CAG to apex court: state can use its report in Yeddyurappa cases

New Delhi, Feb 27: The Comptroller and Auditor General (CAG) has told the Supreme Court that the state government and its prosecuting agencies are free to take any decision on its reports relating to land denotifications undertaken during the tenure of the then chief minister B S Yeddyurappa.

Yeddyurappa“The issue whether the report of the CAG could be made basis for initiation of criminal proceedings is a matter which would fall within the domain of the state government and its prosecuting agencies,” it said in an affidavit filed in the apex court. The stand taken by the CAG comes in support of the Karnataka government which, in its special leave petition, contended that the reports prepared by the constitutional body could be relied upon for initiating action for “cognisable offence” against Yeddyurappa.

The CAG’s affidavit came in response to a notice issued by the Supreme Court, which has been hearing the Karnataka government’s petition challenging the Karnataka High Court’s single-judge bench order of January 5, 2016.

The CAG submitted that it has undertaken performance audit on denotification of land by the state government and allotment of sites by the Bangalore Development Authority (BDA). The audit findings were based on a sample determined at 40% of 126 denotification cases done by the government during 2007-12. The CAG also said its performance audit on land management was taken across the country in eight states and was not limited to Karnataka.

Allowing a batch of 15 petitions by Yeddyurappa, the high court had then held the CAG report could not be the basis for registration of FIRs relating to denotification of lands acquired by the BDA in Bilekahalli, Halagavaderahalli, J B Kaval and other places in Bengaluru city when he was the chief minister.

Yeddyurappa, on his part, has denied before the court any wrongdoing in passing orders for various denotification of land. He claimed the registration of 15 FIRs on the direction by the Lokayukta on the basis of CAG’s reports was “completely misplaced” and has rightly been quashed by the Karnataka High Court.

Responding to the apex court’s notice, Yeddyurappa said, “The CAG report cannot be the sole basis of registration of the FIR. Since the reports (2010-11 and 2012) submitted to the governor on November 21, 2012, is in the process of consideration of the Public Accounts Committee, no other authority can act upon the said report.”

Riyadh, July 6: The government of Saudi Arabia has announced health protocols to prevent the spread of the new coronavirus in the 2020 Hajj season, banning gatherings and meetings between pilgrims.

Saudi Arabia decided in June to limit the number of domestic pilgrims attending the Hajj to around 1,000 to prevent the spread of the coronavirus, after barring pilgrims abroad from the rite for the first year in modern times.

Touching the Kaaba, the holiest site in Islam, will be banned during the Hajj this year, and a social distancing space of a meter and a half between each pilgrim during the rituals including mass prayers and while in the Kaaba circling area will be imposed, a statement by the Center for Disease Prevention and Control (CDC) elaborated.

Also, access to holy Hajj sites at Mina, Muzdalifah and Arafat will be limited to those with Hajj permits starting Sunday July 19 till Aug. 2 2020, and wearing masks all the time will be mandatory for both pilgrims and organisers.

Mangaluru, Jul 17: Dakshina Kannada district Youth Congress president Mithun Rai has tested positive for the covid-19. 

Mr Rai took to social media to announce it: “I have been tested COVID19 positive & I am under Quarantine at Bangalore. With all your love and blessings, I will recover and be back soon at your service.

“My request to all those who were in close proximity with me in the last few days, kindly get yourselves checked for COVID,” he stated in a social media post on Friday.

Mangaluru, May 19: Team Be Human, a city based group of philanthropists, has taken commendable initiative to satiate the hunger of the civic workers of Mangaluru City Corporation that are endangering their lives to keep the city clean amidst covid-19 lockdown. 

On Friday, April 18, gorcesary kits were distributed among around 180 civic workers at Eidgah Maidan in Light House Hill in the presence of Corporator Abdul Raoof Bajal, Mansoor Ahmed Azad, Aina group Ashraf, Ceco Asif, Advocate Abdul Shukoor, U B Saleem, Sahil Zaheer, Rash Beary, Munna Kammaradi and Abdul Muttalib.

The Team swung into action on hearing the civic workers' plight due to the delay in payment of their wages by the Antony Waste Management firm. The Team was helped by the alumni of the St Aloysius College, Mangaluru (batch 1989). 

This is not the first time the Team Be Human distributing kits among the needy. Amidst lockdown it has already distributed around 1200 grocery kits among the poor people including the daily wage workers, migrant labourers in Dakshina Kannada district with help of Ahnaf Deals, Altaf, Shameem, Basha, Pradeep, Vincent,  Shiyaz Deals, Nawaz and Haneef. 

In its next step the Team Be Human is planning to distribute the kits among civic workers in Urva and Suratkal region, said Asif Deals, founder president of Team Be Human. He called upon the youth and students to come forward to help the needy and poor people who are deprived of basic facilities.
