David Headley's deposition, a first in judicial history

February 8, 2016

Mumbai, Feb 8: When Pakistani-American and Lashkar-e-Taiba agent David Coleman Headley deposes before a Mumbai court on Monday through video-conferencing in connection with the 26/11 terror attacks of Mumbai, it would be the first time in the judicial history of India that a man would give evidence on an act of terror from foreign soil.

David“This is very important in the judicial history of India,” special public prosecutor Ujjwal Nikam said on the eve of deposition of Headley as an approver before Additional Sessions Judge G A Sanap, who presides over special cases related to terrorism including those charged under now repealed TADA. He was charged with 11 offences - but on December 10, he agreed to reveal details of the 26/11 terror attacks and he became a witness.

“Firstly, David Headley may give the broader aspect of the criminal conspiracy. Secondly, another important aspect of the evidence of David Headley would be that why the conspiracy was hatched, who were the persons behind the criminal conspiracy and how it progressed, he may also throw some light on the wanted accused in the case,” said Nikam.

It is to be seen what the 55-year-old Headley testifies about Jamaat-ud-Dawa founder Hafeez Saeed and Lashker-e-Taiba’s chief of operations Zaki-ur-Rehman Lakhvi, the two chief conspirators of the 26/11 terror attacks and other wanted people like Major General Saab, Abu Hamja and Abu Kaafa.
