Delhi court orders invesitgation in Owaisi hate speech case

Hyderabad, Jan 29: Delhi's Karkardooma court on Tuesday ordered further investigation in an FIR filed against All India Majlis-e-Ittehadul Muslimeen (AIMIM) chief Asaduddin Owaisi in the alleged hate speech delivered by him in 2014.

The Court's direction came after Ajay Gautam, the main complainant filed a protest petition against the Delhi police's closure report. The complainant, in his petition, alleged that during the last three years, police never came to inquire or record a statement of him. He also claimed that police never conducted an investigation against the accused because of his high political influence.

In 2015, the Delhi police, after the court direction, had registered the FIR against Owaisi for promoting enmity among religious groups among other sections in connection with an alleged hate speech which he delivered in 2014.

The Delhi police had last year filed a closure or un-trace report in the FIR. In its closer report, the police stated that nothing could be found about the source or authenticity of the derogatory video and as a result of which it was not possible to collect any evidence against the proof warranting the filing of challan against him.

The FIR against Owaisi was registered under Indian Penal Court sections of 120B (Criminal conspiracy), 153 (A) (promoting enmity between different groups), 504 (intentional insult with intent to provoke breach of peace) in addition with sections 66A, 66F and 67 of Information Technology act.

The next hearing in the matter is likely to take place on March 26.

Speeches from all leaders are being considered as hate and scrutinized except from bharat jalawo party.   Recently hate monger ananata kumar hegde told in his speecch that hands touching hindu girls should be chopped off.    I think according to indian police or else this is not a hate speech as bjp leaders have full right of speech and leaders from non bjp parties have to control their tongue.   BJP is the ownmer of india

and they have full rights of speech, create riots, kill people, rape girls etc etc.    Most of bjp leaders are hate mongers and give hate speech on daily basis but no action is taken agaisnt them.  Whereas leaders from non bjp parties are being booked for no reason.

Washington, Feb 6: The US has expressed concern over the current situation of religious freedom in India and raised the issue with Indian officials, a senior State Department official has said.

The remarks came in the wake of widespread protests held across India against the Citizenship Amendment Act (CAA).

The senior State Department official, on condition of anonymity, said that he has met with officials in India about what is taking place in the nation and expressed concern.

"We are concerned about what's taking place in India. I have met with the Indian foreign minister. I've met with the Indian ambassador (to express my concern)," the official, who was recently in India, told reporters on Wednesday.

The US has also "expressed desire first to try to help and work through some of these issues", the official said as Secretary of State Mike Pompeo launched a 27-nation International Religious Freedom Alliance.

"To me, the initial step we try to do in most places is say what can we do to be of help you work through an issue to where there's not religious persecution. That's the first step, is just saying can we work with you on this," the official said.

India maintains that the Indian Constitution guarantees fundamental rights to all its citizens, including its minority communities.

It is widely acknowledged that India is a vibrant democracy where the Constitution provides protection of religious freedom, and where democratic governance and rule of law further promote and protect fundamental rights, a senior official of the Ministry of External Affairs has said.

According to the CAA, members of Hindu, Sikh, Buddhist, Jain, Parsi and Christian communities who have come from Pakistan, Bangladesh and Afghanistan till December 31, 2014 following religious persecution there will get Indian citizenship.

The Indian government has been emphasising that the new law will not deny any citizenship rights, but has been brought to protect the oppressed minorities of neighbouring countries and give them citizenship.

Defending the CAA, Prime Minister Narendra Modi last month said that the law is not about taking away citizenship, it is about giving citizenship.

"We must all know that any person of any religion from any country of the world who believes in India and its Constitution can apply for Indian citizenship through due process. There's no problem in that," he said.

Indore, Aug 3: In a bizarre development, the Indore Bench of the Madhya Pradesh High Court has granted bail to an accused in a sexual harassment case on the condition that he will request the victim to tie a ‘rakhi’ on him with a promise to protect her “to the best of his ability for all times to come”.

Justice Rohit Arya on July 30 also ordered the man to pay Rs 11,000 to the complainant as a “customary ritual usually offered by brothers to sisters” on Raksha Bandhan and seek her blessings while visiting her with his wife and a box of sweets. “The applicant shall also tender Rs 5,000 to the son of the complainant for purchase of clothes and sweets,” the order said.

The court directed the accused to take photographs and receipts of payment made to the victim and her son, which should be filed through his lawyer for placing on record of the case before the Registry.

The victim, a resident of Ujjain district, had alleged that her neighbour, Vikram Bagri, entered her house and sexually harassed her on April 20. The police registered a case under Sections 452 (House-trespass after preparation for hurt, assault or wrongful restraint), 354 (A) (Sexual harassment and punishment for sexual harassment), 354 (Assault or criminal force to woman with intent to outrage her modesty), 323 (Punishment for voluntarily causing hurt) and 506 (Punishment for criminal intimidation) of the Indian Penal Code.

The order said the man, in jail for more than two months, was released on bail, on furnishing a personal bond of Rs 50,000 with “one solvent surety in the like amount to the satisfaction of the trial court, on the condition that he shall remain present before the court concerned during trial,” and comply with conditions under Section 437 (3) of CrPC, along with other conditions.

New Delhi, Jun 6: With 9,887 new positive cases reported in the last 24 hours, India's COVID-19 count touched 2,36,657 on Saturday surpassing Italy's latest tally of over 2.34 lakh, taking India to the sixth spot among countries with the highest caseloads of the virus.

The Union Ministry of Health and Family Welfare (MoHFW) said that India registered a spike of 9887 new cases and 294 deaths in the past 24 hours taking the tally to 1,15,942 active cases and 6642 deaths.

Today's count was the highest single-day spike in the country, which has now overtaken Italy, according to the tally posted by the Johns Hopkins University which posted that globally the coronavirus had infected over 66.64 lakh people and claimed over 3.91 lakh lives so far.

In india, the MoHFW informed that 1,14,073 persons have been cured/discharged/migrated so far.

Maharashtra remains the worst-hit State as the total number of COVID-19 positive cases reached 80,229. While the total number of active cases in the state stands at 42,224.

In Tamil Nadu, 28,694 cases have been detected so far while Delhi has reported 26,334 coronavirus cases.
