CBI wanted to implicate Modi, Shah in Ishrat case: Vanzara's counsel

Ahmedabad, Jun 6: Former police officer D G Vanzara's lawyer told a special court that it appeared the CBI wanted to "implicate" the then Gujarat Chief Minister Narendra Modi and his former cabinet colleague Amit Shah in the 2004 Ishrat Jahan encounter case.

Arguing for his client's discharge plea filed in the court of special judge J K Pandya, Vanzara's lawyer V D Gajjar said going by the statements of witnesses recorded by the CBI, it appeared the "intention of the investigating agency was to implicate" Modi and Shah in the case.

"Fortunately" this did not happen, Gajjar said.

Modi, now the prime minister, was the chief minister of Gujarat during the time and Shah served as Minister of State for Home under him.

The CBI had in 2014 given a clean chit to Shah, now BJP president, citing insufficient evidence against him.

In his submission, Gajjar said the charge sheet filed against his client was "concocted" and there was no prosecutable evidence against him.

He said statements of witnesses in the case were not reliable as accused like Bharat Patel and I K Chauhan, among others, were made witnesses without following due process.

The lawyer maintained the encounter was "genuine" and that the fake encounter story was "concocted".

Vanzara, out on bail in the alleged fake encounter case, said in his discharge application that Modi was secretly interrogated by the investigating officer of the case.

"However, such material was not placed on record of this case," the former IPS officer said.

Vanzara, the former Deputy Inspector-General of Police, has presented this as one of the points to press for his discharge in the case.

The CBI has opposed his plea along with that of another former Gujarat Police officer N K Amin, a co-accused, who has also moved a discharge plea in the same court.

The central agency has claimed it has enough evidence to establish its charges against Vanzara and Amin.

The court, which has concluded hearing the plea of Amin, a retired superintendent of police, fixed June 15 for further hearing of Vanzara's petition.

Jahan, a 19-year-old college girl from Mumbai, and three others -- Javed Shaikh alias Pranesh Pillai, Amjadali Akbarali Rana and Zeeshan Johar -- were killed in an encounter with the police on Ahmedabad's outskirts on June 15, 2004.

The Gujarat police had then claimed they had terror links and plotted to kill the then chief minister Modi.

A Special Investigation Team (SIT), constituted by the Gujarat High Court, had concluded that it was a "fake" encounter. Following the finding, the HC had transferred the case to the Central Bureau of Investigation (CBI).

In the first charge sheet filed by the CBI in 2013, seven Gujarat police officers were named as accused, including IPS officers P P Pandey, Vanzara and G L Singhal. They faced charges of kidnapping, murder and criminal conspiracy.

Pandey had been discharged in the case.

The CBI had named four IB officials, including special director Rajinder Kumar and officer M S Sinha, in the supplementary charge sheet. However, the Centre is yet to give its sanction for their prosecution.

Vanzara was last year discharged in the 2005 Sohrabuddin Sheikh and Tulsiram alleged fake encounter cases along with Rajasthan IPS officer Dinesh M N.

New Delhi, Feb 3: The Allahabad High Court on Monday granted bail to former BJP leader Swami Chinmayanand in the alleged rape case of a law student. He was arrested in September last year after the 23-year-old woman accused him of sexual harassment and blackmail.

The woman was a student of the Chinmayanand-controlled SS Law College in Shahjahanpur in Uttar Pradesh.

Chinmayanand is facing charges under Sections 376C (sexual intercourse by a person or persons taking advantage of their official position), 354 D (stalking), 342 (wrongful confinement) and 506 (criminal intimidation) of the Indian Penal Code (IPC).

The case is being investigated by a Special Investigation Team (SIT) formed on the directions of the Supreme Court.

The case came to light after the woman posted a video on August 23 last year on social media alleging that “a senior leader of the saint community” was harassing and threatening to kill her. The law student went missing a day later, after which her father lodged a complaint, accusing Chinmayanand of harassing his daughter.

Chinmayanand was expelled from the BJP after his arrest.

The SIT had, on November 6, submitted chargesheet in the case.

In a parallel case, the woman was charged with trying to extort money from Chinmayanad. The Allahabad High Court granted her bail in that case in December last year.

New Delhi, Feb 4: Uttar Pradesh Chief Minister Yogi Adityanath on Monday accused Arvind Kejriwal of having a "partnership" with Pakistan and appealed to the people in Delhi to not vote for the AAP chief as it will make Pakistan happy.

Ramping up his attack on the Shaheen Bagh protest, Adityanath said that the protest against the Citizenship Amendment Act (CAA) is merely an excuse for people to vent their anger against the scrapping of Article 370.

"You must have seen their partnership on 370. Arvind Kejriwal used to speak in the same voice as Imran Khan on Article 370. You must have heard it.

"Now when elections are taking place in Delhi, who is speaking in favour of Arvind Kejriwal? It is the ministers of Pakistan. They are aware that Kejriwal is feeding 'biryani to protesters at Shaheen Bagh'," he said, referring to Pakistan minister Fawad Chaudhry's tweet asking Indians to defeat Prime Minister Narendra Modi.

Adityanath addressed three rallies on Monday in the national capital ahead of assembly elections.

"Will Pakistan decide who Indians should vote for. If voting for Kejriwal will make Pakistan happy, should it be done," he asked at a rally in Mehrauli.

Adityanath said his Delhi counterpart Kejriwal has become a "toy in the hands of anti-social and anti-India elements".

Addressing a rally in Vikaspuri in west Delhi, he said that Kejriwal is not bothered about key issues such as providing clean drinking water but is concerned about Shaheen Bagh, the anti-citizenship amendment act protest site.

At another rally in Uttam Nagar in west Delhi, Adityanath said Kejriwal has played with the emotions of the people of Delhi for the last five years.

"He obstructed the development of Delhi. And knowingly and unknowingly, he became a toy in the hands of anti-social and anti-India elements," Adityanath said.

The protest at Shaheen Bagh, he said, has disrupted traffic across the capital.

"A guest with an appointment to meet him at 9.30 am could only reach at 11. He told me he had left as early as 7 am but got stuck because of the traffic in Shaheen Bagh," he said.

The Uttar Pradesh chief minister also slammed Kejriwal for "sympathising" with elements who he said gave anti-India slogans in Jawaharlal Nehru University.

Idukki, Jun 8: Devikulam MLA S Rajendran from CPM along with supporters staged a protest by blocking the Munnar-Udumalpet interstate highway here on Monday, demanding that action to be taken to prevent wild elephants entering into human settlements and destroying properties.

The protest started at 9.30 am and demand was made that senior forest officials should give them assurance of putting an end to the problem.

A police team led by Munnar Deputy Superintendent of Police (SP) Ramesh Kumar was camping in the area.

Wild elephants from the nearby forest are frequently trespassing into Munnar and last night two elephants destroyed a vegetable shop in the town.

If it was a lone elephant that the locals nicknamed as Padayappa that used to enter the human settlement, now along with him a baby elephant is also coming to the town at night.

The locals have named the second elephant Ganeshan. Though there were instances of them destroying crops and eating from vegetable shops, till now the duo has not attacked humans.
