Custodial murder: 2 policemen get death penalty; 3 officers jailed

Thiruvananthapuram, Jul 25: In a rare judgment, a special court of Central Bureau of Investigation (CBI) in Kerala’s Thiruvananthapuram today awarded death penalty to two policemen in connection with the custodial death of a youth in 2005.

The court had on Tuesday (July 24) found the two personnel – K Jithakumar and S V Sreekumar, both civil police officers at the time of the incident and first and second accused in the case – guilty of custodial torture that led to the death of Udayakumar (27) at the Fort Police Station in Thiruvananthapuram. They were also directed to pay a penalty of Rs 2 lakh each.

CBI special judge J Nasser awarded three-year jail terms each to three other officers - T K Haridas (then assistant commissioner), E K Sabu (then circle inspector) and Ajith Kumar (then sub-inspector) - found guilty of fudging documents and destroying evidence in a cover-up attempt. K V Soman, then additional SI and third accused in the case, died during the trial.

A police team took into custody Udayakumar and his friend Suresh Kumar from the Sreekanteswaram Park in Thiruvananthapuram on September 27, 2005, for suspected theft. After ascertaining that Udayakumar was in possession of Rs 4,020, the policemen subjected him to third-degree treatment at the station to extract a confession, including the use of an iron pipe on his body, inflicting severe injuries that led to his death. The officers charged with conspiracy had registered a false case against Udayakumar after his death.

Suresh was among the witnesses who turned hostile after the trial in the case commenced.

J Prabhavathi, Udayakumar’s aged mother who fought the 13-year-long legal battle, called it a landmark judgement and said it was a verdict she was expecting. “No son should have to suffer like my son did,” she told reporters.

Bengaluru, Mar 13: Several ministers staying at the Bengaluru resort had been emotionally pressurised to leave the Congress party, said Congress leader Jitu Patwari on Thursday after he was rescued by party leader DK Shivakumar from getting arrested due to the scuffle that had broken out at Embassy Boulevard here.

"We had received information that one of the MLAs, Manoj Chaudhary, staying at the Boulevard wanted his father to bring him back home," Patwari told reporters.

He said, "We had accompanied Manoj's father to the resort but the moment we entered the restaurant at the resort, some miscreants took away Manoj to some other unknown place," Patwari told reporters.

"Meanwhile, we (Lakhan Singh and Jitu Patwari) were manhandled and taken to the police station," he added.

Patwari said that the police had started the process of arresting them but Shivakumar came to their rescue and stopped their arrest.

He further said, "The police manhandled us even though we tried to talk to them in a very calm manner."

"If the MLAs giving resignation was their decision then why is the BJP not allowing them to contact their families," the MP said.

He further said that Jyotiraditya Scindia would soon become a minister but "why are the other ministers being made scapegoats."

Earlier in the day, a Congress leader in Madhya Pradesh had said that if action on the assaulters of its two leaders is not taken then the matter will be taken to the court.

Mangaluru, Jan 8: In an operation, forest officials of Puttur has arrested two persons as many elephant tusks at Puduvettu in Belathangadi taluk of Dakshina Kannada.

Forest officials said on Wednesday the accused nabbed last night were identified as PK Dinesh from Madikeri and V Kumar from Hassan district.

Both were caught while trying to sell tusks the value of which was estimated to be lakhs.

Mandya, Feb 9: A youth from Arechakanahalli village of Maddur taluk on Saturday allegedly committed suicide in Bengaluru after his lover got engaged to another man.

The body of the deceased, Darshan, was found hanging from the celising of his room in Bengaluru. According to Darshan's relatives, he was in love with a girl for the past few years.

Darshan had wanted to marry her, much to the chagrin of her parents, it is said.

The girl's parents had allegedly warned him of dire consequences if he did not stay clear from their daughter. In the meanwhile, she got engaged to another man.

Feeling left out, Darshan allegedly ended his life. In the suicide note, Darshan has held his lover and some of her relatives responsible for his death. He has also claimed that his family was facing death threat from her family.

There are rumours that Darshan might have been killed after he refused to stop seeing the girl. Though both the families are from the same community, their financial status, sources said, is different.

According to the relative of Darshan, the girl is a close relative to a former minister from Mandya district.

"There are reasons to suspect that Darshan might have been murdered, and a suicide note may have been planted at the crime spot.

A proper investigation should be conducted to unearth the truth," he said.
