CBI court rejects Teesta Setalvad's plea

July 24, 2015

Mumbai, Jul 24: A special CBI court here today rejected the anticipatory bail application of social activist Teesta Setalvad and her husband filed in connection with a case registered by CBI alleging that her company received Rs 1.8 crore from abroad without mandatory approval from Centre.

Teesta-Setalvad"The anticipatory bail application is rejected," said Special judge Anis Khan while turning down the plea.

Setalvad and her husband Javed Anand had moved the court for bail on July 17. Immediately after the order, Setalvad told the court that she was shocked.

"I am shocked and aggrieved by the verdict as this is a petty offence. My sympathisers feel that this is an attempt (by the government) to intimidate and possibly eliminate us by the powers (sic)."

The CBI had on July 8 registered a case against Setalvad and Anand alleging that her firm Sabrang Communication and Publishing Pvt Limited (SCPPL) received around 2.9 lakh USD in foreign donations in violation of Foreign Contribution Regulation Act (FCRA).

According to the agency, SCPPL was not registered under FCRA for collecting money from abroad and the amount of nearly Rs 1.8 crore (2.9 lakh USD) was, therefore, received in violation of the Act as the organisation needed to seek prior approval from the Union Home Ministry.

Teesta and her husband, through their lawyer, had told the court that they were innocent and were falsely implicated.

Her advocate Mihir Desai told the court that the only reason why the agency wanted to arrest them is to humiliate them for their work in Gujarat.

However, CBI in their reply, last Friday, had said that motive behind the transfer of foreign contribution to SCPPL reflected interference towards the internal security and activities of India.

"Such act of foreign donor would prejudicially affect the security, strategic, scientific and economic interest of the state and also affect the harmony between religious, social, linguistic or regional groups, castes or communities", the CBI had said in its reply while opposing her plea.

The agency said the allegations against them (Setalvad and Anand) are serious in nature and it is proposed to unravel all the contours of the offence and the conspiracy during the investigation.

Setalvad alleged that the FIR registered against her and her husband was for the purpose of harassing and torturing them, a charge rejected by CBI.

"The applicants are deliberately mixing up the offences alleged against them with non-related issues in order to divert the attention from the serious charges against them," the agency had said.

The CBI had also told the court that when their premises were searched on July 14 this year there was total resistance and non-cooperation from their side.

"During the search, an agreement dated September 22, 2006 between Ford Foundation and SCPPL were seized which clearly showed that the remittances were grants. There is no mention of any 'consultancy' therein," the reply had said.

New Delhi, Jul 29: Calling touchdown of Rafale fighter aircraft at Ambala airbase as "historic day" for Indian Air Force and proud moment for India, Union Home Minister Amit Shah on Wednesday said that "world-class fighter jets will prove to be a game-changer".

In a series of tweets, Shah congratulated Prime Minister Narendra Modi, Defence Minister Rajnath Singh, Indian Air Force and the entire country on this "momentous day".

"Rafale touchdown is a historic day for our vigorous @IAF_MCC and a proud moment for India! These are the world's most powerful machines capable to thwart any challenge in the sky. I am sure Rafale will help our Air warriors to safeguard our skies with its mighty superiority," Shah said in a tweet.

"From speed to weapon capabilities, Rafale is way ahead! I am sure these world class fighter jets will prove to be a game changer. Congratulations to PM @narendramodi ji, DM @rajnathsingh ji, Indian Air Force and the entire country on this momentous day. #RafaleInIndia," he added.

Shah said that Modi government is committed to build India's defence capabilities.

"Induction of these next generation aircrafts is a true testimony of PM @narendramodi's resolve to make India a powerful and secure nation. Modi govt is committed to build on India's defence capabilities. I thank honourable PM for providing this unprecedented strength to our IAF," he tweeted.

Earlier today, the five French Rafale fighter jets touched down at Haryana's Ambala after covering a distance of nearly 7,000 km to join the Indian Air Force.

The jets were given a customary water salute upon their arrival at the airbase, some 220-km from the India-Pakistan border.

The formal induction ceremony of the aircraft would be held later. The aircraft would move out soon to another operational base for operational sorties.

The five Rafale fighter aircraft took off on Monday for India from an airbase in France.
Rafale has multi-directional radar system which can detect 40 targets at the same time in a range of over 100 Kms. It has advance radar warning receiver to identify hostile tracking system a towed decoy system to thwart incoming missile attacks.

Rafale will ensure that our pilots will not have to cross the border to strike the target, that is about 600 Km in enemy territory.

It will get French industrial support for 50 years. India had signed a deal worth over Rs 60,000 crore with France in September 2016 for 36 Rafales to meet the emergency requirements of the IAF.

New Delhi, Feb 12: Delhi Chief Minister-designate Arvind Kejriwal was on Wednesday elected as the leader of AAP legislative party, a day after he led the party to an emphatic victory in the Delhi Assembly elections.

Kejriwal was elected as the AAP legislative party leader during a meeting called by him with the newly-elected party MLAs. The meeting was held at the AAP chief's residence.

Atishi, AAP's winning candidate from Kalkaji constituency said after the meeting, "It is definitely a validation of the work that has been done by AAP in the last five years, be it education, health care, water or electricity."

Kejriwal is slated to take oath as the Delhi Chief Minister for the third time at Ramlila Maidan on February 16.

AAP galloped to a landslide victory by winning 62 of the 70 seats in the Delhi Assembly elections in the face of a high-voltage campaign by the BJP, which fielded a battery of Union Ministers and Chief Ministers in its electioneering, spearheaded by Home Minister Amit Shah.

The BJP marginally improved its tally, managing just eight seats from its 2015's tally of three seats. The Congress, which drew a blank in the previous elections, failed to open its account yet again.
