Budget session: All you need to know about the schedule, agenda, hurdles ahead

New Delhi, Delhi 23: The government, which is looking to pass key legislation, is set to face a stormy Budget session starting Monday despite its promise to walk the “extra mile” to accommodate the opposition’s concerns.

Budget sessionOn Sunday, Prime Minister Narendra Modi assured the Opposition of addressing all its concerns as his government sought support for the bills that will replace six ordinances, including the one that aims to overhaul the land law.

Parliament opens on Monday for what will be the first full budget session of the Modi government. The budget -- to be presented on February 28 -- will be closely watched for the economic path the government charts. The session will be a test of the NDA's floor management skills with a heavy legislative agenda lined up.

The session will begin with President Pranab Mukherjee's address to members of both Houses of Parliament that will indicate the government's agenda for the session.

"I can assure you that all the issues you have referred to will be discussed adequately and appropriately," the PM told an all-party meet Sunday evening.

Modi's reach-out mission started hours earlier when parliamentary affairs minister Venkaiah Naidu drove to the 10 Janpath residence of Congress chief Sonia Gandhi in the morning.

The Congress, however, remained non-committal, saying it couldn't back bills that were "anti-people".

"We have some concerns about the land law amendments," sources quoted Sonia as telling Naidu.

It was the first official engagement between the Modi government and the Congress president.

HT reported on February 20 that a senior Modi minister may meet Sonia to end the ordinance logjam, with the government planning to bring in the bills on Day 1 itself.

Farmers and social activists, led by Anna Hazare, are planning a sit-in against the land bill, which aims to make land acquisition easy for industry, to coincide with the opening day of the session.  

While another contentious legislation — the insurance bill — wasn't discussed, Sonia did tell Naidu that it would be "good" to have detailed discussion on other ordinances as well, sources said.

At the all-party meeting, Modi said it was the collective responsibility of leaders of all parties to ensure that the session ran smoothly.

"…Hope we can collectively work for the benefit of common man," he said.

Congress leader in Lok Sabha Mallikarjun Kharge, who was also present during the Sonia-Naidu meeting, and party colleague Ghulam Nabi Azad, leader of the Opposition in Rajya Sabha, did not promise anything. The Congress parliamentary party had not met for the session, they said.

Janata Dal (United) chief Sharad Yadav said the land proposals were worse than what existed during the British time.

During the session, the focus should be on financial matters and "we must discuss the special category status for different states," Biju Janata Dal leader Bhartruhari Mahtab said.

The opposition leaders also demanded that the PM repeat on the floor of the House the remarks about the government's commitment to religious tolerance and freedom.

Agenda in Parliament

The government enjoys a brute majority in Lok Sabha but in Rajya Sabha it is outnumbered by the Opposition, whose support is critical for law-making.

Naidu, interestingly, said there was a broad consensus on "five out of six" ordinances, indicating the government's willingness to negotiate a dilution of its land ordinance.

HT wrote on Sunday that the government may water down some clauses of the land bill, dubbed anti-farmer by opposition and various social groups.

The government aims to get Parliament's nod for 44 bills during the session. The coal block auction, insurance and motor vehicles law amendment (e-rickshaw) bills will be tabled in Rajya Sabha. The land bill will come up first in Lok Sabha.

The Rail Budget will be presented February 26, Economic Survey February 27 and General Budget February 28.

An official release said the financial business (11 items) includes presentation of and discussion on General and Railway Budget, voting on demands for grants, supplementary demands for grants for 2014-15 and excess demands, if any, for 2013-14.

The legislative agenda comprises introduction, consideration and passing of seven new bills by both the houses including the finance bill, 2015, and bills replacing the six ordinances.

While 10 new bills are slated to be introduced, the government's agenda includes passing of 3 bills pending in Lok Sabha and 7 in Rajya Sabha.

Those pending in the Lok Sabha are: The Constitution (122nd Amendment) Bill, 2014 relating to introduction of GST, The Lok Pal and Lok Ayuktas and other Related Law (Amendment) Bill, 2014 and The Repealing and Amending Bill, 2014. After being passed by Lok Sabha, these bills will be taken up by Rajya Sabha.

Bills pending in Rajya Sabha include 4 bills already passed by Lok Sabha - The Companies (Amendment) Bill, 2014, The Public Premises Eviction of Unauthorised Occupants) Amendment Bill, 2014, The Regional Rural Banks (Amendment) Bill, 2014, The Repealing and Amending (Second) Bill, 2014, and the Payments and Settlement Systems(Amendment) Bill, 2014.

Other pending bills are: The Prevention of Corruption (Amendment) Bill, 2013 and The Constitution (Scheduled Casts) Orders (Amendment) Bill, 2014.

