Defamation case: Arvind Kejriwal, 5 other AAP leaders get bail

New Delhi, Apr 7: Delhi Chief Minister Kejriwal and five other AAP leaders, who were summoned as accused in a criminal defamaiton case filed against them by Union Minister Arun Jaitley, were today granted bail by a Delhi court.kejapp

Chief Metropolitan Magistrate Sumit Dass granted the relief to Kejriwal and AAP leaders Ashutosh, Sanjay Singh, Kumar Vishwas, Raghav Chadha and Deepak Bajpai, on a personal bond of Rs 20,000 each with one surety of like amount.

Kejriwal and other accused had appeared in court in pursuance to the summons issued against them on March 9. The court has now fixed the matter for May 19 for further arguments in the case.

During the hearing which commenced at around 2.35 pm, all the accused moved their bail pleas before the court which granted the relief to them. Jaitley was also present in the court room.

During the brief hearing, the counsel appearing for the accused told the court that they have not been supplied all the documents of the case after which senior advocate Sidharth Luthra, who appeared for Jaitley, said that they would provide entire sets of documents to the defence counsel.

Initially, the court granted bail to the accused on a personal bond of Rs 25,000 each with one surety of the like amount but one of the defence counsel told the court that they have brought fixed depsit receipts (FDRs) of Rs 20,000.

Hearing this submission, the court reduced the amount from Rs 25,000 to Rs 20,000 and fixed the matter for arguments on framing of notice for May 19.

Gopal Mohan, advisor to the CM, stood surety for Kejriwal and Delhi Minister Imran Hussain stood surety for Ashutosh, while AAP MLAs Naresh Balyan, Nitin Tyagi, Naresh Yadav and AAP leader Sanjeev stood sureties for Sanjay Singh, Kumar Vishwas, Dipak Bajpai and Raghav Chadha, respectively.

Before the commencement of the hearing, supporters of BJP and AAP gathered outside gate number 2 of the Patiala House Court complex and shouted slogans against each other.

The accused AAP leaders and Jaitley came to the court amid heavy security presence and entry to the court room was restricted by the police. Only the accused, those giving sureties, Jaitley and lawyers appearing in the matter along with six journalists were allowed to enter the court room.

The court had on March 9 directed Kejriwal and the five other AAP leaders to appear before it today while noting that allegations were "derogatory" and amounted to "slander and libel".

The court had observed that the allegations levelled by them against Jaitley were "not only insulting but jeeringly taunting and provocative" and had summoned all the six accused for alleged offences under section 500 (defamation) of the IPC read with section 34 (common intention) the IPC.

Jaitley had filed a criminal defamation complaint alleging that Kejriwal and these five AAP leaders had allegedly defamed him in Delhi District Cricket Association (DDCA) controversy.

The court, while summoning the accused, had referred to the statements and Facebook and Twitter posts of the accused, and said, "The statements have exposed the complainant (Jaitley) to ridicule, hatred and contempt amongst the right- thinking members of the society and lowered his reputation."

The court had noted that Jaitley, through the testimony of witnesses, has proved on record that while he was President of DDCA, "the accounts were duly audited/approved by AGM" and were submitted with the taxation authorities.

In his complaint, Jaitley had alleged that Kejriwal and others had made defamatory statements that he and his family had made pecuniary gains by associating with M/s 21st Century Media Pvt Ltd, a sports management firm.

On January 5, Jaitley had appeared in the court and said that Kejriwal and five AAP leaders had made "false and defamatory" statements. He had rejected the charge that he had siphoned off money from DDCA for his own benefit.

During recording of his statement, Jaitley had said that their statements against him and his family members lowered his dignity in the eyes of the public at large.

Jaitley, who was the DDCA President from December 1999 to December 2013, had said Kejriwal's statement that he received money when the Feroz Shah Kotla stadium was constructed during his tenure as the DDCA Chief, was false as Board of Directors had constituted a committee to supervise the work and he was not a member of this supervisory committee.

Jaitley had on December 21, 2015 filed the criminal defamation case against them and sought their prosecution for offences that entail a punishment of upto two years in jail.

London, May 14: Fugitive liquor baron Vijay Mallya on Thursday urged the Central government to accept his offer to repay 100 per cent of his loan dues and close the case against him.

While congratulating the Centre for introducing Rs 20 lakh crore relief package to boost the economy amid the coronavirus lockdown, Mallya, lamented that his repeated attempts to pay back his dues have been ignored by the Indian government.

"Congratulations to the Government for a Covid 19 relief package. They can print as much currency as they want BUT should a small contributor like me who offers 100% payback of State-owned Bank loans be constantly ignored? Please take my money unconditionally and close," he tweeted.

Earlier this month, Mallya had sought permission to appeal against a ruling ordering his extradition to India in Britain's highest court the UK Supreme Court.

