Hadiya marriage: Kerala govt rubbishes NIA’s shocking claims

Kasaragod, Oct 7: The Kerala state government has  Kerala rejected the claims made by the Centre's National Investigation Agency (NIA) in the Supreme Court that the Hadiya case, involving conversion of a Hindu woman to Islam and her marriage to a Muslim man, is part of a “pattern” of religious conversions and radicalisation happening in the southern State.

In fact, Pinarayi Vijayan-led CPI (M) government said the Kerala Police was doing an “efficient” job investigating the Hadiya case until the Supreme Court intervened and, believing the NIA’s claims, transferred the investigation to the central agency.

In an affidavit filed in the Supreme Court, the Kerala government said the investigation conducted by the State Police had not revealed any offences which warranted an NIA probe.

"The investigation conducted so far by the Kerala Police has not revealed any incident relating to the commission of any scheduled offences to make a report to the Central Government under Section 6 of the National Investigation Agency Act, 2008," the affidavit filed by Subrata Biswas, the State's Additional Chief Secretary, Home Department, said under oath to the Supreme Court.

The State questioned the sudden transfer of the case to the NIA, saying the State Police Chief had already entrusted the investigation to the Additional Director General of Police (Crimes) and directed to constitute a Special Investigation Team.

A comprehensive probe was already on into various aspects, including the conversion of the woman to Islam, the religious institutions and persons involved, the persons she was in contact, the family background and criminal antecedents of the man she married to, Shafin Jahan, the financial arrangements and other details of their alleged marriage, and finally, if the case involved any attempts of trafficking Hadiya to outside the country.

"The Kerala Police had conducted a thorough investigation in an efficient manner. The Kerala Police is competent to conduct the investigation in such crimes and would have reported to the Central government if any scheduled offences were found to have been committed as per the provisions under the NIA Act," the affidavit said.

On August 16, when the case was transferred to the NIA, then Chief Justice of India J.S. Khehar made a blunt remark to the Kerala government counsel that "we think you (Kerala Police) may take sides. So we asked the NIA for their inputs’’.

The court had wanted the NIA to give inputs after going through the files of the Hadiya case. Additional Solicitor General Maninder Singh, for NIA, had then returned to submit to the court that the Hadiya case was "not an isolated case and we have come across another case with a similar pattern and involving the same people who are acting as instigators".

However, the Supreme Court Bench on October 3, this time led by Chief Justice Dipak Misra, had done a virtual U-turn by questioning the August 16 order for NIA probe.

The Bench led by Chief Justice Misra also prima facie found that the Kerala High Court had no authority to annul the inter-religious marriage between Jahan and Hadiya.

“The order for NIA investigation strikes at the very foundation of multi-religious society... Two senior BJP functionaries have married members of minority communities,” senior advocate Dushyant Dave and advocate Haris Beeran, for Jahan, had argued.

The apex court had further questioned the legality of girl's father keeping her in his custody for the past several months.

“We will hear logical and legal arguments on two issues — can the HC nullify a marriage exercising jurisdiction under Article 226 and was an NIA probe necessary,” Chief Justice Misra had observed, posting the case for hearing on October 9

Mangaluru/ Udupi, June 19: As many as 13 fresh coronavirus positive cases were reported in Dakshina Kannada on June 19, taking the total number of cases in the coastal district to 414. In Udupi, the total number of covid cases mounted to 1,050 with 11 new cases.

Four among the 13 patients in Dakshina Kannada had returned from Saudi Arabia and seven had returned from Sharjah recently. Two others were suffering from an influenza-like illness (ILI). All the 13 patients have been shifted to the designated COVID hospital in Mangaluru.

In Udupi, three among the 11 new covid patients are children. Four are Maharashtra returnees and two had come from Tamil Nadu. Five others have contracted infection from other positive patients. 

Only 98 cases are currently active in Udupi among 1,050. As many as 950 patients have been discharged from hospital. Two deaths have occurred in the district including one on Friday.

Mumbai, Feb 17: The Shiv Sena on Monday said the ongoing preparation for the much awaited visit of US President Donald Trump is a reflection of the "slave mentality" of Indians.

Trump's India trip is like the visit of a "Badshah" (emperor), an editorial in Sena mouthpiece 'Saamana' said.

Taking a dig at the construction of a wall on a plot having several slum structures in Ahmedabad ahead of Trump's visit there, the Sena said the US president's trip would neither stop the fall of rupee's value in forex market nor offer betterment to those (slum dwellers) behind the wall.

"Before Independence, British King or Queen used to visit one of their slave nations like India. The kind of preparations going on from taxpayers' money for the arrival of Trump is similar to it. This reflects the slave mentality of Indians," it said.

The Sena also took a swipe at Prime Minister Narendra Modi over the Ahmedabad Municipal Corporation's (AMC) move to build wall on a plot to "hide the slums" on the route through which Trump's convoy would pass.

"Former prime minister Indira Gandhi had once given the slogan 'Garibi Hatao', which was ridiculed for a long time. It seems now Modi's plan is 'Garibi chupao' (hide poverty)," the Marathi publication said.

Is there any financial allocation for such a wall being built in Ahmedabad? Is the US going to offer loan to India to build such walls across the country? it wondered.

"We have heard Trump is going to be in Ahmedabad for only three hours but the wall construction is costing almost Rs 100 crore to the state exchequer," it said.

It is basically a political arrangement between Prime Minister Modi and US President Trump, the Sena claimed.

Last year, 'Howdy, Modi!' (a mega event jointly addressed by the Indian prime minister and Trump) was organised in the US, it noted.

A similar programme, "Kem Chho Trump" (Gujarati expression for how are you Trump), has been now organised (in Ahmedabad) ahead of the US elections, chiefly because of a sizable number of Gujarati people living in America, the Shiv Sena claimed.

"But this visit of President Trump is neither going to stop further fall of rupee in the forex market nor offer betterment to those behind the wall (being built in front of slums in Ahmedabad)," it said.

The Sena said Trump is "not someone very wise or a statesman or someone who cares for the whole world", but he has to be treated with respect as he represents the mighty US.

"Sometimes you have to treat someone with respect to get your things done," it quipped.

The AMC on Friday said the construction of the wall, around four feet in height, was approved much before Trump's Gujarat visit was finalised.

Trump is scheduled to visit Modi's home state Gujarat on February 24.

He will visit the famous Sabarmati Ashram in Ahmedabad and take part in a roadshow with Modi. After that, the two leaders will inaugurate a new cricket stadium in Motera and address a gathering there, with an expected audience of over a lakh people.

While it was earlier speculated that the programme would be called 'Kem Chho Trump', the Ahmedabad Municipal Corporation on Sunday tweeted a series of posters confirming that the event is now christened as 'Namaste Trump', apparently to give it a pan-India appeal.

Mangaluru, May 13: Coastal district of Dakshina Kannada today reported a fresh covid-19 positive case. According to sources, this case also linked to Manglauru’s First Neuro Hospital, which has emerged as the corona hub of coastal Karnataka.

Health and Family Welfare department in its today’s bulletin revealed that a 38-year-old woman from Darandabagilu near Someshwara in Mangaluru taluk of Dakshina Kannada was tested coronavirus positive.

It is said that the woman was in touch with P-507, an octogenarian, who was being treated for neurological issues at First Neuro Hospital.

With this the total number of coronavirus positive cases reported in Dakshina Kannada rose to 34. Among them only 26 are residents of Dakshina Kannada. Four are from Kasaragod, three from Udupi and one from Bhatkal.

Among 34, currently there only 17 active cases. The condition of two among them is said to be critical.
