Controversy erupts after UP govt issues order to withdraw cases against CM Yogi

Chief Minister Yogi Adityanath-led Uttar Pradesh government’s decision of ordering withdrawal of cases against him among several other cases has triggered a controversy.

The order came a day before the Uttar Pradesh Criminal Law (Composition of Offences and Abatement of Trials) (Amendment) Bill, 2017 was tabled in the state assembly on December 21. The Bill proposing abatement of certain proceedings pending before magistrates until December 31, 2015 was passed the next day. 

Among the cases that were withdrawn include a 1995 case in which Yogi Adityanath, Shiv Pratap Shukla (now Minister of State for Finance at the Centre), Sheetal Pandey (BJP MLA from Sahajanwa) and ten others were booked for violating prohibitory orders.

The case, lodged at Pipiganj police station in Gorakhpur district, was pending in a local court which had earlier directed that non-bailable warrants (NBWs) be issued against the accused for non-appearance before it. Prosecution Officer, Gorakhpur, B D Mishra, said: “The court had ordered NBWs against all named but the warrants were not issued then.”

On December 20, the state government sent a letter to the District Magistrate, Gorakhpur, directing that an application be filed to withdraw the case before the court. The government order stated that based on a letter received from the District Magistrate on October 27 and after scrutinising facts of the case, it had been decided to withdraw the case. The letter mentioned the names of Yogi Adityanath, Shiv Pratap Shukla, Sheetal Pandey and ten others.

Gorakhpur Additional District Magistrate, City, Rajneesh Chandra confirmed that the order for filing an application to withdraw the case had been received. “The Prosecution Officer has been asked to file the withdrawal application in the appropriate court. Apart from the CM, the letter also has names of Union Minister Shiv Pratap Shukla and MLA Sheetal Pandey,” Chandra said.

According to records of the Pipiganj police station, the case under IPC section 188 (disobedience to order duly promulgated by public servant) was filed against Yogi Adityanath and 14 others on May 27, 1995 for holding a meeting in Pipiganj town despite imposition of prohibitory orders by the district administration.

Prosecution Officer Mishra said: “After the FIR was lodged, the district administration submitted documents related to the charges and the case in the local court. The court issued summons to all accused and when they did not respond, the court ordered NBWs against them around two years ago.”

“I have received the state government letter directing that a withdrawal application be filed in the court. The application sent by the state government has 13 names including Yogi Adityanath. We will move the withdrawal application in the court after the winter vacation,” Mishra said.

On December 21, before the before the controversial Bill was tabled, Yogi Adityanath told the Assembly that there were about 20,000 ‘politically-motivated’ cases that had been registered in the state for mere “dharna pradarshan” (demonstrations), and for which warrants were issued, sometimes years later. He said the amendment to the law would end all such cases.

In May this year, soon after Adityanath became the chief minister, his government had bluntly told the Allahabad High Court that he could not be tried for making a hate speech during the communal riots in Gorakhpur in 2007.

The riots in Gorakhpur in January 2007 were sparked allegedly after a provocative speech by Adityanath, the then local MP, over the killing of a Hindu youth in clashes between Hindu and Muslim groups during a Moharram procession.

Tumakuru, Jan 8: RSS leader Kalladka Prabhakar Bhat stoked controversy on Wednesday by stating that 'Jawaharlal Nehru University (JNU) is full of traitors'.

He was addressing the media after taking part in a pro-CAA rally organised by National Citizens Forum near the office of the deputy commissioner of the district here.

Bhat said, “JNU is full of traitors. Congress and communist parties have been generating anti-nationals there. But there is no need to close the university down. Modi government will handle it.”

“Nationalism should be infused among the students there through love and trust. They should be made to realize what the truth is,” he said.

New Delhi, Jan 9: A total of 10,349 people involved in the farming sector, including 5,763 farmers or cultivators, committed suicide in 2018, the National Crime Records Bureau (NCRB)'s report on 'Crime in India-2018' reveals.

The annual data was released around three months after the government released the NCRB report on 'Crime in India-2017'.

As per the latest data, of the 10,349 persons, who committed suicide in 2018, 4,586 were agricultural labourers.

The number of suicides in the farming sector in 2018 accounted for 7.7 per cent of the total suicide-victims (1,34,516) in the country, the NCRB data said.

Suicides in the country in 2018 rose to 1,34,516 from 1,29,887 in 2017.

The rate of suicides was up from 9.9 per cent in 2017 to 10.2 per cent in 2018. In 2017, a total of 10,655 farming sector-suicides were reported.

West Bengal, Bihar, Odisha, Uttarakhand, Meghalaya, Goa, Chandigarh, Daman and Diu, Delhi, Lakshadweep and Puducherry reported zero suicides of farmers or cultivators and agricultural labourers during 2018, said the report.

Mangaluru, Aug 7: Following the incessant rain for last few days and subsequent landslides reported at various places along Charmadi Ghat, the movement of vehicles been banned for two days. 

Charmadi Ghat road connects Dakshina Kannada and Chikkamagaluru districts on National Highway-73. The fresh landslides caused cracks on the road and uprooted many trees. 
Officials have closed Charmadi as well as Kottigehara check posts as a precautionary measure.

Belthangady tahsildar Mahesh J confirmed that multiple landslides have hit Charmadi Ghat road.

"The road has been closed for vehicular movement as the officials are at the spot to clear landslide debris. As a precautionary measure, vehicular movement has been banned as there are chances of further landslides," he said.

Hundreds of commuters who were stuck on various stretches of the ghat following a landslide between Maleyamaruta and Alekan falls in Chikkamagaluru district have been rescued.
