CJI sets up 5-judge constitution bench to hear major issues

New Delhi, Jan 16: Amid a virtual rift between the Chief Justice Dipak Misra and four senior-most judges over assignment of important cases, the Supreme Court on Monday announced the composition of a 5-judge constitution bench headed by the CJI, which does not include them.

None of the four judges — Justices J Chelameswar, Ranjan Gogoi, M B Lokur and Kurian Joseph, feature in the list of members of the 5-judge constitution bench.

As per official information, the 5-judge bench, comprising Chief Justice Dipak Misra, Justice A K Sikri, Justice A M Khanwilkar, Justice D Y Chandrachud and Justice Ashok Bhushan, will commence the hearing on a range of crucial matters from January 17.

Meanwhile, court sources said it was not confirmed whether the CJI on Monday met the four judges who had hurled accusations against him at their controversial press conference on January 12.

As per the list of business for Tuesday, the 5-judge bench will hear major cases such as those challenging the constitutional validity of the Aadhaar Act and its 2013 judgment re-criminalising gay sex between consenting adults.

The same combination of judges had last year heard various constitution bench matters from October 10, including the power tussle between the Centre and the Delhi government over administrative jurisdiction and a matter relating to passive euthanasia.

This bench would also hear the contentious issue of the ban on the entry of women between 10 and 50 years of age in Kerala's Sabarimala temple and resume hearing a legal query on whether a Parsi woman would lose her religious identity if she marries a man from a different religion.

Another contentious matter relates to the challenge to the validity of a penal law on adultery, which only punishes a married man for having an extra-marital sexual relationship with a woman married to someone else.

The other issues to be dealt with by constitution bench include the pleas, which have raised a question as to when will a lawmaker, facing criminal trial, stand disqualified.

All these matters were earlier referred to larger benches for adjudication by different benches of the apex court.

The daily list of business for tomorrow shows that the two PILs seeking probe into Loya's death are listed before a bench headed by Justice Arun Mishra, against whom aspersions were cast by a senior advocate in public.

In their unprecedented press conference on Friday, the four senior judges of the apex court had mounted a virtual revolt against the CJI, listing a litany of problems, including the assignment of cases. They had also raised questions over listing of PILs concerning Loya's death.

An office bearer of the Supreme Court Bar Association (SCBA) said a copy of their resolution was submitted by its president Vikas Singh to the CJI yesterday, but have not heard anything from the top court as yet.

Singh had expressed hope that all judges of the apex court would consider the SCBA resolution seeking a full court discussion to defuse the crisis plaguing the higher judiciary.

The SCBA, at an emergency meeting on Saturday, had passed the resolution expressing grave concern over the differences of four senior-most judges with the CJI.

It had said that all public interest litigation (PIL) matters, including the pending PILs, should be either taken up by the CJI or be assigned for adjudication to four senior judges who are part of the apex court collegium.

New Delhi, Feb 18: Delhi Transport Minister Kailash Gahlot is the richest minister in the AAP government, according to a report released by the Association for Democratic Reforms (ADR) on Monday.

In a statement, the NGO said, Delhi Election Watch and ADR have analysed the self-sworn affidavits of all the seven-party leaders including Chief Minister Arvind Kejriwal.

According to the statement, the minister with the lowest declared total assets is Gopal Rai with assets worth Rs 90.01 lakh.

"The minister with the highest declared total assets is Kailash Gahlot from Najafgarh constituency with assets worth Rs 46.07 crore," it stated.

The report by ADR comes on the day Kejriwal and his six ministers took charge after the formation of the new AAP government.

Chief Minister Kejriwal and his cabinet colleagues took charge of their respective offices on Monday and asserted that they would work to fulfil the promises made in the "guarantee card", released during the poll campaign, including reduction in pollution and expansion of metro network.

Members of his Cabinet are -- Manish Sisodia, Satyendar Jain, Rajendra Pal Gautam, Imran Hussain, Gopal Rai and Kailash Gahlot.

Gwalior, Jul 23: As India's daily infections of coronavirus keep rising, the country is fighting a pandemic which is getting bigger by the day.

