unilateral and triple talaq (divorce) and polygamy - a demand already made by a majority of Indian Muslim women.

As per a report published in the leading daily The Indian Express, the assessment of family laws governing Muslim community members is part of a voluminous report submitted last year by the panel appointed by the previous Congress-led UPA government.

However, the recommendations of the panel have not been made public as yet.

The Supreme Court, while responding to a plea on the divorce norms, had on Monday directed the Centre to produce the report within six weeks.

The plea was filed by a Muslim woman hailing from Uttarakhand against her triple talaq.

The recommendations of the panel supports the demand for the ban on the grounds that such talaq renders “wives extremely vulnerable and insecure regarding their marital status”.

The panel, in its report, has recommended specific amendments to the Dissolution of Muslim Marriages Act 1939 coupled with suggestions for introducing provisions to provide interim maintenance.

The report states that payment of maintenance to the wife and children must be made mandatory in the event of separation or divorce.

The landmark ruling of the Supreme Court in 1985 in the Shah Bano case recognised the Muslim woman's right to maintenance, but was never actually codified in the Muslim personal law.

The report further states that ''all judges should be made aware of the manner in which the SC has interpreted the Muslim Law and has safeguarded the rights of Muslim women.”

The 14-member committee, which was constituted by the Ministry of Woman and Child Development under the UPA government in February 2012, was reconstituted in May 2013.

It was headed by Pam Rajput, founder director of Centre for Women's Studies, Punjab University.

Last year, a survey conducted by the Bharatiya Muslim Mahila Andolan (BMMA) claimed that 92.1 percent Indian Muslim women want oral, triple talaq to be banned.

In Islam TALAK(divorce) is not easy way. For Talak(divorce) should be pass from 3 stage. that's called 3 TALAK.
Some Muslims and Non Muslims thinking that, one who telling at a time 3 TALAK, TALAK is over. It is again shariya(LAW) and they donot fear Allah(s).
Muslim cannot give TALAK for simple issue. Allah(s) will punish those who are giving TALAK for simple issue and those who not follow correct way of TALAK.

Islam gives ways for couple who couldn't get together...In certain religion there is no such concept of divorce once they are married there is no way of separating till death ...In Islam talaq or divorce is discouraged...If the couple can't get together then it provide means to seperate through talaq...If once talaq is said it doesn't end in divorce in between there is way to reconcile,couples should try to keep aside their differences..Only if scuffle further continues then it is better way to get divorced rather than ending in violence..There is nothing called 3 talaqs in single setting..It is against the concept of talaq..There are people who misuse it..There is talaq and waiting time
For women there is concept of khula if the men doesn't look his wife well she can divorce him through Khula...
For those who comment with pseudoname on burkhah...Burkhah is not recommended...Islam only says cover your hair and body and be modest...If someone is unhappy they can go in khujrao style we are not forcing them..For men too there is hijab..I.e from top of navel till knee..Body of men and women are not the same.......Most of our women wear burkhah willfully..Not like a man forcing women and tying tali on her neck..which she has to carry the burden till her death

Dear avinash, Your comments shows how ignorant you are. Please think and analyze. Hizab is required in public places not at home. This is for security and modesty of the women. Actually she is not suffering , the person who want to see her beauty or nudity is suffering. Please check the diffrence between the women who wear hijab and other with sari. In sari you can figure out everything about that women which usually men like you want. This is weakness of all the men.
Hijab also treats all the women at par. You can not differentiate her as white/ Black, rich or poor, what she wear costly one or cheaper one? I think hijab should applied for all the women irrespective of religion for the safety and modesty of the women.

Regarding Talaq & polygamy , We know , sometimes uncultured people misused and endangered to the life of muslim women .. but compared to misuse of human laws or any national laws , is misused very less ... even complaints by muslim women also very rare except some modern women by the influence any particular vested interests....
In a civil country , if anybody misused law , actions to be taken against them , banning it is not the solution...
Burkha , Hijab are the modest dress to pious people .. there is no compulsion to wear it , if you doesn't like , you may find , a lot muslims , who do not wear burkha or hijab... questioning others rights to wear is like..... I am prostitute ... demand for others also same....!

Good for NON MUSLIMS ... (Other wise there are some honest non muslims who are EAGER to know about the CREATOR, if such thing doesnt happen they will never know who is their TRUE creator)
Despite several reminders from Muslim leaders which they also quote from various religious scriptures that GOD is one and Worship him ALONE...
People are still not waking up for the message of ONE GOD. who created them and all that exists..

& We MUSLIMs expect that cos Prophet Muhammad pbuh said a Time will come when people dont know who is their CREATOR. and there will be many followers who will follow BLINDLY (Without even pondering HOW they Got this LIFE, What is the purpose of LIFE and living a life of UNAWARE)>>> It is happening infront of our EYES in the present age..

