Centre withdraws social media hub policy, AG informs SC

New Delhi, Aug 3: The Centre today told the Supreme Court it will undertake a complete review of its social media policy and has withdrawn its notification proposing a social media hub, which some alleged could become a tool to monitor online activity of citizens. 

A bench headed by Chief Justice Dipak Misra considered the submission of Attorney General K K Venugopal, appearing for the Centre, that the notification was being withdrawn, and disposed of petitions challenging it.

Venugopal also told the bench, comprising Justices A M Khanwilkar and D Y Chandrachud, that the social media policy would be reviewed completely by the government.

The bench was hearing a petition filed by TMC MLA Mahua Moitra alleging that the Centre's social media hub policy was to be used as a tool to monitor social media activities of the citizens and should be quashed. 

On July 13, the apex court had asked the government whether its move to create such a hub was to tap people's WhatsApp messages, and observed that it will be like creating a "surveillance state". 

The Trinamool Congress legislator from West Bengal had asked whether the government wants to tap citizens' messages on WhatsApp or other social media platforms.

Moitra had said the government had issued a Request For Proposal (RFP). The tender will be opened on August 20 for a software which would do 360 degree monitoring on all social media platforms such WhatsApp, Twitter and Instagram and track e-mail contents, she said.

On June 18, the apex court refused to an urgent hearing on the plea seeking to stay the ministry's move to set up a 'Social Media Communication Hub' (SMCH) that would collect and analyse digital and social media content.

In May this year, the Broadcast Engineering Consultants India Limited (BECIL), a public sector undertaking under the ministry, had floated a tender to supply software for the project.

The legislator from Karimpur constituency of West Bengal said the SMCH "is being set up with the clear objective of surveillance of activities of individuals such as herself on social media platforms".

In her plea, she said such intrusive action on part of the government was "not only without the authority of law, but brazenly infringes" her fundamental right to freedom of speech under Article 19(1)(a) of the Constitution and violated her right of privacy.

Raising concerns, she said the proposed SMCH seeks to create technology architecture that merges mass surveillance with a capacity for disinformation.

The petition quoted the RFP as saying that the platform should "support easy management of conversational logs with each individual with capabilities to merge it across channels to help facilitate creating a 360 degree view of the people who are creating buzz across various topics".

It said technology is required to have the capability to listen to and collect data not only from social media platforms but also from e-mails.

"Specific capabilities mentioned include live search, monitoring, collecting, indexing and storage of personal data including location-based data and meta-data. The ability to monitor individual social media user/account is a specific mandate being given to the service provider," the PIL said.

WhatsApp, which was recently under fire over fake and provocative messages being circulated on its platform, had informed the IT and Electronics Ministry that it has the ability to prevent spam but blocking can be done only based on user reports since it cannot see the content of private messages.

Detailing the proactive steps to tackle abuse on its platform, WhatsApp had said it retains limited information and is end-to-end encrypted. But this privacy protection has trade-offs in form of "the inability to see problematic content spreading through private conversations on our app".

Jammu, Jan 25: People in Jammu and Kashmir expressed happiness over the restoration of mobile data services and internet access through fixed-line across the Union Territory on Saturday.

Speaking to ANI Jitendra Sharma, a resident of Jammu said, "The government has taken a good decision. People had been facing hardship for a long period and I think it will improve further."

"It is a big relief to people. People can finish their pending work. I hope that 4G services will also be resumed soon," said a resident of Kashmir.

The internet speed is restricted to 2G only.

"Access shall be limited only to whitelisted sites and not to any social media applications allowing peer to peer communication and virtual private network applications. Directions shall be effective from January 25 and will remain in force till January 31," the statement by the government read.

Earlier on January 15, 2G services were reinstated in Jammu, Samba, Kathua, and Udhampur for white-listed sites.

The Central government had suspended the internet in the region following the abrogation of Article 370 of the Constitution on August 5 last year, which conferred special status to the erstwhile state of Jammu and Kashmir, and its bifurcation into two Union Territories -- Ladakh, and Jammu and Kashmir.

New Delhi, Jan 15: The mother of 23-year-old paramedic student, who was raped and brutally assaulted by six men in December 2012, on Tuesday said she knew that the curative petitions of the convicts will be rejected and is confident that they will be hanged on January 22.

Her remarks came after the Supreme Court on Tuesday refused to stay the execution of two of the four death row convicts in the 2012 Nirbhaya gang rape and murder case while dismissing their curative petitions against their conviction and capital punishment.

"The curative please had to be rejected. This was the third time they had gone to the Supreme Court. Whatever pleas they file, we are ready to face them and we will fight it out. We feel that they will be hanged on January 22. We want that to happen," Nirbhaya's mother told PTI over phone.

The four convicts -- Vinay Sharma (26), Mukesh Kumar (32), Akshay Kumar Singh (31) and Pawan Gupta (25) -- are to be hanged on January 22 at 7 am in Tihar jail as a Delhi court issued their death warrants on January 7.

Vinay and Mukesh had filed curative petitions on January 9.

Shortly after the apex court refused to stay the execution of two of them, Mukesh moved a mercy petition before President Ram Nath Kovind.

Mukesh also approached the Delhi High Court for quashing the death warrant. The high court is expected to take up his petition on Wednesday.

New Delhi, May 4: Rebutting the Congress' criticism, the BJP said on Monday that the railways has subsidised 85 per cent of ticket fare for special trains being run for migrant workers and the state governments have to pay the remaining 15 per cent.

The ruling party also accused the Congress of promoting indiscriminate movement of people which, it said, would lead to "faster spread" of coronavirus infection "just like we saw in Italy", and asked if this is what Sonia Gandhi wants.

The counter-charge from BJP leaders, including its spokesperson Sambit Patra and information technology department in-charge Amit Malviya, came after Congress president Sonia Gandhi hit out at the central government for making migrants pay for their train fare and asked her party's state units to pick the tab.

Congress leader Rahul Gandhi also took a swipe at the railways, saying, on one hand, it is seeking ticket fare from people stranded in various states while on the other it is donating Rs 151 crore to the PM-CARES Fund.

Responding to him, Patra said, "Rahul Gandhi ji, I have attached guidelines of MHA which clearly state that 'No tickets to be sold at any station'. Railways has subsidised 85% & state govt to pay 15%. The state govt can pay for the tickets (Madhya Pradesh's BJP govt is paying). Ask Cong state govts to follow suit," Patra tweeted.

The BJP leader further clarified that for each 'Shramik Express', special trains being run for migrants to take them back to their native places during the lockdown, about 1,200 tickets to the destination are handed by the railways to the state government concerned.

State governments are supposed to clear the ticket price and hand over the tickets to workers, he said.

He said the BJP government in Madhya Pradesh is doing so and asked Rahul Gandhi to tell the Congress-ruled states to follow suit.

Hitting out at Sonia Gandhi, Malviya tweeted, "Congress is obviously upset at how well India has handled Covid. They would have ideally wanted a lot more people to suffer and die. Promoting indiscriminate movement of people would lead to faster spread of infection, just like we saw in Italy. Is this what Sonia Gandhi wants?"

BJP MP Subramanian Swamy claimed that migrant workers returning home will not have to pay money as the rail travel will be free from now onwards.

"Talked to Piyush Goyal office. Govt will pay 85% and State Govt 15%. Migrant labour will go free. Ministry will clarify with an official statement," he tweeted.
