Bhopal tragedy in UN list of major industrial accidents

United Nations, Apr 20: The 1984 Bhopal gas tragedy which killed thousands of people is among the world's "major industrial accidents" of the 20th century, a UN report has said, warning that 2.78 million workers die from occupational accidents and work-related diseases each year.

The report released by the UN labour agency International Labour Organization (ILO) said in 1984, at least 30 tons of methyl isocyanate gas, which was released from the Union Carbide pesticide plant in the Madhya Pradesh capital, affected more than 600,000 workers and nearby inhabitants.

"The Government figures estimate that there have been 15,000 deaths as a result of the disaster over the years. Toxic material remains and thousands of survivors and their descendants have suffered from respiratory diseases and from damage to internal organs and immune systems," it said.

The report titled 'The Safety and Health at the Heart of the Future of Work - Building on 100 years of experience' said the Bhopal disaster was among the world's "major industrial accidents after 1919".

Among the other nine major industrial disasters after 1919 listed in the report are the Chernobyl and Fukushima nuclear disasters as well as the Rana Plaza building collapse.

In the Chernobyl disaster in April 1986, one of four nuclear reactors at the Chernobyl power station in Ukraine exploded, releasing at least 100 times more radiation than the atom bombs dropped on Nagasaki and Hiroshima.

The explosion killed 31 people immediately and thousands of people in the aftermath.

"The number of casualties in the region increases every year due to long term effects including a sharp increase in thyroid cancer," the report said.

Following a major 9.0 magnitude earthquake and tsunami which struck north-eastern Japan in March 2011, the Fukushima nuclear power plants experienced equipment failures which caused a series of explosions, fires and radiation releases, causing injuries to plant workers and emergency responders, it said.

In one of the worst industrial disasters in Bangladesh, the Rana Plaza building in Dhaka collapsed in April 2013. The building, which housed five garment factories, killed at least 1,132 people and injured more than 2,500.

According to recent estimates released by the ILO, each year 2.78 million workers die from occupational accidents and work-related diseases (of which 2.4 million are disease-related).

An additional 374 million workers suffer from non-fatal occupational accidents. It is estimated that lost work days globally represent almost four per cent of the world's GDP, and in some countries, this rises to six per cent or more.

The report attributes stress, excessively-long working hours and disease to worker casualty every year, underlining ILO's message that no paid work should threaten a worker's wellbeing, safety or life.

The agency also identified several new or existing occupational risks of growing concern, that affect women more than men.

These include modern working practices overall, world population growth, increased digital connectivity and climate change, which are believed to account for losses of almost four per cent of the global economy.

"The world of work has changed, we're working differently, we're working longer hours, we're using more technology," ILO's Manal Azzi told UN News.

"The report says 36 per cent of workers are working excessive long hours, meaning more than 48 hours per week," she said.

Noting that "people are increasingly asked to produce more and more, they have no time to rest," Azzi highlighted that women are particularly at risk because they tend to be the primary carer for children or parents and lack the time to exercise.

"Not only do you work when you're at your office but then you're working at home as well," Azzi said, adding that "so it's a lot of sedentary work and that affects cardiovascular diseases as well".

The greatest proportion of work-related deaths – 86 per cent – come from disease, according to the ILO, with some 6,500 people a day dying from occupational diseases, compared to 1,000 from fatal occupational accidents.

The greatest causes of mortality are circulatory diseases (31 per cent), work-related cancers (26 per cent) and respiratory diseases (17 per cent).

"As well as the economic cost we must recognise the immeasurable human suffering such illnesses and accidents cause. These are all-the-more tragic because they are largely preventable," Azzi said.

Launched during the ILO's centenary year – and ahead of the World Day for Safety and Health at Work on April 28, the report underlines the life-saving value of promoting prevention, to save lives and encourage healthy working environments.

"Serious consideration should also be given to the recommendation of the ILO's Global Commission on the Future of Work, that occupational safety and health be recognised as a fundamental principle and right at work," Azzi said.

The report said that new risks may emerge whereas other risks may be on the rise.

"While the road ahead presents many new challenges to safety and health at work, it is important for governments, employers and workers, and other stakeholders to seize the opportunities to create a safe and healthy future of work for all," it said.

Since 1919, the ILO has adopted more than 40 international labour standards promoting occupational health and safety.

Washington, Mar 26: Indian-American hoteliers have come forward to rescue the stranded Indian students in the US following implementation of lockdown measures in the country in response to the rapidly-spreading coronavirus pandemic, offering them free accommodation and free meals.

With the students scrambling for a roof over their heads after being asked to vacate their hostels and India banning international flights for a week from March 22 due to the coronavirus pandemic, more than 6,000 rooms in nearly 700 hotels were offered to them by Wednesday following a call from the Indian Embassy.

