Denotification: Apex Court orders notice to BSY, Shivakumar

New Delhi Jan 10: The Supreme Court on Tuesday issued notice to former Karnataka chief minister B S Yeddyurappa and Enery Minister D K Shivakumar in a case pertaining to denotification of land in Bengaluru.

A bench of Justices A K Sikri and Ashok Bhushan sought response from the two among others on a plea by complainant-petitioner Kabbalegowda.

The petitioner claimed the public servants abused their position for benefit of Shivakumar.

The issue relates to the denotification of 4.20 acre of land in contravention of the Karnataka (Restriction of Transfer) of Land Act, 1991. In a special leave petition, Kabbalegowda, a social worker from Ramanagaram district, has challenged the December 18, 2015, order of the High Court of Karnataka, quashing the proceedings initiated against the leaders and others. The trial court had on February 5, 2012, taken cognisance of the offences allegedly committed by the accused.

According to the complainat filed by Kabbalegowda, land measuring 5.11 acres in Bengaluru was said to have been purchased by one B K Srinivasan in 1962.

An extent of 4.20 acres was then converted from agricultural to industrial use. The land was subsequently said to have been notified for acquisition under the provisions of the Bangalore Development Authority Act.

It was alleged that Shivakumar, after assuming office as the Minister for Urban Development and with the full knowledge that the land was notified for acquisition, is said to have purchased the said land from Srinivasan, on December 18, 2003, for a sum of Rs.1.62 crore, which was in contravention of the Prevention of Corruption Act.

Subsequently, Shivakumar allegedly in 2004 converted 4.20 acres for residential purposes in collusion with officials. He was said to have entered into a joint development agreement with a firm in respect of the land. It was alleged that the accused thus used his official position as an MLA and as a leader of the Congress party to persuade the then Chief Minister Yeddyurappa to accord sanction for the withdrawal from acquisition in respect of the land on May 13, 2010.

Value grew manifold

The value of the land in question had grown manifold over the years and was then estimated at over Rs 29 crore.

SC upholds validity of Karnataka reservation law on SC, ST promotions

New Delhi, Mar 19: The Supreme Court on Thursday upheld the validity of Karnataka's 2018 reservation law, which granted reservation in promotion to employees belonging to SC and ST categories.

A bench headed by Justice DY Chandrachud holds that applications filed by a group of general category employees for applying 'post-based quota' and the principle of the creamy layer at entry-level in public employment are not maintainable.

The apex court had, in November last year, reserved its order on the applications filed by general category candidates in the matter.

In May last year, the top court had upheld the law allowing reservations in promotions for SC and ST candidates with consequential seniority.

Pro-CAA arsonists burn down house of their own pro-CAA BJP leader in Delhi. Reason: He’s a Muslim!

New Delhi, Mar 2: The bloodthirsty arsonists allegedly hired by pro-CAA politicians in the capital of India to target Muslims, did not spare even the house of a Muslim leader of BJP.

Akhtar Raza, the BJP’s minority cell vice-president for the Delhi Northeast district, is now not in a position to share his pain with anyone.

Even the police hadn’t come to his rescue, when the mob raising “Jai Sri Ram” slogans burnt down his house at Bhagirathi Vihar Nalla Road in northeast Delhi last week.

“They were chanting slogans. Around 7pm, they started throwing stones at us. I called for police help. But the police asked me to leave. We managed to flee before they burnt my house and destroyed everything,” Raza, who returned today to witness the destruction, told media persons.

“Those who attacked us were not locals. They were outsiders. They managed to identify and burn down all the 19 houses belonging to Muslims in this lane,” Raza said.

Apart from all the belongings in the house of Raza, the arsonists also have burnt down six vehicles belonging to his family.

Raza is sad that no one from BJP contacted him after the violence even though he has been serving the party and promoting its ideology for past five years. “No party leader contacted me. There was no phone call. There was no relief or special treatment or anything,” Raza said.

Interestingly, Raza is still indentifies himself as a BJP leader. “I belonged to BJP. I may continue in the party,” he said.

The locality remained tense on Sunday too. On Monday, several groups distributed relief materials among people who had queued up to collect them. In front of Raza’s house is a lane from which several bodies of innocent Muslims have been recovered.

How a Muslim and being a leader can accept ideologies of such a hat mongers.

These people with such a ideolgies can never be the friend of not Muslims and also good secular Hindus.

Ayodhya over, now Kashi and Mathura have to be liberated: K S Eshwarappa

Shivamogga, Aug 5: Karnataka Minister KS Eshwarappa on Wednesday hailed the laying of foundation stone (bhoomi pujan) for a grand Ram temple in Ayodhya and said "Kashi Vishwanath and "Krishna Janmasthan temples have to be liberated".

"It is a good day that the foundation stone for Ram Temple has been laid. A beautiful temple will come up, but there are Kashi Vishwanath and Krishna Janmasthan temples which have to be liberated," Eshwarappa said.

The minister said that there is a "sign of slavery" at Krishna temple in Mathura and Kashi Vishwanath temple in Varanasi.

"The whole nation is dreaming of Shri Krishna temple in Mathura and Kashi Vishwanath temple. I have visited the two temples.

There is a sign of slavery. Mosques are there at holy places. When I visited the place at Mathura, I witnessed the wall. When we look at the wall, we feel like we are still slaves," he said.

"While visiting Kashi, there is also a structure of slavery. Dream of Hindus is fulfilled in Ayodhya. One day, it will be fulfilled in Mathura and Kashi. Mathura Sri Krishna and Kashi Vishwanath will be freed and temple will be built," Eshwarappa added.

The Places of Worship Act, enacted in 1991, says that religious character of a place of worship existing on the August 15, 1947 shall continue to be the same as it existed on that day. The Act kept Ayodhya case out of its purview.
