DK Shivakumar files Rs 204 crore defamation case against BJP MLA Yatnal

Bengaluru, Aug 4: Irked by "false and baseless allegations" by former Union Minister and BJP leader Basanagouda Patil Yatnal, Congress leader DK Shivakumar has filed a defamation suit of Rs. 204 crore.

Shivakumar has already paid a court fee of Rs 1,04,08,000.

Following the defamation suit filed by Shivakumar at his home town Kanakapura, the Judge at Senior Civil Judge and JMFC court admitted the case and issued summon to Yatnal.

The case will be taken up for hearing on September 18.

Yatnal, while speaking to media persons at Vijayapura, issued a "damaging, image tarnishing and baseless statements against Shivakumar on June 23, he has been exerting pressure on national level BJP leaders and union BJP ministers to ensure that he is free from cases that are being probed by the Income Tax (IT) department and Enforcement Directorate (ED)," the defamation petition filed by Shivakumar stated.

The petition further mentioned that Vijayapura said Shivakumar has "promised to remain neutral and not becoming a stumbling block in the formation of BJP government in Karnataka."

"These statements have been beamed in electronic and print media too. These are baseless, false, irresponsible and irrelevant statements made by Yatnal. These remarks are passed with malafide intention to malign and to tarnish my public image. This has put a huge question mark on my loyalty, sincerity, integrity and image at party and public level," the petitioner stated.

The Congress leader claimed, "The false and baseless statements mislead the investigating agencies and mislead the probe. Further, it is damaging to an extent that I am looked at with suspicion by Kanakapura Assembly constituency voters, Congress leaders, workers, and citizens of India in general and Karnataka in particular. It gives an impression that I am sacrificing the trust of people, leaders and voters for my personal and political gains. I have played a pivotal role in bringing Congress - JD(S) government to power."

"With these baseless statements, I am branded as a person instrumental in destabilising and dethroning the coalition government. This has caused major damage to my reputation, image and my loyalty towards the party," Shivakumar stated in the petition.

The petition also said these "irresponsible statements that I (Shivakumar) support to destabilise the coalition government are aimed at with devious intention to impede my political prosperity and growth and to put my image at stake in the eyes of leaders of Congress at the state level and Central level apart from coalition leaders."

Shivakumar went on to mention in the petition that during his stint as Water Resources Minister, he undertook several official visits to Delhi.

"These visits and meetings between June 12 and 19 were scheduled with a host of Union ministers to discuss conservation of water and drinking water projects. Water sharing issues and project implementation relating to Mahadayi, Mekedatu were discussed at length. It was my primary concern and duty too as a water resources minister to resolve the issues in the larger interest of public. My official visits with large public interest have been misinterpreted by Yatnal to put me in bad light in the eyes of leaders, public, voters and central leadership. This has caused mental agony and distressed me," he stated.

In the light of "damage and distress" caused, Shivakumar said he approached the court, claiming damage of Rs 204 crore from Yatnal for his "irresponsible statements." Further, he sought permanent restrain from Yatnal about the "slanderous and maligning statement."

Udupi, Mar 25: A 34-year-old man who returned from Dubai tested positive for novel coronavirus in Udupi district. This is the first case in the district. 

He returned from Dubai on March 18 and got admitted to a government hospital in Udupi on March 23 for fever. The swab samples were sent to Shivamogga laboratory for testing.

The report which arrived on Wednesday confirmed that he was positive for COVID-19, said DHO Dr Sudhir Chandra Sooda.

Bengaluru, Feb 7: The Bruhat Bengaluru Mahanagara Palike (BBMP) ordered the destruction of a tilted building in the city after evacuating about 150 people from 35 families in the vicinity, an official said on Thursday.

"The top portion of the building has been destroyed 70 per cent today (Thursday). Later, the destruction contractor will allow machines to be used," Bruhat Bengaluru Mahanagara Palike (BBMP) Yelahanka joint commissioner Ashok said.

Located on Vinayaknagar Street in Hebbal's Kempapura, the five-storey building being used as a hostel for boys got tilted on Wednesday morning, spreading panic in the neighbourhood.

Though the tilted building owned by one Rahul, a jeweller, was a sound structure, Ashok said a neighbour, Babu, hired a JCB excavator to dig deep beside the affected structure to build his own structure.

"Babu not only dug very deep but also damaged the foundation pillar of the tilted building, weakening the structure and leading to its slant," said Ashok.

Babu has been booked and arrested even as the police are on the look-out for the JCB owner and operator.

The titled building erected five floors unauthorisedly and falls into the B Khata category. It was constructed without the civic body's plan, said Ashok. 

A Khata and B Khata denote the two types of khatas that exist under BBMP. Khata is a document which shows a property owner having an account with the municipality to pay taxes. An A Khata denotes that the building owner has paid relevant property taxes and that the building conforms to building bylaws and government rules. A B Khata denotes that the building is in violation of government regulations regarding properties in Bengaluru, even when the civic charges for the property have been cleared by the owner.

"As per procedure, we issue notice, but such constructions are rampant in the city. Under the BBMP jurisdiction, there are 15 lakh B Khata structures," said Ashok.

For all B Khata sites, the civic body does not give any plan and there is no proper control on them, he said.

Ashok said the case to regularise the B Khata buildings to A Khata buildings is currently pending in the Supreme Court.

Luckily, no injury or loss of life has been reported from the tilted building.

The civic body arranged alternative accommodation for the affected families, but most of them chose to stay with their relatives, said Ashok.

Udupi, Jan 25: The accused, who planted a crude bomb at the Mangalore International Airport on January 20, was brought to Udupi on Saturday, to collect information, as part of the spot investigation, police said here.

According to police officials, accused Aditya Rao was brought to Karnataka Bank Kadiyali branch, where Rao had a Safe Locker. The team opened the locker and seized the documents, along with a Box.

They said the seized documents, along with the Box, will be sent to the FSL for investigation.