The Indian Embassy have been running a round-the-clock helpline since last week for the students in the US, who number over 2,50,000.

Most of these hotels offered are in and around universities and colleges, but the hotel owners from across the country have come up in large numbers to the call given by community leaders, who have roped in Asian American Hotel Owners Association (AAHOA) for the purpose.

India's Ambassador to the US Taranjit Singh Sandhu said in a tweet, "It is heartening to see that Indian; Indian-American and other hotel owners are coming forward to help people with accommodation in these testing times. Together we can overcome the fight against COVID19!"

"The Indian community has come together to help the student and many hotel owners have offered their rooms free of cost to them. Many of them are also offering free meals to these students," Chicago-based community leader Nirav Patel told PTI.

Indian-American hotelier couple K K Mehta and Chandra Mehta have offered more than 100 rooms to Indian students at their two prime properties each near the Times Square and Barclays Center in New York City, said Jaipur Foot USA chairman Prem Bhandari on behalf of the hotels.

The Indian Consulate in New York had contacted them about this 10 days ago, he said.

"These students are the future of both India and the United States. All the top Indian-American CEOs, scientists and doctors came to this country as a student. It's our moral duty to help them with our resources," Bhandari said.

Regional director of AAHOA Upper Midwest Kalpesh Joshi said they had created a master list of the availability hotel rooms, which was being constantly updated.

Free accommodation would be allocated in coordination with the Indian Embassy and its consulates, he said.

"The Indian Embassy and its consulates are working tirelessly to get these students rooms," he added.

Joshi has also sent out a video message to his hotelier colleagues: "Because of the coronavirus outbreak, our Indian students in the US are out of shelter. Let's work together. As a hotelier, I would like to request all my hotelier friends to come forward... let's provide some rooms to the students."

Boston-based Computer Society of India (North America) has collaborated with AAHOA to help students and Indian IT professionals searching for emergency accommodation due to the COVID-19 lockdown.

Anyone who is having financial hardship will be given hotel accommodation either free of cost or the rates will not be more than USD 50, said the Computer Society of India (North America).

Minesh Patel, the chairman of Virginia Asian American Store Association, said between Richmond, Norfolk, and Virginia Beach, Indian-American hotel owners can help in arranging accommodation for over 500 Indian students.

Florida-based Vipul Patel, the national president of Asian American Store Owners Association, said support for the Indian students have been pouring in from the Indian-American hoteliers.

"I have not come across any hotel owner who said no to us," Patel said.

Rooms would be allocated to students on the recommendation of the Indian Embassy and its consulates in Houston, Chicago, Atlanta, San Francisco and New York.

The Indian Consulate in New York was the first to take a lead in this regard. It has worked with Hammock Worldwide Hotels and Resorts to provide temporary accommodation for the students at a flat rate of USD 50 per night.

Joshi said that initially there was a suggestion to charge a convenience fee of USD 20-25 per day from the students.

"But when a few of them offered free rooms and free meals, everyone agreed to it," he said.

According to Johns Hopkins University coronavirus tracker, the number of deaths caused by the novel coronavirus in the US rose to 1,031 with 68,572 confirmed cases. The US has the third highest number of confirmed cases behind China and Italy.

New Delhi, Jun 18: Vodafone Idea on Thursday told the Supreme Court that it has incurred Rs 1 lakh crore losses as it insisted it is not in a position to furnish bank guarantees.

A bench comprising Justices Arun Mishra, S. Abdul Nazeer, and M.R. Shah, taking up the adjusted gross revenue (AGR) matter through video conferencing, directed the telecom companies to submit their financial documents and books for the last 10 years.

Asking Vodafone if it was a foreign company, the bench said that how can the company say it would not furnish any bank guarantee.

"What if you fly away overnight in future without paying anything?" it asked.

Senior advocate Mukul Rohatgi, representing Vodafone Idea, denied his client is a completely foreign firm and cited before the bench its tie-ups and investments.

Vodafone owes over Rs 58,000 crore as AGR dues and so far, has paid close to Rs 7,000 crore.

Rohatgi contended before the court that the telecom company is in a tough situation, and cannot furnish any fresh bank guarantee, as profits have eluded the company in past many quarters. He submitted before the bench that Rs 15,000 crore bank guarantees are lying with the government, and his client's losses are over Rs 1 lakh crore.

"I cannot offer any more surety," he informed the bench.

Justice Mishra noted that this is public money and these dues should be recovered. "Do not tell us that you will pay if you were to make profits... the money must come," he noted.

Justice Shah observed that the telecom industry is the only industry which earned during the Covid-19 pandemic. "After all, this money will be used for public welfare", he said.

