Delhi HC grants six months interim bail to Kanhaiya Kumar; JNU students celebrate

New Delhi, Mar 3: In a major relief to JNUSU President Kanhaiya Kumar, the Delhi High Court granted him bail on Wednesday. He is likely to walk out of jail on Thursday after submission of all the bail related documents.

The Delhi HC has granted him interim bail for 6 months on surety bond of Rs 10,000. Kanhaiya Kumar's lawyers are likely to process the bail related documents on Thursday.

Before granting bail to the JNUSU president, the court had put forth some conditions before him and JNU faculty. The court asked the JNU faculty to monitor the political actions of Kanhaiya Kumar.

Congress leader Kapil Sibal was the Kanhaiya's lawyer during his bail plea.

Earlier, on Tuesday, justice Pratibha Rani had reserved the order after over three hours of hearing on the bail plea of Kanhaiya who is accused of raising anti-India slogans inside JNU campus during an event organised on February 9.

What happened in court

During the hearing, while Kanhaiya's counsel had argued that the student leader had never raised any slogans against the nation, Delhi Police had maintained that there was evidence that he and others were shouting anti-India slogans and were holding Afzal Guru's posters.

Police had claimed that Kanhaiya was "not cooperating" in the probe and even came out with "contradictory" statements in joint interrogation by Intelligence Bureau (IB) and Delhi Police.

The defence lawyers including senior advocate Kapil Sibal had countered the allegations saying there were "some outsiders with covered faces who raised anti-India slogans and Kanhaiya was seen in CCTV footage asking them for their identity cards."

The bench had also asked tough questions to the police on slapping sedition charge on the accused and asked it to show evidence against him of his "active role" in raising anti- India slogans.

Kanhaiya had also distanced himself from Umar Khalid and Anirban Bhattacharya, the two other accused arrested in the case.

Meanwhile, the bail order triggered wild celebrations in JNU campus where hundreds of students, dominantly from leftist groups, celebrated, shouting slogans hailing Kanhaiya Kumar.

"We are happy, we are happy," a group of students said loudly, as per IANS.

Lawyer Vrinda Grover said she was happy with the bail order but said the surety would be provided only on Thursday when Kanhaiya Kumar is expected to walk out of Tihar Central Jail.

Special Public Prosecutor Shailendra Babbar told journalists that police would decide the next line of action after seeing the bail order.

"The order cleared one thing that we have some evidence to prove the charges framed against Kanhaiya," he said.

"If there had been no ground in our evidence, Kanhaiya would have been given a proper bail instead of an interim bail"

In Kanhaiya Kumar's hometown Begusarai in Bihar, family members and supporters burst crackers and hailed the court order. They also distributed sweets to residents.

Kanhaiya's arrest

He was arrested on February 12 in the case which was registered under sections 124 A (sedition) and 120B (criminal conspiracy) of the IPC.

According to the police, a group of students had on February 9 held an event in the campus and allegedly shouted slogans against the hanging of Parliament attack convict Guru.

this is the clear example of hundreds of Muslim youths who are in jail for years on false case. God only has to help these youngsters in this country. Our country is controlled by the RSS who are anti minorities and dalits.

Jan 15: Amazon.com Inc Chief Executive Officer Jeff Bezos is facing a bitter welcome during his India visit this week as the country’s antitrust regulator initiated a formal investigation just hours before his arrival and trader bodies comprising millions of infuriated small store owners announced demonstrations.

Bezos is in New Delhi for the Smbhav summit, an Amazon India event for small and medium businesses. The billionaire is scheduled to conduct a fireside chat with Amazon India chief Amit Agarwal, anchoring an event that also features Infosys Ltd. co-founder Narayana Murthy and retail billionaire Kishore Biyani, who recently sold a stake in his retail group to Amazon. Ahead of the event, Bezos paid his respects at Mahatma Gandhi’s memorial, wearing a white tunic and a rust-colored Indian vest.

The small businesses that Amazon’s CEO is hoping to endear himself to, however, are organizing in opposition. The Confederation of All India Traders announced that members of its affiliate bodies across the country would stage sit-ins and public rallies in 300 cities to raise a war cry against the world’s largest online retailer. In a letter to Prime Minister Narendra Modi last week, the confederation’s Secretary General Praveen Khandelwal alleged that Amazon, much like Walmart Inc.-owned Flipkart, was an “economic terrorist” who engaged in predatory pricing that deprived the government of tax revenue and “compelled the closure of thousands of small traders.”

