Coal scam: Court frames charges against ex-coal secy, five others

New Delhi, Aug 19: A special court today framed various charges including cheating and criminal conspiracy against former Coal Secretary H C Gupta, two public servants, private firm Vikash Metals and Power Ltd and its two officials in a coal blocks allocation scam case.

courtSpecial Judge Bharat Parashar put on trial all the accused in the case in which the CBI's closure report was earlier rejected by the court, asking the probe agency to further investigate the matter.

The case pertains to alleged irregularities in allocation of Moira and Madhujore (North and South) coal blocks in West Bengal to VMPL. In September 2012, the CBI had registered an FIR in the case.

Besides Gupta and the firm, the court ordered to put on trial public servants, ex-joint secretary in Ministry of Coal (MoC) K S Kropha, the then Director (CA-I) in MoC, K C Samria, firm's Managing Director Vikash Patni and its authorised signatory Anand Mallick.
The accused pleaded not guilty and claimed trial after which the court fixed the matter for further hearing on September 9.

Gupta, an accused in several coal scam cases and presently out on bail, had recently told the court that he intended to "face trial from inside the jail" and withdraw his personal bond to secure bail due to financial difficulties.

He had also refused to accept the court's offer to avail an advocate from New Delhi Legal Aid Services Authority or an amicus curiae appointed by the court. His application is presently pending before the court.

While ordering framing of charges in the present case, the court had said "prima facie" offences of criminal conspiracy, cheating and criminal breach of trust by public servants under IPC and various sections of the Prevention of Corruption Act are made out against the accused.

"Keeping in view the overall facts and circumstances of the case coupled with the submissions made, I am of the considered opinion that prima facie charge for the offences under sections 120-B (criminal conspiracy) and for the offences under sections 120-B, 409 (criminal breach of trust by public servants), 420 (cheating) of IPC and under sections 13(1)(c) and 13(1)(d) (criminal misconduct by public servants) of the PC Act is made out against all the accused...," the judge had said.

The court also said prima facie substantive offences under the Prevention of Corruption Act are made out against Kropha and Samria.

"Charge for the offence under section 409 IPC and for the offences under PC Act are made out against accused Gupta.

"Charge for the offence under section 420 IPC is also prima facie made out against accused company M/s Vikash Metal and Power Ltd (VMPL), Patni and Mallick," it said.

The CBI had on January 28 placed before the court a Central government order according sanction to prosecute Kropha and Samria for their alleged involvement in the case. It had also filed a report on its further probe in the case. Regarding Gupta, CBI had said that lapses in processing the application were found on his part too, but since he had retired, no action was being recommended.

CBI had said that VMPL wrongly claimed that it had been allocated 300 acres of land in Begusarai in Bihar by the Bihar Area Development Authority.

The agency had found that the land was de-allocated and directors of the company failed to inform the screening committee members about it, it had said.

New Delhi, Mar 4: A court in Delhi on Wednesday convicted expelled BJP MLA Kuldeep Singh Sengar of culpable homicide not amounting to murder in the death of the Unnao rape victim's father.

District judge Dharmesh Sharma said Sengar had no intention of killing the victim's father. “He was beaten in a brutal manner that led to his death,” the judge said.

The court had sent Sengar to jail on December 20 for the “remainder of his natural biological life” for raping the woman in 2017, when she was a minor.

The Central Bureau of Investigation (CBI) had examined 55 witnesses in support of the case and the defence examined nine witnesses.

The court had recorded the statements of the rape survivor's uncle, mother, sister and one of her father's colleague who claimed to be an eyewitness to the incident.

Charges were framed against Sengar, his brother Atul, Bhadauria, sub-inspector Kamta Prasad, constable Amir Khan and six others in the case.

The case was transferred to Delhi from a trial court in Uttar Pradesh on the directions of the Supreme Court on August 1 last year.

In July, 2019 a truck rammed into the car the rape victim was travelling in with some family members and her lawyer.

Two of her aunts died in the incident. She was airlifted from a hospital in Lucknow and to AIIMS in Delhi.

The victim has been provided accommodation in Delhi and is under CRPF protection.

New Delhi, Feb 26: Calling the recent violence in Delhi as 'planned conspiracy', Sonia Gandhi on Wednesday demanded Union Home Minister Amit Shah's resignation over the clashes that left 20 people dead in two days.

"CWC (Congress Working Committee) believes Home Minister and Centre is responsible. The Home Minister should tender his resignation with immediate effect," the Congress party's interim chief told reporters here.

Violent clashes erupted between pro and anti-CAA groups in parts of northeast Delhi on Monday, leading to widespread vandalism and arson for over two days.

While many blamed police for inaction to control the mobs, Union Home Minister Amit Shah met the top brass of Delhi Police, Chief Minister Arvind Kejriwal, LG Anil Baijal and directed the officials to control the situation.

Gandhi blamed both the Central and the Delhi governments, saying the administration did not take adequate steps on time to curb violence in the national capital.

"Chief Minister Arvind Kejriwal and Center is equally responsible for not activating the administration to reach out to the people to maintain peace and harmony," Sonia added.

The death toll in the violence rose to 20 on Wednesday, according to GTB hospital authorities.

Government sources told ANI that the National Security Advisor (NSA) Ajit Doval has been given the charge of bringing normalcy in the capital.

Sources also said that Doval will brief Prime Minister Narendra Modi and the Cabinet about the prevailing situation.

The NSA last night visited Jaffrabad, Seelampur and other parts of northeast Delhi where he held talks with leaders of different communities.

Without naming any leader, the Congress interim president also targeted the leaders of the Bharatiya Janata Party for making inflammatory statements saying that "there is a conspiracy behind the violence, country also saw this during Delhi elections. Many BJP leaders made inciting comments creating an atmosphere of fear and hatred."

New Delhi, Jan 7: The Delhi Police has filed an FIR against JNUSU president Aishe Ghosh and 19 others for allegedly attacking security guards and vandalising the server room of the Jawaharlal Nehru University (JNU) on January 4.

The police registered the FIR on January 5.

In the complaint filed by the JNU administration, the University alleged that the accused were involved in physical violence and pushed the women guards, verbally abused them and threatened them of dire consequences if they opened the lock of university's communication and information (CIS) office.

"They illegally trespassed the University property with the criminal intention to damage the public property. They damaged servers and made it dysfunctional. They also damaged fiber optic power supplies and broke the biometric systems inside the room," the University officials alleged.

This incident allegedly occurred a day before Aishe Ghosh, other JNU students and teachers were attacked by a masked mob inside the campus.