Hmm.. Not Surprising, the Central Govt. Panel (moderated by VHP ) is keen on enforcing a law like this.

And they want ban on polygamy..What irony !!

With regards to muslim women asking for such law, we muslims wouldn't really have much of problem if the Govt. brings such law. We understand these women, as some men tend to take unfair advantage of the given Shariah Law. Infact, this law banning such Talaq, and polygamy, will make us more responsible of our community and discipline us.
Banning hijab, hmm don't even think of it. If these women don't want to wear, let them not be forced. and let them
also not enforce their thoughts on other women who want to wear Burkha/Hijab etc...

Make Islamic law a Indian law so that it will become uniform law. Since Hindus or Christians do not have any religious laws there should not be any problem for them to follow Islamic law. Hope Govt of India make Sharia law applicable to all Indian citizens. Please note Criminal Law is already applicable equally irrespective of their religion & Muslims do not have problem with that. 1400 years of research has been done on Islamic sharia law and is practical law unlike man made laws.

Mangaluru, Feb 28: BJP Corporator in Mangaluru's ward number 46 (Cantonment), Divakar, has been elected as the Mayor of the city on Friday. While Janaki aka Vedavathi, Corporator of ward number 9 (Kulai), has been elected as the Deputy Mayor.

Divakar secured 46 votes including that of MLAs D Vedavyasa Kamath and Dr Y Bharath Shetty.

Regional Commissioner V Yashwanth conducted the election at the Council Hall of Mangaluru City Corporation (MCC).

Two nominations were filed for the post of Mayor. Congress had fielded Keshav, representing ward 37 (Maroli) for the post of Mayor. Keshav secured 15 votes including that of MLC Ivan D'Souza.

Congress had fielded Zeenath Samshuddin of ward number 44 (Bunder) for the post of Deputy Mayor and secured 17 votes.

Two Social Democratic Party of India (SDPI) corporators remained neutral for the post of Mayor while they supported the candidature of Zeenath Samshuddin of Congress for the Deputy Mayor post. Janaki aka Vedavathi of the BJP secured 46 votes.

The BJP had swept the elections to the 60-member council held on November 12 by winning 44 wards, while the Congress won 14 wards. Social Democratic Party of India won two seats.

Election to the post of Mayor and Deputy Mayor was conducted as per the reservation roaster for the 21st term dated September 3, 2018. Accordingly, the Mayor's post was reserved for candidate from BCM ‘A’ category while that of Deputy Mayor for woman general.

Bengaluru, Feb 2: The monthlong budget session beginning on Monday, which will mark BS Yediyurappa’s maiden budget in his fourth term as chief minister, is expected to be a fiery one.

The opposition JD(S) and Congress have already threatened to stall proceeding until BJP legislator Basangouda Patil Yatnal apologises for his controversial remarks against freedom fighter and centenarian HS Doreswamy. Yatnal had called him a fake and a Pakistani agent.

Disruptions are also likely to pose a threat to speaker Vishweshwar Hegde Kageri’s novel idea of having a two-day discussion on the Constitution of India to commemorate 70 years of the country’s Independence.

Both opposition parties have scheduled legislature party meetings early on Monday and they could coordinate on issues on the floor of the house to put the BJP — especially Yediyurappa — on the backfoot.

Yatnal is not known as a “hardliner”, but his attack on Doreswamy has garnered support from several ministers including CT Ravi, KS Eshwarappa and V Somanna. Yediyurappa may have a hard time defending his party’s line.

The BJP is yet to schedule its legislature party meeting, but MLAs suggest the party will allow the issue to be raised and debated in the legislature. “Both have expressed their point of view. Let there be a discussion on the matter, but not allowing the house to function will only be a waste of the state’s time and money,” said deputy chief minister CN Ashwath Narayan.

Besides the Doreswamy issue, Yediyurappa will also deliver his reply — postponed from February 20 — to the debate on the governor’s address. The issue of student Amulya Leona Narona’s arrest on a charge of sedition, the Bidar sedition case involving a parent of a school student, pro-Pakistan writings on walls in places in north Karnataka, introduction of NPR and the anti-CAA stir is also likely to feature during the lengthy session.

Words Jihad and Jihadi have been in abundant use for the negative purposes from last two decades in particular. They have been closleyl linked to the word terrorism and violence, done by section of Muslims here and there. This global use of word is particularly a post 9/11 phenomenon. Just to recapitulate after the WTC was hit by two aeroplanes; the building sunk leading the death of nearly three thousand innocent people. The victims belonged to most countries and religions. In the aftermath; Osama bin Laden called it Jihad. American media coined the word Islamic terrorism since then. Most of the acts indulged in by Muslim terror groups have been labelled under this title. This; irrespective of the fact that many an Islamic Scholars, many a Muslim clerics like Maulanas of Deoband and Barelvi, stating that Islam does not approve of violence against innocent people. The words have stuck.