The new bills pertain to on the National Cooperative Development Corporation, the Warehousing Corporation, Andhra Pradesh reorganisation, arbitration and conciliation, repeal of appropriation acts, registration of births and deaths, whistle blowers protection, Indian Institutes of Management, National Academic Depository and Identification of Scheduled Castes.

The non-legislative business for the session includes discussion on the motion of thanks to the President's address.

There will be 20 working days during the first half of Budget session and 13 in the second half.

During the intervening recess, standing committees will take up detailed examination of the demands for grants of different ministries.

New Delhi, Feb 1: Air India's jumbo B747 plane, evacuating 324 Indian nationals from the novel coronavirus-hit Wuhan in China, landed here on Saturday morning, officials said.

The plane reached Delhi around 7.30 am, they said.

There were five doctors from Ram Manohar Lohia (RML) Hospital and one paramedical staff on board, said an Air India spokesperson.

The Indian Army has set up a quarantine facility in Manesar near Delhi to keep those evacuated from China's Hubei province.

Officials said they would be monitored for any signs of infection for a duration of two weeks by a qualified team of doctors and staff members.

"With 324 passengers, special flight has taken off for India from Wuhan. It may reach Delhi at 7.30am," said the Air India spokesperson at 1.19 am on Saturday.

The flight had departed from Delhi airport at 1.17 pm on Friday to evacuate Indian nationals from China, where more than 250 people - none of them Indian - have died due to novel coronavirus.

On Friday evening, the Air India spokesperson had stated that another special flight may take off from Delhi airport on Saturday to evacuate Indians from Wuhan.

The death toll from the novel coronavirus outbreak in China has risen to 259 with total confirmed cases surging to 11,791 amid stepped up efforts by a number of countries to evacuate their nationals from Hubei province, the epicentre of the virus, officials said on Saturday.

About Friday's flight, the spokesperson had said earlier during the day, "A team of five doctors from RML hospital, one paramedical staff from Air India, with prescribed medicines from doctors, masks, overcoats, packed food are in the aircraft. A team of engineers, security personnel are also there in this special aircraft. Whole rescue mission is being led by Captain Amitabh Singh, Director (Operations), Air India."

The spokesperson had added that there were five cockpit crew members and 15 cabin crew members on Friday's flight.

Before departure at Delhi airport, Air India Chairman and Managing Director Ashwani Lohani had said, "No service will take place in the plane. Whatever food is there will be kept in seat pockets. As there will be no service, there will be no interaction (between cabin crew and passengers)."

"Masks have been arranged for the crew and passengers. For our crew, we have also arranged a complete protective gear," he had added.

"Total five doctors from the Health Ministry are also going... The plane will be there (at Wuhan airport) for 2-3 hours," Lohani had said.

Air India has done such evacuations earlier also from countries such as Libya, Iraq, Yemen, Kuwait and Nepal.

New Delhi, Jan 14: The curative petitions of Vinay Sharma and Mukesh, who were sentenced to death in the Nirbhaya gang rape and murder case, was on Tuesday rejected by a five-judge Supreme Court Bench led by Justice N.V. Ramana.

In a three-page order, the Bench concluded, after an in chamber consideration that began about 1.45 p.m., that there was no merit in their pleas to spare them from the gallows.

“We have gone through the curative petitions and relevant documents. In our opinion, no case is made out within the parameters indicated in the decision of this Court in Rupa Ashok Hurra versus Ashok Hurra. Hence, the curative petitions are dismissed,” the court held.

Curative is a rare remedy devised by a Constitution Bench of the Supreme Court in its judgment in the Rupa Ashok Hurra case in 2002. A party can take only two limited grounds in a curative petition - one, he was not heard by the court before the adverse judgment was passed, and two, the judge was biased. A curative plea, which follows the dismissal of review petition, is the last legal avenue open for convicts in the Supreme Court. Sharma was the first among the four convicts to file a curative.

The Bench also rejected their pleas to stay the execution of their death sentence and for oral hearing in open court.

Besides Justice Ramana, the Bench comprised Arun Mishra, Rohinton Nariman, R. Banumathi and Ashok Bhushan.

Curative petitions were filed in the Supreme Court by both convicts on January 9. The petitions had come just days after a Delhi sessions court schedulled the execution of all the four convicts in Tihar jail on January 22.

Sharma and Mukesh, in separate curative petitions, argued that there was a “sea change” in the death penalty jurisprudence since their convictions. Carrying out the death sentence on such changed circumstances would be a “gross miscarriage of justice”.

In his plea, Sharma said the Court had commuted the death penalty in several rape and murder cases since 2017, when it first confirmed the death penalty to the Nirbhaya convicts.

“fter the pronouncement of judgment in 2017, there have been as many as 17 cases involving rape and murder in which various three-judge Benches of the Supreme Court have commuted the sentence of death,” the petition contended.

The Supreme Court recently dismissed a review petition filed by Akshay Singh, another of the four four condemned men, to review its May 5, 2017 judgment confirming the death penalty. It also refused his plea to grant him three weeks' time to file a mercy petition before the President of India.