Rohatgi argued that his client would have to fold up if orders were issued to clear dues tomorrow. "11,000 employees will have to go without notice, as we cannot pay them," he added.

Senior advocate Abhishek Manu Singhvi, appearing for Bharti Airtel, contended before the court that out of Rs 21,000 crore AGR dues, the company has already deposited a sum of Rs 18,000 crore.

He argued that his client has given a bank guarantee, in excess of demand, to DoT, and supported the proposal for phased repayment of remaining AGR dues. He insisted that the company needs to sit down with the government and calculate the dues. Airtel owes Rs 25,976 crore after paying Rs 18,000 crore, as per the government.

Senior advocate Arvind Datar, representing Tata Telecom, informed the bench that his client has paid Rs 6,504 crore in AGR dues so far, and furnishing a bank guarantee may adversely impact investments in the sector.

The total AGR dues are close to Rs 1.5 lakh crore.

The top court will now take up the matter in the third week of July.

Jun 23: US President Donald Trump has issued a proclamation to suspend issuing of H-1B visas, which is popular among Indian IT professionals, along with other foreign work visas for the rest of the year.

Trump said the step was essential to help millions of Americans who have lost their jobs due to the current economic crisis.

Issuing the proclamation ahead of the November presidential elections, Trump has ignored the mounting opposition to the order by various business organisations, lawmakers and human rights bodies.

The proclamation that comes into effect on June 24, is expected to impact a large number of Indian IT professionals and several American and Indian companies who were issued H-1B visas by the US government for the fiscal year 2021 beginning October 1.

They would now have to wait at least till the end of the current year before approaching the US diplomatic missions to get stamping. It would also impact a large number of Indian IT professionals who are seeking renewal of their H-1B visas.

“In the administration of our Nation's immigration system, we must remain mindful of the impact of foreign workers on the United States labour market, particularly in the current extraordinary environment of high domestic unemployment and depressed demand for labour,” said the proclamation issued by Trump.

In his proclamation, Trump said that the overall unemployment rate in the United States nearly quadrupled between February and May of 2020 -- producing some of the most extreme unemployment rates ever recorded by the Bureau of Labor Statistics.

While the May rate of 13.3 percent reflects a marked decline from April, millions of Americans remain out of work.

The proclamation also extends till the end of the year his previous executive order that had banned issuing of new green cards of lawful permanent residency.

Green card holders, once admitted pursuant to immigrant visas, are granted "open-market" employment authorisation documents, allowing them immediate eligibility to compete for almost any job, in any sector of the economy, he said.

“American workers compete against foreign nationals for jobs in every sector of our economy, including against millions of aliens who enter the United States to perform temporary work. Temporary workers are often accompanied by their spouses and children, many of whom also compete against American workers,” Trump said.

“Under ordinary circumstances, properly administered temporary worker programmes can provide benefits to the economy. But under the extraordinary circumstances of the economic contraction resulting from the COVID-19 outbreak, certain non-immigrant visa programmes authorising such employment pose an unusual threat to the employment of American workers,” he said.

For example, Trump said, between February and April of 2020, more than 17 million United States jobs were lost in industries in which employers are seeking to fill worker positions tied to H-2B nonimmigrant visas.

“During this same period, more than 20 million United States workers lost their jobs in key industries where employers are currently requesting H-1B and L workers to fill positions,” he said.

“Also, the May unemployment rate for young Americans, who compete with certain J non-immigrant visa applicants, has been particularly high -- 29.9 percent for 16-19-year-olds, and 23.2 percent for the 20-24-year-old group,” he said.

“The entry of additional workers through the H-1B, H-2B, J, and L non-immigrant visa programmes, therefore, presents a significant threat to employment opportunities for Americans affected by the extraordinary economic disruptions caused by the COVID-19 outbreak,” Trump said.

Trump observed that excess labour supply is particularly harmful to workers at the margin between employment and unemployment -- those who are typically "last in" during an economic expansion and "first out" during an economic contraction.

In recent years, these workers have been disproportionately represented by historically disadvantaged groups, including African Americans and other minorities, those without a college degree, and Americans with disabilities, he said.

The proclamation suspends and limits entry into the US of H-1B, H-2B and L visas and their dependents till December 31, 2020. It also includes certain categories of J visas like an intern, trainee, teacher, camp counselor, or summer work travel programme.

The new rule would apply only to those who are outside the US, do not have a valid non-immigrant visa and an official travel document other than a visa to enter the country.

According to the proclamation, it does not have an impact on lawful permanent residents of the United States and foreign nationals who are spouses or child of an American citizen.

Foreign nationals seeking to enter the US to provide temporary labour or services essential to the food supply chain are also exempted from the latest proclamation.
