Birth of third child will disqualify you from contesting panchayat polls: SC

New Delhi, Oct 25: The Supreme Court on Wednesday ruled that birth of a third child would automatically disqualify a person from contesting panchayat polls and from holding the post of a member or sarpanch in a panchayat.

Scotching attempts by a tribal sarpanch in Odisha to step around the disqualification law by giving away one of his three children in adoption to comply with the two-child norm, a bench of Chief Justice Ranjan Gogoi and Justices SK Kaul and KM Joseph said the legislative intent in Panchayati Raj Act was to bar any person having three 'live births' in her/his family from contesting panchayat elections or holding posts in panchayats.

"The legislative intent is to restrict the number of births in a family and not on the basis of benefit available under the Hindu Adoption and Maintenance Act in regulating the number of children by giving the excess children in adoption," the CJI-led bench said.

The petitioner, Minasingh Majhi, had challenged an Orissa high court decision to disqualify him from holding the sarpanch's post in a panchayat in Nuapada district after the birth of his third child. Two children were born to him and his wife in 1995 and 1998. He was elected sarpanch in February 2002, but the birth of the third child in August 2002 led to his disqualification from the post.

His counsel Puneet Jain argued that he had given the first born in adoption in September 1999 and as Hindu Adoption and Maintenance Act provides that once a child is given in adoption, that child ceases to be a member of the original family, his client remained compliant with the two-child norm to hold the post of sarpanch.

Jain argued that though Majhi was the biological father of three children, legally he had two children as the first born was given away in adoption to another family and, hence, he was compliant with the norm set by the Odisha Gram Panchayat Raj Act.

The bench said, "We do not know whether the law intended to make panchayat members and sarpanchs the role model for entire India by fastening the two-child norm on them. But the legislative intent appears clear that it wanted to put a cap on the number of children at two for those holding elected posts in panchayats."

Jain argued that twins and triplets were born to persons and asked whether they should be disqualified from contesting panchayat elections or holding elected posts in the grassroots level democratic institution? The bench said the situation did not apply to the case in hand and clarified that birth of twins and triplets was a rare phenomenon and the court would take an appropriate decision when such a case was brought before it.

Howrah, Jan 8: Following the 'Bharat Bandh' called by trade unions, protesters blocked railway tracks in Howrah and Kanchrapara in North 24 Parganas on Wednesday.

They raised anti-government slogans and criticised the Center for its policies. They were holding placards, posters and banners against the government.

Commuters faced difficulties as bus services were also affected. CPI (M) protesters also stopped the operation of state transport buses. In Odisha, the public agitation started around 6 am at Talcher, Bhubaneswar, Brahmapur, Bhadrak and Kendujhargarh.

Due to the protests, the following trains are detained enroute at different stations --Bhadrak-Brahmapur passenger at Bhadrak, Kendujhargarh-Bhubaneswar passenger at Kendujhargarh, Bhubaneswar-Balangir InterCity at Bhubaneswar, Howrah-Yesvantpur Express at Brahmapur, Ichhapur-Cuttack MEMU at

Brahmapur and Puri-Rourkela passenger at Bhubaneswar.

The ten central trade unions including Centre of Indian Trade Unions (CITU), Indian National Trade Union Congress (INTUC), among others have given the call for strike with a 12-point charter of demand. Trade union Bharatiya Mazdoor Sangh (BMS) is not taking part in the strike.

New Delhi, Mar 5: A Delhi court Thursday issued fresh death warrants for execution of the four convicts in the Nirbhaya gang rape and murder case for March 20 at 5.30 am.

Additional Sessions Judge Dharmendra Rana fixed March 20 as the new date of execution after it was told by the Delhi government that the convicts have exhausted all their legal remedies.

The lawyer for the four death row convicts also told the court that there was no legal impediment for the court to proceed in fixing the date of execution.

Mumbai, Apr 22: Maharashtra Home Minister Anil Deshmukh on Wednesday said none of the 101 people arrested in connection with the Palghar lynching case is a Muslim, and accused the opposition of giving a communal colour to the incident.

Terming the incident as unfortunate and a blot on humanity, Deshmukh in a Facebook address said this is not the time to play politics, and urged all to engage in collective efforts to defeat the deadly coronavirus.

Without naming any leader or party, Deshmukh, who is an NCP leader, said some people were seeing Mungerilal ke haseen sapne (referring to a fictional character from a TV show who daydreams) of returning to power in the state.

He said in the run up to the incident, a rumour did rounds in Palghar that some people were lifting children during night.

The entire episode is being investigated by a special inspector general and the probe has been handed over to the Crime Investigation Department (CID), he said.

"The police arrested 101 people in connection with the incident within eight hours after it took place. They had run into neighbouring jungles, but were caught by police. There is no Muslim brother among these 101 people, Deshmukh said.

The minister said someone was heard as saying oye bas (please stop) in the video clip of the incident, but it was allegedly distorted as Shoaib.

An attempt was made to give a political colour to the incident. And this is very unfortunate...communal politics is being played, Deshmukh alleged.

He said such politics is being played at a time when the entire state is engaged in a battle against coronavirus.

"It is not the time to play politics, but to fight coronavirus collectively. It is unfortunate some people are seeing 'Mungerilal ke haseen sapne' at this juncture, the minister said.

The incident took place on the night of April 16 when three men - two seers and their driver - were going from Mumbai in a car towards Surat in Gujarat to attend a funeral.

Their vehicle was stopped near a village in Palghar district where the three were dragged out of the car and beaten to death with sticks by a mob on suspicion that they were child-lifters.

The deceased were identified as Chikne Maharaj Kalpavrukshagiri (70), Sushilgiri Maharaj (35), and driver Nilesh Telgade (30).

The Maharashtra government earlier ordered a high- level probe into the incident, and two policemen from Palghar were suspended on Monday for alleged dereliction of duty.
