Denying maternity leave for 3rd child unconstitutional: HC

Nainital, Aug 4: The Uttarakhand High Court has come to the rescue of a government servant who was denied maternity leave for her third child, terming a state government rule to this effect "unconstitutional".

Hearing a writ petition by Haldwani resident Urmila Manish, the single judge bench of Justice Rajiv Sharma said denial of maternity leave to women for their third child under the Second Proviso of Fundamental Rule 153 of Financial Handbook of the Uttar Pradesh Fundamental Rules, adopted by Uttarakhand, went against the letter and spirit of the Constitution.

The court in its July 30 order said the rule should be struck down as it went against the Article 42 of the Constitution which provides for "just and humane conditions of work and maternity relief," and also the Section 27 of the Maternity Benefit Act, 1961.

Taking a humanitarian view, it ordered that the petitioner be granted leave.

Manish was denied maternity leave on the ground that she already has two children and could not be granted the same for her third child in consonance with the Second Proviso of Fundamental Rule 153.

‘Amit Shah is lying’: TMC shoots back after Home Minister’s letter to Mamata on migrants

New Delhi, May 9: The Trinamool Congress on Saturday responded to Union home minister Amit Shah’s charge that the Mamata Banerjee-led West Bengal government is not facilitating the movement of stranded migrant workers.

Amit Shah has written to West Bengal chief minister Mamata Banerjee, saying her government is doing “injustice” to migrant workers by not allowing the special Shramik trains to reach the state.

“Union home minister Amit Shah speaks after weeks of silence only to mislead people with lies,” the TMC’s Abhishek Banerjee was quoted as saying by news agency PTI.

“The Centre is lying… West Bengal is running 711 camps for migrants in the state. We are taking good care of them,” Abhishek Banerjee, who is also the chief minister’s nephew, said.

Amit Shah had pointed out in his letter that the Centre was not receiving the “expected support” from the state government in helping stranded migrant workers from West Bengal.

“West Bengal government is not allowing trains with migrants reaching the state. This is injustice with WB migrant labourers. This will create further hardship for them,” Amit Shah had said in his letter to Mamata Banerjee.

The issue of migrant workers is the latest flashpoint between the Centre and the West Bengal government amid a row over the state’s efforts to control the coronavirus disease (Covid-19).

The Centre and the state have exchanged allegations over the criteria for reporting deaths from the infection, and while While Bengal says the Centre is trying to politicise a public health crisis, the Union government maintains that state officials are ignoring repeated warnings to step up the fight against the disease.

Federal officials have said that the region has not conducted adequate tests and that there has been mismanagement over identifying hotspots and containing them.

Union home secretary Ajay Bhalla also slammed the state government for a very low rate of testing and high rate of mortality, 13.2%, by far the highest for any state.

The Centre has also accused the state government of not allowing cross-border movement of goods trucks to Bangladesh.

There are 1,678 Covid-19 cases and 160 deaths in West Bengal until Saturday morning.

Will bury alive those who raise slogans against Modi and Yogi: UP Minister

Aligarh, Jan 14: Uttar Pradesh Minister Raghuraj Singh has courted a major controversy after he said that people who raise slogans against Prime Minster Narendra Modi and Uttar Pradesh Chief Minister Yogi Adityanath "would be buried alive".

The minister said this on Sunday while addressing a rally in Aligarh to muster support for the Citizenship Amendment Act (CAA) 2019.

"If you raise slogans against Prime Minister Narendra Modi or Chief Minister Yogi Adityanath, I will bury you alive," he threatened.

He was apparently referring to protests held by students of Aligarh Muslim University against the CAA during which they allegedly raised slogans against the Prime Minister and the chief minister.

The minister further said: "These one per cent people are opposing the CAA. They stay in India, eat up our taxes and then raise 'murdabad' slogans against the leaders. This country belongs to people of all faiths, but slogan shouting against the Prime Minister or chief minister is unacceptable."

He also launched an attack on India's first Prime Minister Jawaharlal Nehru. "What was Nehru's caste? He did not have a 'khaandan'," he claimed.

Raghuraj Singh is minister of state in the labour ministry in Uttar Pradesh.

Unfair to blame pilots or AAI for Kerala plane crash: Rajiv Pratap Rudy

New Delhi, Aug 8: Former Union Minister Rajiv Pratap Rudy on Saturday said that it is unfair and unfortunate to blame the pilots or the Airports Authority of India (AAI) for the Kerala place crash which took place on Friday evening.

"It is very unfortunate and unfair when experts come under television channel and they try to put blame on the Airports Authority of India or the pilots. Airport authority in an institution which has had survived various tests of time for the last 65 to 70 years, or pre-independence, so it is unfair to blame them," he said.

While speaking to news agency, Rajiv Pratap Rudy said that the 737 Boeing aircraft is reliable and the pilots were experienced, and it was wrong to blame them.

He further said that there are many possibilities on what could have happened, and said, "It is an accident and we need to find the facts."
Rajiv Pratap Rudy also expressed his deepest condolences to the family members of those who lost their lives in the plane crash. "This accident is terrible and heart-rending.

I offer my deepest condolences to the family members of the captain and first officer, and the families of passengers who died and were injured," he said.

At least 18 people died when a plane carrying 190 passengers came from Dubai met with an accident at Karipur airport in Kozhikode on Friday evening, as per the Directorate General of Civil Aviation (DGCA).

"Eighteen people, including two pilots, have lost their lives. It is unfortunate. 127 people are at hospitals, others have been released," said Puri on the Air India Express flight that crash-landed on Friday evening.

Air India Express Dubai-Kozhikode IX-1344 flight, carrying 190 people on board from Dubai under the Vande Bharat Mission, skidded off the runway at Karipur Airport in Kozhikode at 7.41 pm on Friday in which several people sustained injuries.
