Hindu marriage ties non-Hindus in knots, couple gets HC wrap

Mumbai, June 24: Marry in a hurry and repent at leisure, observed the Bombay high court as it grappled with a tangle that a Christian man had landed in by marrying a Muslim woman under the Hindu Marriage Act.

Mark Rebello had married Sakina Khan (names changed) on May 31, 1995 according to Vedic rites, apparently after being misguided by the marriage 'shops' outside the Bandra courts, and their marriage was registered under the Bombay Registration of Marriages Act. They had a daughter in 1998. Till 2005 everything was fine, but then differences cropped up and the couple separated in 2008.

The family court dismissed Mark's petition in 2008 for nullifying the marriage under Section 7 of the Hindu Marriage Act, saying it was not maintainable as they were both non-Hindus.

"How did you select to marry under the Hindu Marriage Act?" asked Justice PB Majmudar, who along with Justice Anoop Mohta heard Mark's petition challenging the family court order. "From day one, your marriage is illegal. Marry in (a) hurry and repent at leisure," he said. "They are opening shops for marriage and divorce also. Law-abiding citizens should never take advice from touts."

'Marriage shops misguided couple'

When Bombay high court judges pointed out that couple Mark Rebello and Sakina Khan should have married under the Special Marriage Act instead of the Hindu Marriage Act, Mark's advocate said they were misguided by the marriage 'shops'. "Marriages are solemnized here. They are giving divorces also on stamp paper. Their conduct must be deprecated by the court," he added.

Mark claimed in his petition that on June 16, 1995, he and Sakina, who got separated in 2008, had got married in church. But it did not seem to cut ice with the courts with the family court dismissing on November 10, 2011, his petition for declaration of the status of his marriage under section 34 of the Specific Relief Act.

The court reasoned that an earlier dispute between the same parties and under the same cause of action had attained finality and, hence, a fresh petition was not maintainable.

Sakina's advocate opposed the stand, saying the family court was right in dismissing his petition.

Meerut: The licence of a private hospital in Uttar Pradesh’s Meerut has been suspended after a video showing its staff member providing fake Covid-19 report had gone viral.

"A video had gone viral in Meerut. We have registered a case in this regard. We have suspended the licence of the nursing home. Today, we have sealed it also. Strict action will be taken against anybody who will do something like this in this time of crisis,” said Anil Dhingra, District Magistrate, Meerut.

In the video, the person can be heard saying that they provide Covid-19 negative report for Rs 2,500, Dhingra stated.

Meerut CMO Rajkumar said, “In the video, a man from the hospital can be heard saying that he can arrange COVID-19 negative report and the person can get operation or other things done. We have identified the man. We have suspended the licence of the hospital and an FIR has been registered.”

New Delhi, Jul 19: At least six people were killed and 20 injured when a bus overturned after colliding with a private vehicle at Agra - Lucknow Expressway in the wee hours of Sunday. According to initial reports, the bus carrying around 40 passengers toppled after hitting a stranded SUV at around 5 am, 122 km from Lucknow.

A police team reached the spot within a few minutes of the accident and rescued the injured with the help of locals. They were rushed to a nearby hospital. “Five passengers were killed on the spot while another died minutes after reaching the hospital,” Hindustan Times quoted Kannauj DSP Amarendra PD Singh as saying.

Around 20 other passengers have also sustained injuries who were admitted to the hospital, the police said. The bus had started from Bihar's Darbhanga and was en route to Delhi. "The private bus was coming from Darbangha and going to Delhi when it hit a car. Both the vehicles came down from the highway," a senior police official told news agency ANI.

Meanwhile, authorities are trying to ascertain the identity of the deceased. UP CM Yogi Adityanath expressed over the loss of lives and directed officials to ensure all help to the victims.

Unnao, Jan 3: The Uttar Pradesh Police has submitted a charge sheet in a court here in connection with the death of a 23-year-old Unnao rape victim, who was allegedly set ablaze by five men.

Additional Superintendent of Police Vinod Kumar Pandey, who is heading a Special Investigation Team in the case, said the charge sheet was submitted on Wednesday.

"There is ample proof against the five accused persons, and the charge sheet was prepared based on those evidences," he said on Thursday.

The 23-year-old Unnao rape victim, who was airlifted to Delhi and admitted to Safdarjung Hospital with 90 per cent burns after being set on fire, died following a cardiac arrest on December 6, 2019.

The woman was set afire by five men, including two of her alleged rapists, on December 5 morning when she was going to Rae Bareli to attend a court hearing in the rape case filed by her.

In her statement to Sub Divisional Magistrate Dayashankar Pathak, the woman had said she was attacked when she reached Gaura turn near her home on her way to the court.

She had specifically named Harishankar Trivedi, Ram Kishore Trivedi, Umesh Bajpai, Shivam Trivedi and Shubham Trivedi as the persons who set her on fire.

The woman had also alleged that Shivam and Shubham Trivedi had abducted and raped her in December 2018.
