College to jail in bomb case: How cops destroyed 12 yrs of his youth

New Delhi, Feb 18: Mohammad Rafiq Shah was a student of MA (final) at Shah-i-Hamadan, Institute of Islamic Studies, University of Kashmir, Srinagar, when on the midnight of November 21, 2005, his world plunged into darkness.

youthHe was picked up by officials of Delhi Police's special cell and Special Task Force (STF) of Kashmir Police.Two days later - after allegedly subjecting him to torture and humiliation at an STF camp - they brought him to Delhi. His crime: he was alleged to have planted a bomb in a DTC bus in Govindpuri on October 29, 2005, which injured many people.

Twelve years later, when he walked free on Thursday - after additional sessions judge Reetesh Singh acquitted him of all charges - the police were facing serious questions of credibility and human rights violations. Rafiq's claim that "he was made an accused to assuage the public perception that Delhi Police was incompetent to act against terrorism" and that "he was a vulnerable target... made a scapegoat" rang true. Police, it seems, deliberately ignored his alibi at every step to prove their case . They brushed aside his plea that it could be proved he was in his class on the day of the blast. It relied on dubious witness es who ended up contradicting themselves, exposed Rafiq to many people when he was in custody before a test identification parade (TIP) could be conducted and suppressed inconvenient facts.

TOI had as early as on February 12, 2006, raised the question whether it "could be a case of harried cops under pressure to show results, targeting an innocent boy?" In a front-page report, "Delhi bomber was in class on October 29", we had reported that Rafiq was actually attending his MA classes in his college in Srinagar. It was also reported that Rafiq had refused to appear for TIP as he had already been presented before some people, one of whom could be a witness in the Govindpuri blast.

The ground had been laid in Srinagar where Rafiq -according to his reply during framing of charges on January 21, 2008 which was cited by the judge - was allegedly forced to drink urine, kept naked and sexually abused, all in order to perhaps break his spirit. He had also alleged that rats were put in his trousers and attempts made to hurt his religious sentiments. "It seems I am being victimised only because I am a Kashmiri Muslim," he said, expressing his faith that justice would prevail and the police get exposed.

The court drew attention to Supreme Court's observation that when it comes to the notice of the investigating agency that a person accused of an offence has a good alibi, then it is the duty of that agency to investigate the genuineness of the plea of alibi and submit a report to the magistrate. "In the case of Manu Sharma versus the State (NCT) of Delhi....Supreme Court had observed that the criminal justice administration system in India places human rights and dignity for human life on a much higher pedestal. An accused is presumed to be innocent till proved guilty and is entitled to fairness and true investigation and a fair trial. The prosecution is expected to play a balanced role in the trial of crime and the investigation should be judicious, fair, transparent and expeditious to ensure compliance with the basic rule of law," the court asserted. Rafiq's case failed on all counts.

First Delhi Police produced a witness, Danbir Sharma, one of the passengers in the bus, on the basis of whose description, they got a portrait made. However, Sharma later couldn't identify Rafiq. The portrait then disappeared mysteriously - pointed out by the judge - even as another witness, Rajeev Sinha, surfaced.

His and Sharma's description of the bomber were at variance. Singh described the bomber as a young man, 22-24 years of age with a French-cut beard and prominent nose, who was wearing a cap with `New York' written on the right. He said he was wearing a white shirt with grey stripes and cotton trousers, either blue or black. Sharma, however, said the bomber was a boy of 5 feet, 10 inches height and had `sanwla' complexion. According to him, he was wearing a `coca cola' coloured shirt and white trousers.

The defence later claimed that Rafiq had a full-grown beard when he was arrested. It was alleged that on November 25, 2005, inspector Badrish Dutt brought a barber to the special cell office and got his beard trimmed to resemble a French cut. He then took a photo of his on his cellphone.

Significantly , Rafiq had refused to participate in a TIP on the ground that he had been exposed to many people while in custody at Lodi Colony and his photographs taken. He particularly mentioned a man wearing spectacles with his lawyers later alleging in court that it was Sinha, a planted witness. Sinha later accepted that he wore spectacles.

Sinha had produced a ticket to prove his presence on the bus that day . This had been left unverified by the police for long though it could have checked its authenticity with the depot manager and the registers he maintained quite easily. It chose not to do so.

