Man fined for posting wife’s private photos on FB

Dubai, December 16: The Court of Appeal recently fined an Indian man Dh2,000 for posting private photographs of his wife on the social networking site, Facebook.

The court also slapped a fine of Dh1,000 on him for consuming liquor and quashed the deportation order handed down by the Court of Misdemeanours.

The Court of Misdemeanours had earlier dismissed the case after the defendant submitted a waiver from his wife relinquishing her rights to pursue the case against him for allegedly posting her photographs and details on Facebook, breaching her privacy.

The court had also imposed Dh1,000 in fine for consuming liquor and ordered that he be deported.

A Court of Appeal bench presided by Judge Dr Ahmed Al Mutawah did not take into consideration the wife’s relinquishing of her rights when handing down the verdict, observing that such a criminal charge may not be dismissed with the filing of a waiver. Posting others’ private photographs on a public forum is a crime that affects their reputation and personal life.

The defendant and his wife had been married for 12 years and have two children together. However, disagreements began to surface about four years back, which the wife blamed on his bad treatment of her and his habit of drinking liquor.

Both had been living alone for seven months prior to the complaint. During their split, the defendant posted on Facebook private photographs of his wife with her cousin which were taken before her marriage to him.

He tagged the photos with the line ‘she kicked her husband out to have a good time’ on his Facebook page.

He then text messaged her to have a look on his Facebook page, which upset her a lot and she lodged a complaint at the police station.

In the court, the defendant claimed he was intoxicated when he posted his wife’s photos on the Net.

During trial, the wife withdrew her complaint and surrendered her rights to sue him legally. But he had still to face the criminal charges as stipulated by the law.

The Public Prosecution challenged the verdict of the Court of Misdemeanours citing a flaw in implementing the law regarding the dismissal of the case for the offence of posting the private photos because of the waiver.

The prosecution requested that the Court of Appeal to rectify that flaw as per the Criminal Procedure Code.

Pratapgarh, Jun 2: In a shocking incident, a young man was tied to a tree and set afire by the family of a woman with whom he was allegedly having an affair in Pratapgarh district of Uttar Pradesh late on Monday night.

The man, 25, was a resident of Bhujauni village under Fatanpur police station, and he died on the spot.

Enraged over the incident, his family members and local people turned violent and set two police vehicles on fire.

Additional forces were rushed in to control the situation that remains tense.

The body has been sent for post-mortem.

According to Superintendent of Police (SP), Pratapgarh, Abhishek Singh, "Some people barged into the house of Ambika Patel and dragged him away. They then tied Patel to a tree some distance away and set him on fire after sprinkling petrol on him. They fled immediately after." Agitated family members and villagers assembled at the site and set a 112 police response vehicle (PRV) and another police jeep on fire. They were demanding immediate arrest and action against the accused.

The official said that Patel's relatives claimed that he was having an affair with a woman from his village and this had resulted in many face-offs between the families.

Patel had reportedly shared a video clip of the woman on social media a few months ago further increasing tension between the families.

The woman's family members had registered a police complaint against Patel in this connection at the Fatanpur police station that led to his arrest. He was released from jail recently, police added.

The woman had been recently selected as a police constable and was posted to Kanpur.

The SP said that an FIR had been registered on the complaint of the victim's family and efforts were on to arrest the accused.

Thane, Mar 22: Eight men were arrested at Kalyan in the district on Sunday as they were found playing cricket during the 'Janata curfew' being observed to check the spread of coronavirus, police said.

They were playing cricket at Kala Talao Maidan in the afternoon, police said.

Police also detained a boy in this connection, an official said.

"Action was taken against them for defying the prohibitory orders issued by the Thane Police Commissionerate.

They also went against the 'Janata curfew' being observed to curb the spread of coronavirus," the police official said.

The Mahatma Phule Chowk Police Station registered an offence against the accused under IPC sections 188 (disobedience to order duly promulgated by public servant), 269 (negligent act likely to spread infection of disease dangerous to life), 290 (public nuisance).

They were also booked under the Maharashtra Police Act as well as the National Disaster Act 2005, the official said.

Muzaffarnagar, Jun 11: Three persons have been arrested for allegedly using plastic scrap to make jaggery at Bhokaheri village under Bhopa police station here, as official said on Thursday.

 Police raided a jaggery manufacturing unite (kolhu) and arrested three persons on Wednesday, SHO, Bhopa police station Sanjive Kumar said.

Police have registered a case against five persons including the trio that was arrested while two of them managed to escape, he said, adding that two loaded tractor trollies of plastic scrap have been seized.