India’s e-commerce market is projected to grow to $150 billion by 2022, according to a 2018 report by software industry group Nasscom and consulting firm PwC India. Competition for this rapidly expanding sector is intensifying as Asia’s richest man, Mukesh Ambani, prepares to go live with JioMart, an online shopping platform challenging Amazon and Walmart directly. The latter’s Flipkart Online Services Pvt is also delving deeper into the countryside in its pursuit for more customers. Amazon, for its part, opened a huge office complex in the southern city of Hyderabad in September, underscoring its commitment to the country.

The Competition Commission of India said it would probe the deep discounts, preferential listings and exclusionary tactics that Amazon and Flipkart are alleged to have used as anti-competitive levers. India’s trade bodies have long argued that both retail giants were flouting rules by promoting sales and discounts through their favoured sellers, many of whom they have preexisting commercial arrangements. The regulator has ordered for the investigation to be completed within two months.

Bezos last visited India in 2014 under starkly different circumstances. During that trip, the Amazon founder wore local festive garb, rode atop a festooned truck for a photo opp and presented Amazon’s Indian unit with a giant check for $2 billion. Since then, Amazon has pledged a further $3.5 billion to expand in the country.

New Delhi, Apr 28: Outstanding loans amounting to Rs 68,607 crore of top 50 wilful bank loan defaulters in the country including firms of Mehul Choksi and Vijay Mallya have been technically written off till September 30, 2019, the Reserve Bank of India said in a RTI reply.

Absconding dimantaire Choksi's company Gitanjali Gems tops the list of these defaulters with a whopping amount of Rs 5,492 crore, according to the list.

This is followed by REI Agro with Rs 4,314 crore and Winsome Diamonds with Rs 4,076 crore.

Rotomac Global Private Limited has funded advances of Rs 2,850 crore which have been technically written off and Kudos Chemie Ltd with Rs 2,326 crore, Ruchi Soya Industries Limited, now owned by Ramdev's Patanjali, with Rs 2,212 crore and Zoom Developers Pvt Ltd with Rs 2,012 crore being the other companies.

Mallya's Kingfisher Airlines figures in the list at number 9, with outstanding of Rs 1943 crore which have been technically written off by the banks.

Forever Precious Jewellery and Diamonds Private Limited has loans of Rs 1,962 crore written off while Deccan Chronicle Holdings Limited have Rs 1915 crore written off loans.

Choksi's other firms Gili India and Nakshatra Brands also have loans of Rs 1,447 and Rs 1109 crore respectively written off.

REI Agro of Jhunjhunwala brothers is already under the scanner of ED. The CBI and ED are also probing alleged fraud by the owners of Winsome Diamonds.

Vikram Kothari's Rotomac is the fourth in the list. He and his son Rahul Kothari were arrested by the CBI for bank loan default.

In the last Parliament session, Rahul Gandhi had asked the government to provide a list of top 50 bank loans defaulters in the country, leading to sharp exchanges and uproar in the Lok Sabha.

"The information on top 50 wilful defaulters and their sum of funded amount outstanding and amount technically/prudentially written off as on September 30, 2019 reported in CRILC by banks, is provided," the RBI said in its written response dated April 24.

In his application, RTI activist Saket Gokhale had sought the list of defaulters as on February 16, but the RBI said the requested information is not available.

The RBI said that according to section 8 (1)(a) of RTI Act 2005 read with para 77 of Supreme Court judgement of December 16, 2015 in Jayantilal N Mistry case, information on overseas borrowers is exempted from public disclosure.

"Data is as reported by banks and RBI will not be held responsibly or accountable for any misreporting and/or incorrect reporting by the reporting entities," the RBI said in the written reply to the RTI query.

New Delhi, May 30: The Congress on Friday described the first year of the Modi government as a "year of disappointment, disastrous management and diabolical pain".

Congress leader K C Venugopal said the six years of the Modi dispensation have seen fraying of bonds of empathy, fraternity and brotherhood with increase in acts of communal and sectarian violence.

Congress chief spokesperson Randeep Surjewala said that at the end of six years, it appears the Modi government is at war with its people and is inflicting wounds on them, instead of healing them.

"It is inflicting wounds on Mother India," he said.

"This government is trying to fill coffers of the select rich and is inflicting pain on the poor," Surjewala said.

On the BJP's charge of the Congress playing politics over the COVID-19 crisis, Venugopal said the opposition party did not indulge in any politics and gave suggestions instead.

"Being a responsible opposition, it is our duty to raise the problems faced by the common people. As opposition, we highlighted the failures of the government," he said.

Venugopal said the government "is totally insensitive" to the plight of migrant labourers and farmers.

Surjewala also demanded that a virtual session of Parliament be convened immediately to discuss pressing issues and the due process be set in motion for holding of meetings of various parliamentary committees.

Modi and his cabinet had taken oath on this day last year for a second term in office.