The police wrote to the Registrar, University of Kashmir, on February 17, 2006, regarding verification of admission and attendance of Rafiq but chose to forget about it in court. Later, it was claimed that because of vacations, the information could not be procured from the university . However, the judge saw through the charade. DCP S K Tewari had on February 27 - just 10 days after writing the first letter - asked the Registrar "Whether " A" or "P" is marked in the attendance register of the class?" The court said this question could not have been put to the Registrar unless Tewari had access to the attendance records - the ones later produced by the defence and seen by the court - and hence the vacation plea for not being able to verify Rafiq's presence "seems to be false".The court said that in all probability the records had been collected by the police.

The police claimed the other accused, Mohammad Hussain Fazili - who too was acquitted - had led them to Rafiq. Rafiq, however, told the court that he met Fazili for the first time on November 21, 2005, at the STF camp. Fazili, too, denied taking the cops to Rafiq and claimed he was himself misled into believing by inspector Badrish Dutt that he was wanted in connection with an inquiry in a case under the Wildlife Protection Act. He too ended up in jail for 12 years.

Bengaluru, Apr 18: The Karnataka government has managed to get the contact details of nine out of 10 foreign nationals who had visited Jubilant Life Sciences, a pharmaceutical company in Mysuru district's Nanjangud which has been declared a coronavirus hotspot, State minister S Suresh Kumar said on Saturday.

As many as 66 people have tested positive for COVID-19 in Nanjangud.

While investigating the source of virus in what is now known as 'Nanjangud cluster', the Mysuru administration could get information that 10 foreign nationals had visited this town, Kumar told reporters.

Soon the External Affairs Ministry's help was sought which managed to track nine of them, Kumar said, adding that the MEA contacted its embassies in China, Germany, Japan and the USA to track these persons.

"Out of 10, they could contact nine and got details. All of them have said that they were all healthy and they did not have any symptoms.

Hence, they did not feel the need to undergo COVID-19 tests," the minister said.

He opined that many people do not show the symptoms but they could be carriers of the virus.

"It all depends on the person's immunity," Kumar explained.

A foreign national from Germany who had visited Nanjangud could not be reached as her contact details were not available.

Forthcoming Census and RSS campaign

Currently massive protests are going on against NPR, NCR and CAA. At the same time we are going to begin the process of decadal census in 2021. Already RSS is active in promoting NPR, NCR and CAA. At the same time RSS wants that Adivasis should register themselves as Hindus rather than ticking the column of ‘Others’. As per their spokesperson in the 2011 census many Adivasis groups ticked that column because of which the population of Hindus came down to by 0.7 percent point to come down to 79.8 %. This has sent signals to this Hindu nationalist organization and is planning to ensures that Adivasis tick the column of Hindus in this census.

As such RSS has a very clever attitude in defining the term Hindu. The first formulation was by Savakakar who said that all those who regard the land east of Indus as their Holy land and Father land are Hindus. This left out Muslims and Christians, and brought all others in the ambit of Hindu fold. From the decade of 1980s due to electoral compulsions they have been trying to articulate that all those who are living in India are Hindus. Murli Manohar Joshi stated that Muslims are Ahmadiya Hindus and Christians are Christi Hindus. Recently there was a controversy when they restated that Sikhs are not a separate religion but are a sect of Hinduism. Many Sikh organizations stood up to say that Sikhism is a religion by itself and recalled the book of Kahan Singh Nabha, “Hum Hindu Nahin”

As far as Adivasis are concerned in contrast to what is being planned by Hindu nationalist RSS, many Adivasis groups have been meeting from last couple of years to demand just the contrary. As per them there should be a column where they can tick their identity of Adivasis.  There are active campaigns among Adivasis groups to uphold their Adivasi identity in Census. As per them in the first census which was conducted in Independent India, the column, Aborigines, was there, which was later removed forcing them to club themselves with other religions.

After 1951 in addition to Hindu, Muslim, Sikh, Christian, Jain and Buddha, the column ‘others’ was also there which was removed in 2011. Even during British period if you look at the censuses of the British era (from 1871 to 1931); there was provision for tribes to choose Aborigine as an option. There are nearly 83 religious practices being followed by Adivasis. Few major of these are Sarna, Gondi, Punem, Adi, and Koya. What they share in common is that they are animists, worship nature and spirit of ancestors; do not have priestly class or Holy Scriptures and Gods and Goddesses characteristic of the broad Hindu pantheon.