The application comes two weeks after the High Court in London - the UK's second-highest court - dismissed Mallya's appeal against a lower court ruling that he be sent to India to face charges of defrauding a consortium of Indian banks of more than Rs 9,000 crores relating to the collapse of Kingfisher Airlines in 2012.

Bhopal, Mar 15: Madhya Pradesh Chief Minister Kamal Nath on Saturday sought the intervention of Home Minister Amit Shah for the "release" of 22 Congress MLAs in Karnataka, saying they had been held "captive" and were under "pressure".

In a letter to Shah, Chief Minister Nath said the BJP's demand for floor test had "no meaning" till the MLAs do not reach the state.

He said that the MLAs do not have any means of personal communication and all efforts to reach them have failed.

In the four-page letter, Nath said Governor Lalji Tandon had told him that the responsibility of security of those who will come to meet the Speaker should be with the CRPF but as the Chief Minister, it is his duty to ensure the security of all residents of the state including MLAs.

"I assure you that if these 22 MLAs are released by the Karnataka Police, then I will ensure maximum security by the state government so that they are able to convey their views without fear and take part in the proceedings of the assembly," Nath said.

He urged Shah to use his powers as Home Minister so that 22 MLAs safely reach Madhya Pradesh and discharge their responsibilities "without fear or greed" in the assembly session beginning on March 16."

Chief Minister Nath said that he had been informed that the MLAs had been deprived of all personal communication facilities.

He said that a father was not allowed to meet his son and two ministers who were accompanying the father of the legislator were "arrested" and manhandled by the Karnataka Police.

"My efforts to reach them as also of their relatives have failed which proves my apprehension that they are under captivity."

He said the videos released in the name of MLAs to "mislead" the people of the state were similar. "This proves that all these MLAs are under pressure and they are being forced to act in a particular way," he said.

Nath said that he was drawing Shah's attention to the developments in the state since March 3 which were aimed at destabalising the government.

He said three Congress MLAs, one BSP, and one independent MLA were taken to Gurugram and two ministers of his government were able to "rescue" the BSP legislator.

He said the three Congress MLAs and the independent MLA were later taken to Bengaluru by the BJP. He said a BJP MLA and a party functionary accompanied them.

"Later, 19 Congress MLAs were taken to Bengaluru in chartered planes and the arrangement was done by the BJP," he said, adding that they were accompanied by two former BJP MLAs and a former minister.

Kamal Nath said the number of MLAs in Bengaluru grew to 22 and they are all in the protection of the Karnataka Police.

He said some BJP leaders from Madhya Pradesh can be seen in pictures of the place where the MLAs were staying. "All reported expenses on these MLAs are being borne by the BJP," he said.

He said the BJP leaders had told the media about the resignation of MLAs and they had not presented themselves before the assembly Speaker.

Kamal Nath said he was concerned about the security of the MLAs and had written to the Governor earlier.

"You would agree with me that the demand for floor test has no meaning till the 22 MLAs are in captivity. This is unprecedented that the BJP is demanding floor test and several Congress MLAs have been kept outside the state,' he said.

New Delhi, Feb 29: Former RBI governor Raghuram Rajan has said slowdown in growth is due to the current government focussing more on meeting its political and social agenda rather than paying attention to the economy.

India can still reverse its slowing economic growth by paying attention to key issues, he said. "It's a sad story, I think most recently, it is politics," Rajan said in response to a question on what was stopping India's growth which remains below potential.

In an interview to Bloomberg TV, Rajan said unfortunately the current government after a massive election win has "focussed more on fulfilling its political and social agenda rather than paying attention to the economic growth".

"Unfortunately, this drift has continued a pace of slowing growth, which was precipitated initially by some actions the government took such as the demonetisation and a poorly rolled out Goods and Services Tax (GST) reform," Rajan said.

India's GDP growth hit nearly 7-year low of 4.7 per cent in the December quarter, as per official data released on Friday.

The GDP growth for the quarter is the lowest since January-March of 2012-13.

In the interview, which was telecast before the official numbers were released, Rajan said India has not paid sufficient attention to cleaning up the financial sector and unfortunately, that is leading to the slowing growth.

"These are things that they can change if attention is paid to them and appropriate actions are taken," Rajan, Professor of Finance at University of Chicago Booth School of Business, said.

On being asked about the spread of the coronavirus globally and its impact, he said there will certainly be some legacy issues in terms of business rethinking in the global supply chain.

"If it is disrupted anywhere, the entire supply chain is held ransom and companies are going to start rethinking that should we actually have these really spread out global supply chain or to bring them back closer home and how much diversification should we have. Should we have multiple production sites across the world rather than have it focussed primarily in Asia," he said.