A vaccine, according to the World Health Organization, may not be coming until early 2021 despite good progress on the font. There is also, so far, no definitive cure for the virus, yet.

Madhya Pradesh Assembly Protem Speaker and Bharatiya Janata Party(BJP) leader Rameshwar Sharma, however, feels that the end of the coronavirus pandemic will begin with the start of the construction work for Ram Temple in Ayodhya.

"He (Lord Ram) had reincarnated for the welfare of mankind and to kill demons at that time. As soon as the construction of Ram Temple begins the destruction of the COVID pandemic will begin too," said Sharma, reports ANI.

"Not only India, but the entire world is suffering due to coronavirus. We are not only maintaining social distancing but also remembering our holy figures. The Supreme Court has ordered that Ram Temple will be built," he further added.

The treasurer of Shri Ram Janmabhoomi Tirtha Kshetra Trust, Swami Govind Dev Giri had said that Prime Minister Narendra Modi will lay the foundation stone of Ram Temple on August 5.

He said that social-distancing norms would be ensured at the program, and not more than 200 people will be attending the ceremony.

"The Prime Minister will visit Hanuman Garhi, Ram Lalla Temple, plant a tree and later do the 'bhoomi pujan'," he told ANI.

Ram Mandir trust spokesperson Nritya Gopal Das said five silver bricks will be placed inside the sanctum sanctorum during the ceremony.

The bricks are believed to symbolise five planets as per the Hindu mythology, he said, adding that the design and the architecture of the temple is the same as the one proposed.

According to the trust sources, Home Minister Amit Shah, Defence Minister Rajnath Singh, RSS chief Mohan Bhagwat , Maharashtra Chief Minister Udhav Thackeray and Bihar CM Nitish Kumar are also on the list of invitees.

India so far has recorded 1.19 million coronavirus positive cases, and 28,732 deaths.

Dubai/Abu Dhabi, May 7: A group passengers who are scheduled to fly to Kozhikode on the first COVID-19 Indian repatriation flight have begun streaming in to Terminal 2 at Dubai International Airport.

Wearing masks and gloves, the passengers are now waiting for the medical screening and check-in services to begin.

Airport officials gave entry to the departure terminal only to passengers with tickets.

Naif resident Mahamood P.P, 60, was among the first to reach as he was not informed about the change in the flight schedule, he told Gulf News.

“I reached here at 9.30am as I didn’t get any information about the 2.10pm flight getting rescheduled to the evening,” he said.

Suffering from a heart disease, Mahmood, who works as a juice maker at a juice shop near Naif Police station, said he stepped out of his room for the first time in two months.

“As there were many cases in Naif, I never went out because of my health condition. Since I was not in contact with anyone else other than my roommates who also never went out, I didn’t go for the COVID screening also. I was worried that I might be exposed to infection while waiting for the tests,” he said.

He thanked the Indian Consulate for giving him priority to fly home. “I need to go for my heart checkup. So I wanted to fly home as soon as possible.”

However, he said his son, a civil engineer who came here searching for a job, is not flying back though he is on a visit visa.

“Since the UAE government has allowed people on visit visa to stay here till December, he has decided to try his luck in getting a job,” said Mahamood.

Sneha Thomas, who is eight months pregnant, was also among the first to arrive at the airport.

Her husband Somi Jose came to drop her.

Thomas is among 11 pregnant women flying on the Dubai-Kozhikode flight.

Sharjah resident for 30 years, Mohammed Ali Yaseen, who is also the secretary of the Kerala Muslim Cultural Centre in Sharjah, said he is flying home as the restaurant he was running had to be closed due to a demolition plan of the building.

“Three months ago I got the notice to vacate the building and I had to close the restaurant. I was looking for another shop. But then the coronavirus hit. Now there is no point in me opening me a new shop as those who are already operational are not getting any business.”

He said he decided to drop the plan and go home for now. “My visa and license are still valid. I will try to come back when this pandemic ends and things are better.”

Meanwhile, at the Au Dhabi International Airport, families with kids were given priority to proceed towrards check-in. at terminal 3. The passengers coming in right now were mostly women who were on a visit visa. Pregnant women and the elderly too were given priority.
