Defamation case adjourned against Pak PM

Peshawar, Dec 20: A local court adjourned hearing into a defamation suit filed by former Pakistan Tehreek-e-Insaf (PTI), MPA Fauzia Bibi against Pakistan Prime Minister Imran Khan due to his lawyer’s failure to turn up.

Additional district and sessions judge Shah Waliullah Hamid Hashmi fixed January 3 for the next hearing observing that the court will hear arguments about a request of Mr Imran to return the lawsuit for lacking jurisdiction to hear it, Dawn reported. 

The former MPA, who was elected on reserved seats for women on the PTI’s ticket, has filed the lawsuit for recovery of damages to the tune of Rs 500 million for defaming her through leveling ‘baseless’ allegations against her- of horse trading in the Senate election.

The suit was filed in June this year under the Defamation Ordinance, 2002. The only defendant in the lawsuit is Mr Imran as PTI chief.

Lawyer Habib Qureshi appeared before the court and said as Imran’s counsel Babar Awan was busy with some case hearings in the Supreme Court, he was not able to visit Peshawar to appear before the court in the case. He sought the adjournment of the hearing.

During a hearing, Mr Babar had filed the application under Order 7 Rule 10 of Code of Civil Procedure, saying the press conference in question addressed by his client was held in Islamabad and not in Khyber Pakhtunkhwa.

He had said the committee constituted for taking action against the plaintiff was also constituted there.

The lawyer added that as the cause of action arose there, therefore, it was not in the jurisdiction of the present court to deal with this case.

Syed Gufranullah Shah, lawyer representing the plaintiff, said the defendant’s counsel had been using delaying tactics.

He requested the court to dismiss the application filed on behalf of Mr Imran as the court had the jurisdiction to hear the lawsuit.

The lawyer said his client was member of the Khyber Pakhtunkhwa Assembly and the statement of Mr Imran was related to her stint as member of the assembly. He stated that the allegations against the plaintiff were leveled in connection of Senate Elections for which she had cast vote at the KP Assembly.

He argued that the Defamation Ordinance 2002 was a special law and it had overriding effect over other laws. He added that under the said law the Peshawar district court was the relevant forum for hearing the defamation suit.

The lawyer said in the Senate polls held on Mar 3, his client had followed the direction with effect to cast vote in favour of all the candidates of her party nominated against general and reserved seats for women and technocrats.

In the lawsuit, the plaintiff claimed that after the Senate polls, Mr Imran began uttering, spreading and resorting to publication, communication and circulation of maliciously false, baseless and unfounded oral statements and representation against the plaintiff.

Mexico City, Aug 1: The number of people, who have died of COVID-19 in Mexico, has risen by 688 to 46,688 within the past 24 hours, Deputy Health Minister Hugo Lopez-Gatell said.

The number of victims in Mexico is now higher than in the United Kingdom, where 46,119 people have died of the disease. The largest number of fatalities - 153,311 - has been recorded in the United States, while Brazil comes second with 92,475 deaths.

Lopez-Gatell also said on late Friday that the number of confirmed coronavirus cases had increased by 8,458 to 424,637 over the past day.

A day earlier, the Latin American nation recorded 7,730 new cases of the coronavirus, with 639 fatalities.

The World Health Organisation (WHO) declared the COVID-19 outbreak a pandemic on March 11. To date, over 17.5 million people have been infected with the coronavirus worldwide, with over 677,000 fatalities, according to Johns Hopkins University.

Washington, Jun 27: Facebook has said that it will flag all "newsworthy" posts from politicians that break its rules, including those from President Donald Trump.

Separately, Facebook's stock dropped more than 8 per cent, erasing roughly USD 50 billion from its market valuation, after the European company behind brands such as Ben & Jerry's and Dove announced it would boycott Facebook ads through the end of the year over the amount of hate speech and divisive rhetoric on its platform.

Later in the day, Coca-Cola also announced it joined the boycott for at least 30 days.

CEO Mark Zuckerberg had previously refused to take action against Trump posts suggesting that mail-in ballots will lead to voter fraud, saying that people deserved to hear unfiltered statements from political leaders.

Twitter, by contrast, slapped a "get the facts" label on them.

Until Friday, Trump's posts with identical wording to those labelled on Twitter remained untouched on Facebook, sparking criticism from Trump's opponents as well as current and former Facebook employees.

Now, Facebook is all but certain to face off with the president the next time he posts something the company deems to be violating its rules.

"The policies we're implementing today are designed to address the reality of the challenges our country is facing and how they're showing up across our community," Zuckerberg wrote on his Facebook page announcing the changes.

Zuckerberg said the social network is taking additional steps to counter election-related misinformation.

In particular, the social network will begin adding new labels to all posts about voting that will direct users to authoritative information from state and local election officials.

Facebook is also banning false claims intended to discourage voting, such as stories about federal agents checking legal status at polling places.

The company also said it is increasing its enforcement capacity to remove false claims about local polling conditions in the 72 hours before the US election.

Ethan Zuckerman, director of the Massachusetts Institute of Technology's Center for Civic Media, said the changes are a "reminder of how powerful Facebook may be in terms of spreading disinformation during the upcoming election".

He said the voting labels will depend on how good Facebook's artificial intelligence is at identifying posts to label.

"If every post that mentions voting links, people will start ignoring those links. If they're targeted to posts that say things like 'Police will be checking warrants and unpaid traffic tickets at polls' a classic voter suppression disinfo tactic and clearly mark posts as disinfo, they might be useful," he said.

But Zuckerman noted that Facebook "has a history of trying hard not to alienate right-leaning users, and given how tightly President Trump has aligned himself with voter-suppressing misinfo, it seems likely that Facebook will err on the side of non-intrusive and ignorable labels, which would minimize impact of the campaign."

