Hadiya case: No court can annul marriage between two consenting adults, says SC

The Supreme Court of India on Thursday, Feb 22, observed that no court can annul marriages between two consenting adults or resort to a “roving enquiry” on whether the married relationship between a man and woman is based on consent.

The Bench led by Chief Justice Dipak Misra defined the limits of the court's jurisdiction in Hadiya case.

“Can a court say a marriage is not genuine or whether the relationship is not genuine? Can a court say she [Hadiya] did not marry the right person? She came to us and told us that she married of her own accord,” Justice D.Y. Chandrachud observed.

Ms. Hadiya, the 26-year-old Homeopathy student converted to Islam and subsequently married a Muslim man. The marriage was annulled by the Kerala High Court, which said it was “sham”. Her father, Asokan K.M., alleged that she was indoctrinated by a “well-oiled network” who is a front to recruit Indian citizens and traffick them abroad to strife-prone countries like Syria to work as “sex slaves”. However, Hadiya has repeatedly stated that her father had been telling blatant lies to separate her from her husband.

“She said on the telephone to her father that she wants to go to Syria to rear sheep. There may be fathers who receive such news with calm and fortitude, but this father was alarmed,” senior advocate Shyam Divan, for Mr. Asokan, addressed the Bench. Mr. Divan said his daughter is a victim of an “enormous trafficking exercise”.

Justice Chandrachud countered that if there was trafficking of citizens involved, the government had the power to stop it on the basis of credible information. If citizens are travelling abroad to be part of a manifest illegality, then too, the government has the authority to stop them.

“But in personal law, we cannot annul marriages because she did not marry the right person,” Justice Chandrachud told to Mr. Divan.

Chief Justice Misra said Ms. Hadiya's father may still view her as a child who was enticed or attracted by some kind of extraordinary situation. “But she is an adult,” Chief Justice Misra pointed out.

Chief Justice Misra said “What troubles us is there is a roving enquiry on the marriage of two consenting adults to find out whether was consent.”

The National Investigating Agency (NIA) had been probing the case and what they claim to be several other similar cases of “brainwashing”, radicalisation and indoctrination in Kerala. In the previous hearing, the court had told the NIA to stay away from prying into Ms. Hadiya's choice to marry Shafin Jahan.

But Mr. Divan said the Kerala High Court was “absolutely justified” in annulling the marriage, considering the particular circumstances of the case and the material before it that there was a network involved behind the conversion and marriage of Ms. Hadiya.

Countering Chief Justice Misra's observation that courts cannot intervene in a marriage between adults, Mr. Divan classified Ms. Hadiya as a “vulnerable adult” who still needs protection.

“This is a case exactly in which marriage is being used as a device to keep her [Hadiya] outside the reaches of the court,” Mr. Divan submitted.

In an intervention, senior advocate Kapil Sibal, for Mr. Shafin Jahan, said Mr. Divan was being “unfair” to the court. Mr. Sibal denied that Ms. Hadiya said she wanted to go to Syria for sheep farming. Instead, it was her father, upset by her conversion to Islam and subsequent marriage, who told her that she would be trafficked to terrorist countries. The court scheduled the next hearing on March 8.

Based on SC ruling  on Wrong judgement for simple cases  by the High court shows incompetency of the judges.

The marriage of 2consented parties can not be annulled by the court, even if it is wrong religiously, still they have access to have court marriages.

Very pity High court judges commit simple mistakes. A layman would never do such errors.

Mangaluru, Feb 25: Notorious gangster Ravi Poojary,

who has been extradited to India from Senegal, has 34 cases registered against him within the city police commissionerate.

Now in Bengaluru police custody for interrogation in connection with several cases there, Poojary faces cases relating to murder, murder attempt, extortion and threat calls in the city, police sources said.

Sources said the city police are trying to get Pujari for interrogation though it would take a while as the court has allowed Bengaluru police to keep him in custody for questioning and evidence taking for 15 days.

Most of the cases in the city against him, 28 of them, are in connection with threat calls.

He had allegedly made threat calls in 2015 to the then state ministers B Ramanath Rai and Abhayachandra Jain, demanding immediate arrest of the accused in the murder of Bajrang Dal worker Prashanth Poojary.

All the cases against Poojary in the city were registered between 2007 and 2018.

Cases involving murder, death threats and shootouts are among the cases to be investigated, the sources said.

A total of 28 cases of death threat calls, one of murder, three of shootouts, one of abduction and a case of funding his associates lodged in prison are the crimes being probed by the city police.

The cases are now pending in courts at different stages of trial.

Cases of making threat calls to businessmen using his associates demanding protection money have been registered at Moodbidri, Kavoor, Kadri, Konaje, Barke and Urwa police stations.

Some of his associates were imprisoned in 2012 in connection with threat calls to a businessman from Kinnigoli.

The case relating to providing them money while in prison was also registered in the same year.

Pujari, wanted in many cases including extortion and murder in different parts of the country, including Karnataka and who had been on the run for over 15 years, was deported to Senegal following his arrest and later extradited

He had jumped bail in Senegal last year after being arrested there.

Mangaluru Jul 11: A member of Adyar gram panchayat, who was attacked by a gang last night breathed his last at a private hospital in the city.

Mohammed Yaqoob, who was a BJP backed member of Adyar GP was attacked near his village by a gang at around 9 pm on Friday.

In spite of sustaining serious injuries, he managed to return home. 

He then hired an auto-rickshaw and went to Highland Hospital along with his son. 

However, he breathed his last there without responding to any treatment.

According to sources, the victim knew one of the assistants.

It is suspected that political or personal rivalry might be the reason for the attack. However the exact motto behind the attack is not yet known. 

A case has been registered in Kankanady Rural police station.

New Delhi, Jul 29: Air Commodore Hilal Ahmad Rather has become a buzz name in Kashmir overnight. Hilal saw off the first batch of Rafale jets which took off from France to India on Monday. Among other things, he has also been associated with the weaponisation of the Rafale aircraft for acclimatisation to Indian requirements.

Hilal is presently India's Air Attache in France.

The career details of this officer of the Indian Air Force (IAF) read like the decoration scroll of the best flying officer anywhere in the world.

Born in the south Kashmir's Anantnag district to middle-class parents, Hilal's father, late Mohammad Abdullah Rather retired as a deputy superintendent of police (Dy SP) in J&K police department. He has three sisters and is the only son of his parents. Hilal studied in Sainik School in Nagrota town of Jammu district.

He was commissioned in IAF as a fighter pilot on December 17, 1988, became flight lieutenant in 1993, wing commander in 2004, group captain in 2016 and air commodore in 2019.

He graduated from defence services staff college (DSSC). He also graduated from air war college (USA) with distinction. He won the sword of honour in NDA. Hilal is also the recipient of Vayu Sena Medal and Vishisht Seva medal.

With an impeccable record of 3,000 accident-free flying hours on mirage-2000, MIG-21 and Kiran aircraft, Hilal's name will now forever be associated with Rafale in India.