RSS as per its political agenda of Hindu Nation regards them as Vanvasi. They pontificate that they have been part of Hindu society who were driven away to forests to escape the forcible conversion being done by the Muslim invaders. This concoction is contrary to the interpretations based on the studies from population genetics. The Hindu nationalist argues that Aryans have been the original inhabitants of the country from where they spread to other parts of the World. The book by Tony Joseph, ‘Early Indians’ tells us that away from the race theory, we are all mixed up. The first inhabitants in our land were the ones who emigrated from South Asia over Sixty thousand years ago.

The Indo-Aryans came here nearly three thousand years ago and they pushed the aborigines to the forests and hills and that’s what constitutes the Adivasi community of India.

Hindu Nationalists like all the nationalists who construct their nationalism around their religion claim to be the most original inhabitants of the land, and their interpretations of past are molded according to that. RSS right from beginning has not been using the word Adivasi, it calls them Vanvasi. As per its agenda it wants them to be part of Hindu fold, despite Adivasis themselves saying that they are not Hindus, they have beliefs and practices which are far away from Hinduism in whatever form.

To enhance its political reach from the decades of 1980s in particular its work in Adivasis areas has been intensified. While ‘Vanvasis Kalyan Ashram’, part of RSS Combine which was formed much earlier, it was in the decades of 1980s that their work was jacked up by sending more Pracharaks in Adivasi areas. We see that in Gujarat, Dangs and nearby area, Swami Aseemanand, in MP, centered around Jhabua-the followers of Asaram Bapu and in Orissa Swami Laxmananad stationed them. They saw Christian missionaries working in the field of education and health as an obstacle to Hinduization of Adivasis. Their propaganda against Christian missionaries led to the ghastly murder of Pastor Graham Stains. It was this propaganda which led to anti Christian violence in various forms, the most horrific being the Kandhamal violence of 2008.

In order to culturally co-opt them into the fold of Hinduism they began series of religious congregations, Kumbhs. Shabri Kumbh in Dangs and many other Adivasis predominant areas created an atmosphere of fear, Adivasis were asked to be part of it, saffron flags were distributed and they were made to put it in their houses. Two religious icons were popularized in these areas, one was Shabri and other was Hanuman. To cap it all, Ekal Vidyalayas, started spreading RSS’s interpretation of history in these areas. The other angle of the whole thing is that Adivasis are living in the areas rich in minerals, which the BJP supporter Corporate World wants to take over.

World over aborigines have similar pattern. They are animists and what they practice is a culture as such. Many have converted to other religions out of their choice for sure, but finally in these matters what is important is the self perception. Hemant Soren the Chief Minister of Jharkhand pointed out that “Adivasis are not Hindus. ”Keeping that in mind; the column of Aborigines needs to find its place in our census forms.

Mangaluru, Jan 15: A 28-year-old man, who is a first-year MBBS dropout, was arrested by the police after he posed as a doctor and treated patients at a private hospital at Derlakatte on the outskirts of the city.

The arrested has been identified as Mohammed Habib Hussain, a native of Shivamogga, who was residing in Attavar, Mangaluru. He had discontinued studies after the first year due to personal reasons.

The incident took place on Sunday night  at Yenepoya Medical College, Derlakatte. Dr Sampathila Padmanabha, medical superintendent, Yenepoya Medical College, said the accused had come to the medical college at midnight on December 29.

After speaking to the security guard at the hospital entrance, he introduced himself as an assistant to the consulting urologist, and wanted to visit patients at the private ward situated at floor number 7.

After entering, he called the duty nurse to get case sheets. Later, he examined two women patients in the presence of the duty nurse, and also wrote a prescription on the patient case sheet. He also yelled at a nurse, saying that she isn’t doing her duty properly, and left the place.

However, the nurse who grew suspicious, informed the management, after the accused had left the place. The management, who crosschecked about the accused, found out that he is not a doctor, and that he is also not associated with the hospital.

The management sent an advisory to all employees to produce their identity cards, whenever they enter any wards, especially at night, and also to keep an eye on anyone suspicious. The same message was passed on to other hospitals in the vicinity.

The accused again showed up at the hospital on Sunday night. As security guards were told about strangers visiting the hospital in the guise of doctors, he was allowed to enter the hospital premises, so that he can be apprehended. He later went to the reception counter and queried about the consultant urologist. When he noticed that the staff had an idea about what was happening, he tried to flee from the spot. He was later caught by a security guard, and the police were informed. He was arrested by Ullal police station personnel.

Dr Padmanabha added that he used to roam around with his friend in a car. He was also involved in a similar incident at a private hospital in Kankanady, and the same has been informed to the police. He visited hospitals in a car, which has been seized by police.