Earlier in the day, shares of Facebook and Twitter dropped sharply after consumer-product maker Unilever announced a new ad boycott on Facebook, Twitter and Instagram through at least the end of the year.

The European company said it took the move to protest the amount of hate speech online.

Unilever said the polarised atmosphere in the United States ahead of November's presidential election placed responsibility on brands to act.

In addition to the decline in Facebook shares, Twitter ended the day more than 7 per cent lower.

Unilever, which is based in the Netherlands and Britain, joins a raft of other advertisers pulling back from online platforms.

Facebook in particular has been the target of an escalating movement to withhold advertising dollars to pressure it to do more to prevent racist and violent content from being shared on its platform.

"We have decided that starting now through at least the end of the year, we will not run brand advertising in social media newsfeed platforms Facebook, Instagram and Twitter in the U.S.," Unilever said.

"Continuing to advertise on these platforms at this time would not add value to people and society."

Facebook did not immediately respond to a request for comment. On Thursday, Verizon joined others in the Facebook boycott.

Unilever "has enough influence to persuade other brand advertisers to follow its lead," said eMarketer analyst Nicole Perrin.

She noted that Unilever pulled back spending "for longer, on more platforms (including Twitter) and for more expansive reasons" in particular, by citing problems with "divisiveness" as well as hate speech.

Sarah Personette, vice president of global client solutions at Twitter, said the company's "mission is to serve the public conversation and ensure Twitter is a place where people can make human connections, seek and receive authentic and credible information, and express themselves freely and safely."

She added that Twitter is "respectful of our partners' decisions and will continue to work and communicate closely with them during this time."

New York, Apr 5: New York State, the epicentre of the coronavirus pandemic in the US, continued to record the highest count of daily deaths from COVID-19 as a staggering number of 630 people died in a 24-hour period and Governor Andrew Cuomo said the outbreak in the state could peak in about seven days.

The state had recorded the highest single increase in the number of deaths from novel coronavirus in a single day between April 2 and 3 when 562 people had died, one person dying from the viral infection almost every two-and-a-half minutes.

In the 24 hours since April 4, the death toll grew to 630, "all-time increase" up to a total of 3,565, up from 2,935 on Friday morning, Cuomo said.

The daily death toll in New York continues to grow at record numbers as the state remains the most impacted in the US from coronavirus.

Coronavirus cases in New York State now stand at 113,704, out of the country's total number of 312,146. New Jersey, the second most impacted state in the US, has about 30,000 COVID-19 cases.

New York City alone has 63,306 coronavirus patients, up from 57,169 the previous 24 hours, and 2,624 deaths.

Cuomo said the apex in the state, the point where the number of infections on a daily basis hits the high point, is still about 4-8 days away.

"We have been talking about hitting that apex, the high point of the curve. I call it the battle of the mountaintop. That's going to be the number one point of engagement of the enemy," he said.

"But our reading of the projections is we're somewhere in the seven-day range, four, five, six seven, eight day range. Nobody can give you a specific number, which makes it very frustrating to plan when they can't give you a specific number or a specific date, but we're in that range," Cuomo said.

"We are not yet at the apex. Part of me would like to be at the apex and just let's do it. But there's part of me that says it's good that we're not at the apex because we're not yet ready for the apex either, still working on the capacity of the (healthcare) system," the governor said.

Cuomo has expressed anger over the short supply of essential medical equipment for healthcare professionals to help them deal with the surge in coronavirus cases across the state and the country.

He said personal protective equipment (PPE) such as masks, gowns and face shields are in short supply in New York as they are across the country and there is need for companies to make these materials.

"It is unbelievable to me that in the New York State, in the United States of America, we can't make these materials and that we are all shopping China to try to get these materials and we're all competing against each other," he had said earlier.

Cuomo said on Saturday that the state has 85,000 volunteers, including 22,000 from outside the state, and he will also be signing an executive order to allow medical students who were slated to graduate to begin practising, supplementing the state's healthcare professional capacity.

On ventilators, he said the state had ordered 17,000 but there was not enough supply in the federal stockpile to meet this growing demand across the state.    

"China is remarkably the repository for all of these orders - ventilators, PPE, it all goes back to China, which long term we have to figure out why we wound up in this situation where we don't have the manufacturing capacity in this country," he said, adding, "New York has been shopping in China."

The Chinese government helped facilitate a donation of 1,000 ventilators that will arrive at the JFK Airport in the city, he said, as he thanked the Chinese government, Alibaba head Jack Ma, the Jack Ma Foundation, Alibaba co-founder co-founder Joe Tsai and China's Consul General Huang Ping.
In addition, the state of Oregon would deliver 140 ventilators to New York.    

Cuomo has signed an executive order allowing the state to redistribute ventilators and personal protective equipment from hospitals, private sector companies and institutions that don't currently need them and redeploy the equipment to other hospitals with the highest need.
Those institutions will either get their ventilator back or they will be reimbursed and paid for their ventilator so they can buy a new ventilator.
The 2,500-bed facility at the Javits Convention Centre, which was supposed to be used for non-COVID patients, will now be used as COVID-positive facility.

"The federal government will staff that and the federal government with equip that. That is a big deal because that 2,500-bed facility will relieve a lot of pressure on the downstate system as a significant number of beds and that facility has to make that transition quickly and that's what we're focused on," Cuomo said.

Cuomo emphasised that he wants the pandemic to end as soon as possible as it is taking an unprecedented strain on life.

"I want this to be all over. It's only gone on for 30 days since our first case. It feels like an entire lifetime. I think we all feel the same. This stresses this country, this state, in a way that nothing else has frankly, in my lifetime. It stresses us on every level.

The economy is stressed, the social fabric is stressed, the social systems are stressed, transportation is stressed," he said.
