Woman hit by court sign awarded Rs 19 lakh

New Delhi, July 9: A woman who became mentally disabled after a signboard at the Rohini district court fell on her head has been awarded a compensation of Rs 19 lakh by the Delhi High Court, which brushed aside claims of the defendants that the incident was an "act of God".

The victim, Harinder Kaur, was in the court premises pursuing a dispute against her estranged husband when the 'District Court Rohini' board fell on her from the rooftop, where it was loosely tied.

Justice Vipin Sanghi, in an order released earlier this week, asked the Rohini district court, PWD and MCD to compensate Kaur for their negligence that left her with permanent, 70% mental disability.

The high court also rapped the court administration and other civic agencies for ignoring municipal bylaws in putting up the board. "Facts speak for themselves and tell their own story of negligence, so as to establish a prima facie case against the respondents... The respondents have shifted liability from one to another," Justice Sanghi noted, holding the authorities responsible for the injury.

Kaur's 65-year-old mother had approached HC for compensation through advocate Pankaj Batra, who first argued that the placement of the signboard violated laws. He also placed on record RTI replies that revealed that PWD had failed to take mandatory permission from the MCD commissioner before putting up the board. The petition said the board was installed above a passage in the complex and it fell on Kaur as she was walking into the complex.

Citing Kaur's medical reports, Batra alleged that the injuries had resulted in her being unable to sleep and left her totally disoriented with no possibility of being employed.

After initially passing the blame amongst each other, the Rohini court administration, the PWD and the MCD attributed Kaur's injury to an "act of God" in view of the inclement weather on the day of the incident. They argued that the board fell due to strong winds and rains, and not because of negligence on their part.

But HC brushed aside the explanation saying squalls, duststorms and rain were a regular feature in Delhi. "Negligence is writ large on the part of the respondents. They can't in the garb of inclement weather shirk from their responsibility of complying with provisions of law and taking reasonable precautions so as to keep away all persons from harm," the court added.

Mandya, Jun 14: In a tragic incident, a woman and her two children were drowned in a pond at Beeranahalli village in Nagamangala taluk of this district on Sunday.

Police said that the deceased have been identified as Geeta (40), and her two children Savita(19) and Soumya(14).

Savaitha is a degree student while Soumya was studying in 9th standard. The trio drowned in a pond where they had gone to wash their cows. The locals rushed to the spot and tried to rescue them but could not save.

Kochi, Feb 6: A 46-year-old Thailand national was allegedly raped by two men here, following which they were arrested, police said on Thursday.

The accused hailing from a north Kerala district have been arrested on the basis of a complaint lodged by the woman.

Police said the accused-- Mohammed Insaf and his friend Ansaruddin from Kondotty in Malappuram district were arrested after recording the statement of the victim.

The woman from Thailand had been a Facebook friend of Insaf for the last seven months after she enrolled her child in a school in Malappuram district.

The woman who came from Bangkok recently to visit her child and was staying in a hotel here.

When Insaf came to meet the woman, he was accompanied by his friend Ansaruddin and both allegedly raped the woman at the hotel room, police said.

All formalities including medical examination of the woman were completed, police said.

The accused will be produced before the court on Thursday, they added.

Gorakhpur, Feb 16: Two unidentified policemen allegedly raped a 20-year-old woman in a hotel room near a railway station in Uttar Pradesh's Gorakhpur.

The incident took place on Thursday after which the woman informed her family members. The FIR was registered in the matter on Friday, police said.

A case under various sections of the Indian Penal Code (IPC) including gang rape has been registered against two unidentified police men at the Gorakhnath police station, they said.

No arrests have been made so far in this connection, the police added.

Members of various political parties including Congress, Samajwadi Party, BSP and Purvanchal Sena staged a sit-in demonstration at the office of the district magistrate (DM) demanding suspension of all staff members of the Gorakhnath police station as well as a magisterial probe into the matter.

"The girl is undergoing treatment at the district hospital. She has made serious allegation of rape by two policemen. During investigation we found that the hotel has CCTV footage and also took the statement of guard," SSP Gorakhpur, Sunil Kumar Gupta said.

"Prima facie, the woman went to the hotel room willingly with some men. However, a probe is underway and culprits won't be spared," he said.

The woman told media that both the policemen thrashed her and accused her of being involved in prostitution.

She claimed that she requested them to leave her but they beat her and raped her. Later, they asked her to go home in an autorickshaw.

The survivor also told media and investigating policemen that she will be able to identify the hotel room where the crime took place as well as the two policemen who allegedly raped her.

The woman said she runs coaching classes at her home and her father is a labourer.
