Watching child porn in public is not free speech, says SC

New Delhi, Feb 27: Watching child pornography cannot be allowed in the name of liberty or freedom of expression, the Supreme Court said on Friday, even as the Centre informed that an exercise to block such contents on the Internet has been undertaken.stop-child-porn

A bench of Justices Dipak Misra and Shiva Kirti Singh asked Additional Solicitor General Pinky Anand to take suggestions from the National Commission for Women and others in helping the government prepare a scheme to ban child pornography.

The court said there was a distinction between art and obscenity and pornography cannot be allowed in the name of freedom of speech and expression as this is not an absolute right.

SC Women Lawyers Association, represented by senior advocate Mahalakshmi Pavani, urged the court to ensure prohibition of watching child pornography at public places, saying it has become a moral cancer as reports of school bus drivers and helpers forcing children to watch such materials and molesting them have come to light.

Concurring with her plea, the bench said, “Children need to be protected from this kind of moral assaults as it has the potentiality to bring them physical disasters.”

The bench further said: “Children cannot be made prey to these kind of painful situations, and a nation, by no means, can afford to carry any kind of experiment with its children in the name of liberty and freedom of expression. When we say nation, we mean each member of the collective.”

The court asked the Centre to file an affidavit suggesting ways and means to curb child pornography.

The law officer said that it was difficult to ban all websites containing pornographic materials on internet.

Advocate Vijay Panjwani, appearing for petitioner Kamlesh Vaswani, submitted that watching pornography or being compelled for it can never come within the definition of freedom of speech and expression as mentioned under Article 19(1)(a) of the Constitution.

Rather, it may attract penal provision, he added.

During the hearing, the court also said at times people may find something as objectionable while others may call it art. It put the matter for further consideration on March 28.

Ayodhya, Aug 2: With the foundation laying ceremony of the grand Ram temple around the corner, the work at the stone-carving workshop of Ram Janambhoomi in Ayodhya has reached its final stage.

Speaking to news agency, caretaker of Ram temple stone workshop Hanuman Yadav said, "Stonework is ready for the construction work till the first floor of the temple. Cleaning work is almost done but some work is still left which will be done soon after the trust's meeting."

Talking about the characteristics of the sandstone chosen work the construction, he said, "It was chosen for the construction as it can withstand rigours for thousands of years. These designated stones are minutely carved according to the need of the temple."

The stone-carving workshop for the Ram temple construction was established in Ayodhya by the Vishwa Hindu Parishad (VHP) in 1990.

On August 5 when Prime Minister Narendra Modi will visit Ayodhya for rituals that will mark the beginning of Ram temple construction, Hanumangarhi is the first stop he would be visiting.

The construction of Ram temple will begin in Ayodhya after the ceremony to lay the foundation stone in which various dignitaries from the political and religious fields are likely to participate apart from RSS chief Mohan Bhagwat.

New Delhi, Jun 7: Rain lashed some parts of the Delhi-NCR on Sunday morning.

The India Meteorological Department (IMD) has predicted partly cloudy sky with possibility of development of thunder lightning for three days from June 10 onwards with minimum and maximum temperature will hover around 29° Celcius and 42° Celcius respectively.

Strong surface winds during day time have been predicted for today by IMD.

Daman, Mar 3: A BJP councillor was shot dead on Monday in the Union Territory of Daman, police said.

Salim Memon was sitting in his motorcycle showroom when three to four unidentified persons shot four to five bullets after asking a visitor there to move out, an official said quoting eye-witnesses.

While fleeing, they also shot two rounds close to this visitor who was standing outside, he said.

"Memon was rushed to a hospital in Marwad area but was declared dead on arrival. CCTV footage is being scanned to nab the culprits," said Daman Superintendent of Police Vikramjit Singh.

Memon was elected to Daman municipality as a Congress candidate but then switched over to the BJP.

Sources said Memon, who also has a land brokerage business, had come out of jail a few months back in connection with a case of rivalry.
