Beef possession not a criminal offence, rules Bombay HC

May 6, 2016

Mumbai, May 6: The Bombay High Court on Friday pronounced the judgement on a bunch of petitions challenging the constitutional validity of the beef ban in Maharashtra.

BeefAccording to news agency, the Bombay HC has passed order, which says that beef ban will continue in Maharashtra.

A ban on cow and bullock slaughtering to continue but beef possession (if brought from outside Maharashtra) is not a criminal offence, ruled the HC.

A division bench of Justices AS Oka and SC Gupte had reserved the ruling in January after hearing the arguments.

In February 2015, the President granted assent to the Maharashtra Animal Preservation (Amendment) Act. While the original 1976 Act banned slaughter of cows, the amendment prohibited, in addition, slaughter of bulls and bullocks and possession and consumption of their meat.

As per the Act, slaughter attracts a five-year jail-term and Rs 10,000 fine while possession of meat of bull or bullock attracts one-year in jail and Rs 2,000 fine.

During the hearing, the HC had refused to grant interim stay to the provisions penalising the possession of beef.

Arif Kapadia, a city resident, and noted lawyer Harish Jagtiani had challenged the provision which says mere possession of beef anywhere in the state is a crime.

This is arbitrary and undermines the cosmopolitan nature of the city which houses people from all religions and communities, they had contended.

Other petitions had been filed by Vishal Sheth, a lawyer, and Shaina Sen, a student, contending that the ban on beef violates fundamental rights of citizens.

Why not other items like chicken, pork, fish and mutton not touched by the law. All lives are equally important but why this special category. Then all should be asked to be vegetarians

One thing which Fadnavis should have concentrated is to make possession of cow and bulls attractive proposition to holders rather than go for ban on slaughter. this he would have achieved by making green every where, make water available and feed available, provide effective cost recovery of produce .. instead by banning he is burdening people who possess assets as cattle more marginalized and economically poorer .. his vision and his party''s vision is self centered and lacks focus of economics but working against poor, marginalized farmers, dalits and minorities,,, classic case of intolerance, stupidity and religious bigotry,, he deserves to be sacked ..

Mar 11: Two activists of Sangh Parivar have been arrested by the police in Tamil Nadu’s Coimbatore for hurling a petrol bomb at a mosque in Ganapathy on March 5.

The miscreants had hurled petrol bombs at the front gate of Hidayathul Sunnath Jamath Mosque at Vedhambal Nagar near Ganapathy in Coimbatore around 1 am on March 5. Since the bomb did not explode, nobody was injured in the incident.

Following a complaint from the Secretary of the Jama’ath, the police had formed three separate teams to nab the miscreants.

Based on tip-offs, the police detained BJP member Pandi (41) and VHP member Akhil (23), both from Rathnapuri in Coimbatore for inquiry.  The duo has also been remanded to judicial custody.

According to a statement by the Coimbatore police, the accused told the police that they hurled petrol bomb at the mosque to protest against the attack against Anand, a Hindu Munnani functionary a few days ago. The accused also reportedly told the police that they were planning to create more chaos.

Madukkarai Anand, the District Secretary of Hindu Munnani was attacked on March 4, while he was returning home after participating in a pro-CAA dharna organised by the BJP and allied parties in Gandhipuram.

He was allegedly followed by men on two motorbikes, who attacked him with rods. Anand suffered head injuries in the attack and was admitted to a hospital. The Podanur police registered a case for attempt to murder based on a complaint and had also formed special teams to nab the accused. However, no one has been apprehended in that case till now.

Based on the statements given by the accused, the police arrested the two men, seized the two-wheeler they used, two cell phones and the things they used to manufacture the petrol bomb.

Tumakuru, Jan 8: RSS leader Kalladka Prabhakar Bhat stoked controversy on Wednesday by stating that 'Jawaharlal Nehru University (JNU) is full of traitors'.

He was addressing the media after taking part in a pro-CAA rally organised by National Citizens Forum near the office of the deputy commissioner of the district here.

Bhat said, “JNU is full of traitors. Congress and communist parties have been generating anti-nationals there. But there is no need to close the university down. Modi government will handle it.”

“Nationalism should be infused among the students there through love and trust. They should be made to realize what the truth is,” he said.

Unfortunate, still he has poor followers to believe him.

He is safe at home and sacrifiers are poor boys who blindly believe and obey him.

This guy is sick and irriversible.

God will reward him so that his followers believe his exploiting orders.

Hubballi, Jan 6: Elected representatives of the BJP, Congress and JD(S) on Sunday decided to sink their differences and fight unitedly for Karnataka’s rightful share in the Mahadayi and Kalasa-Banduri water dispute with Goa.

The meeting convened by JD(S) MLC Basavaraj Horatti here saw participation of BJP ministers Prahlad Joshi and Jagadish Shettar, Congress and JD(S) lawmakers, among others.

After a 70-minute closed door meeting, MLC Horatti told reporters that they discussed the water dispute in detail and decided to take steps based on inputs from legal and technical experts on the rightful apportioning of water. “Today, we took the first big step towards the overall development of the region, unencumbered by political divisions,” he said.

Though the air was filled with a sense of jubilation as the issue had united seemingly hostile political parties on one side, a few activists expressed disappointment that the meeting failed to set a timeline to resolve the dispute.