A Bench led by Justice R. Banumathi had said it was open for the Nirbhaya case convicts to avail whatever time the law prescribes for the purpose of filing a mercy plea.

Akshay (33), Mukesh (30), Pawan Gupta (23) and Sharma (24) had brutally gang-raped a 23-year-old paramedical student in a moving bus on the intervening night of December 16-17, 2012. She died of her injuries a few days later.

The case shocked the nation and led to the tightening of anti-rape laws. Rape, especially gang rape, is now a capital crime.

One of the accused in the case, Ram Singh, allegedly committed suicide in the Tihar jail. A juvenile, who was among the accused, was convicted by a juvenile justice board. He was released from a reformation home after serving a three-year term.

New Delhi, Jun 16: Despite Prime Minister Narendra Modi led government’s attempt to downplay the border dispute with China, matters have heated up unprecedentedly along the Line of Actual Control (LAC)- the effective Sino-India border in Eastern Ladakh. 

The country has lost three precious lives – an army officer and two soldiers. The last time blood was spilled on the LAC, before the latest episode, was 45 years ago when the Chinese ambushed an Assam Rifles patrol in Tulung La.

India had lost four soldiers on October 20, 1975 in Tulung La, the last time bullets were fired on the India-China border though both the countries witnessed bitter stand-offs later at Sumdorong Chu valley in 1987, Depsang in 2013, Chumar in 2014 and Doklam in 2017.

Between 1962 and 1975, the biggest clash between India and China took place in Nathu La pass in 1967 when reports suggest that around 80 Indian soldiers were killed and many more Chinese personnel.

While three soldiers, including a Commanding Officer, were killed in the latest episode in Galwan Valley, the government describes it as a "violent clash" and does not mention opening fire.

New Delhi described the locality where the 1975 incident took place as "well within" its territory only to be rebuffed by Beijing as "sheer reversal of black and white and confusion of right and wrong".

The Ministry of External Affairs had then said that the Chinese had crossed the LAC and ambushed the soldiers while Beijing claimed the Indians entered their territory and did not return despite warnings.

The Indian government maintained that the ambush on the Assam Rifles' patrol in 1975 took place "500 metres south of Tulung" on the border between India and Tibet and "therefore in Indian territory". It said Chinese soldiers "penetrating" Indian territory implied a "change in China's position" on the border question but the Chinese denied this and blamed India for the incident.

The US diplomatic cables quoted an Indian military intelligence officer saying that the Chinese had erected stone walls on the Indian side of Tulung La and from these positions fired several hundred rounds at the Indian patrol.

"Four of the Indians had gone into a leading position while two (the ones who escaped) remained behind. The senior military intelligence officer emphasised that the soldiers on the Indian patrol were from the area and had patrolled that same region many times before," the cable said.

One of the US cables showed that former US Secretary of State and National Security Adviser Henry Kissinger sought details of the October 1975 clash "without approaching the host governments on actual location of October 20 incident". He also wanted to know what ground rules were followed regarding the proximity of LAC by border patrols.

A cable sent from the US mission in India on November 4, 1975 appeared to have doubts about the Chinese account saying it was "highly defensive".

"Given the unsettled situation on the sub-continent, particularly in Bangladesh, both Chinese and Indian authorities have authorised stepped up patrols along the disputed border. The clash may well have ensued when two such patrols unexpectedly encountered each other," it said.

Another cable from China on the same day quoted another October 1974 cable, which spoke about Chinese officials being concerned for long that "some hotheaded person on the PRC (People's Republic of China) might provoke an incident that could lead to renewed Sino-Indian hostilities. It went on to say that this clash suggested that "such concerns and apprehensions are not unwarranted".

According to the United States diplomatic cables, Chinese Foreign Ministry on November 3, 1975 disputed the statement of the MEA spokesperson, who said the incident took place inside Indian territory.

The Chinese had said "sheer reversal of black and white and confusion of right and wrong". In its version of the 1975 incident, they said Indian troops crossed the LAC at 1:30 PM at Tulung Pass on the Eastern Sector and "intruded" into their territory when personnel at the Civilian Checkpost at Chuna in Tibet warned them to withdraw.

Ignoring this, they claimed, Indian soldiers made "continual provocation and even opened fire at the Chinese civilian checkpost personnel, posing a grave threat to the life of the latter. The Chinese civilian checkpost personnel were obliged to fire back in self defence."

The Chinese Foreign Ministry spokesperson had also said they told the Indian side that they could collect the bodies "anytime" and on October 28, collected the bodies, weapons and ammunition and "signed a receipt".

The US cables from the then USSR suggested that the official media carried reports from Delhi on the October 1975 incident and they cited only Indian accounts of the incident "ridiculing alleged Chinese claims that the Indians crossed the line and opened fire first".