This has also beoame one more weapon in the hands of communal sectarian elements. Apart from the mainstream media social media has been delving this with gay abandon using these words in a derogatory way. The lap media also called Godi media, which is an important part of the opinion making against Muslims has been using it day in and day out.

Recently (March 11, 2020), Mr. Sudhir Chaudhary, the Editor-in-Chief of Zee channel in a show went on to the limits of this misrepresentation by showing a chart and classifying Jihad into various categories, Love, Jihad, Land Jihad and latest in series being Corona Jihad in the wake of Tablighi Jamaat event. Mr Chowdhary concluded that all these types of Jihad are being done to weaken India. Surely, these types of programs have been increasing and intensifying Hate against Muslims and Jihad.

Unlike most of the times, this time around a complaint was filed against the said editor, a FIR was filed and lo and behold the editor’s tune changed.  In the next program he talked respectfully about the word Jihad! The tone and tenor changed. Was it a late realization or the fear of facing criminal action which made him change the tune, he alone should know, but that’s another chapter to the story?

As such jihad is by and large used as synonym for violence, terrorism. This is very much contrary to the its use in Koran.. Islamic scholar Asghar Ali Engineer argues that its use in Koran is multilayered. It stands for ‘utmost striving’ and has nothing to do with violence against innocents. As per him the concept of Jihad is far above violence. Those indulging in power games have used it as a cover for expanding power and called it as Holy War. This is very similar to the use of word Crusade by Christian Kings and Dharm Yudh by Hindu kings.

A deeper and more rational study of Koran and Hadith bring forth the real meaning of the term. Sufi’s who were away from the power struggle and focussed on spiritual aspects of religion like Bhakti Saints or liberation theologians, unfolded the deeper meaning of the term. Engineer points out that “it is for this reason that they describe war as jihad-e-Asghar and jihad to control one’s greed and selfish desires as jihad-e-Akbar (Great jihad)” (On Multi Layered Concept of Jihad, in A Modern Approach to Islam, Dharmaram , Page 26, 2003, Bangalore)

The reference to Jihad comes in Koran over 40 times, mostly referring to Jihad-e-Akbar, striving to overcome personal greed and selfishness. The real transformation of the word Jihad in popular perceptions and Chaudhary is the extreme example of that, takes place during the training of Mujahideen in the few specially set up Madarssas in Pakistan. This was initiated and coordinated by America in the decade of 1980s, when the Russian Army occupied Afghanistan. That was the time American forces were totally demoralised due to their humiliating defeat in Vietnam, at the hands of Vietnamese people.

To confront the Russian army, US planned to join the anti Russian forces. For this with the help of extremist Salafi version of Islam, they promoted the radical tendencies within a section of Muslims. The brain washing of the Asian Muslim youth as Mujahedeen to Taliban took place in few Pakistani Madrassas, totally funded by America. For this funding opium trade was also put into operation. The brainwashing module designed in Washington incorporated many components which also distorted the concept of Kafir, and created Hate against communists. Communists were labelled as Kafirs (Non believers) and so killing them was presented as Jihad. Getting killed while doing such an act was to be rewarded with entry pass to Jannat with 72 virgins waiting for those embracing this path.

America further went on to promote Taliban and Al Qaeda, which joined anti Russian forces, leading to defeat of Russian forces. Mahmood Mamdani in his book ‘Good Muslim Bad Muslim’ makes an inference based on CIA documents that America invested 8 thousand million dollars and also supplied seven tonnes of armaments, including the most sophisticate missiles to these forces. One also recalls the Al Qaeda leaders’ visit to US, White house. In the Press meet the then US President Ronald Regan, introduced them as being the equivalents of founding fathers of United States as they are fighting against the evil of communism.

Now of course the situation has taken its own turn and nearly three decades after their inception the same elements, later followed by ISIS and IS acted like Frankenstein’s monsters, killing Muslims in large numbers. It is estimated that over 70000 Pakistanis have been killed due to the action of these groups, who were propped up and nurtured by US to enhance its control over the oil wells of West Asia.

The likes Sudhir Choudhary can merrily propagate the Hate using the term Jihad. That such elements can also be partly controlled through the process of law is a part of great learning after the FIR filed against him. One hopes that such hate filled programs will come to a halt once we combat them ideologically and after resorting to the provisions of Indian Constitution.
