ED files prosecution complaint against Dr Zakir Naik, attaches properties worth Rs 50-cr

New Delhi, May 2: The ED today filed its first direct charge sheet against doctor-cum-interfaith scholar Zakir Naik on charges of laundering criminal money to the tune of Rs 193 crore and allegedly creating illegal real estate assets worth crores in India and abroad, officials said.

The agency filed the prosecution complaint under the Prevention of Money Laundering Act (PMLA) before a special court in Mumbai and said Dr Naik's "inflammatory speeches and lectures have inspired and incited a number of Muslim youths in India to commit unlawful activities and terrorist acts."

"His thoughts created disharmony amongst various faiths and created hatred amongst people following different faiths," it said.

This is the second charge sheet in the case by the Enforcement Directorate (ED), but the first against Dr Naik that specifically underlines his role.

The agency claimed its probe revealed that "most of the incriminating speeches of Naik were delivered during the 10-day Peace Conference organised by the Islamic Research Foundation (IRF) in Mumbai during the period between 2007-2011." The IRF is owned and promoted by Dr Naik.

"The said conference was planned, organised, funded and promoted by the IRF and people of other religions were openly converted into Islam by Dr Naik," it charged.

The ED said a total amount of Rs 193.06 crore has been identified as proceeds of crime. 

In the past, the agency has attached Dr Naik's properties, investments made in mutual funds, Islamic International School in Chennai, 10 flats, three godowns, two buildings and land in Pune and Mumbai, and 10 bank accounts.

It said Dr Naik also "made investments in Dubai where he is developing high-end bungalows." The ED is expected to attach these overseas assets in the coming days, a senior official said.

The agency alleged in the chargesheet that the money trail probe against Dr Naik and his associates found that "IRF received an amount of Rs 64.86 crore, between 2003-04 to 2016-17, mostly from dubious or suspicious sources and majority of the funds were utilised for organising Peace conferences."

"It was during Peace conferences that provocative speeches were made and religious conversion to Islam was also propagated/conducted," the ED alleged.

It added Dr Naik transferred funds from abroad to India and purchased properties in Pune and Mumbai by "layering of funds" and in the name of his close relatives. "Investigation has also revealed that Dr Naik was also involved in suspicious unaccounted cash transactions," it said.

The central probe agency, till now, has arrested two of Dr Naik's aides Amir Gazdar and Najamuddin Sathak. Naik himself is absconding from probe and at present, is stated to be in Malaysia.

Dr Naik was booked by the ED in 2016 based on a National Investigation Agency (NIA) FIR that was registered under the Unlawful Activities Prevention Act (UAPA).

The NIA in the past has said the Islamic preacher "deliberately and maliciously insulted the religious beliefs of Hindus, Christians and non-Wahabi Muslims, particularly Shias, Sufis and the Barelwis, with the intention of outraging their religious feelings."

It had said Dr Naik's organisation, IRF and Ms Harmony Media "have been instrumental in the maximum circulation of such incriminating speeches."

Bengaluru, Jan 12: Chief Justice of India, Sharad Arvind Bobde on Saturday hinted at the possibility of Artificial Intelligence being developed for the court system while making it clear that it will never replace human discretion.

Speaking at an event here, Bobde said, "We have a possibility of developing Artificial Intelligence for the court system. Only for the purpose of ensuring that the undue delay in justice is prevented."

"I must make it clear at the outset as there are times when even judges have asked this. AI is not going to replace human judges or human discretion", he added.

Sharing more details of his vision, he stated, "It is only the repetitive, mathematical and mechanical parts of the judgments for which help can be taken from the system...we are exploring the possibility of implementing it."

Bobde stressed on the requirement of developing AI for judiciary while outlining the number of pending cases in different courts.

"Some people are in jail for 10-15 years and we are not in position to deal with their appeals. The high court's and Supreme Court take so long and ultimately the courts feel that it is just to release them on bail", he said.

Bobde also endorsed employing every talent and skill to ensure delivery of justice in a reasonable time.

"We must employ every talent, every skill we possess to ensure that justice is received within reasonable time. Delay in justice can't be a reason for anybody to take law into their hands. But it's very important for us as courts to ensure there's no undue delay in justice", he said.

CJI Bobde also highlighted the need for pre-litigation mediation and said, "Pre-litigation mediation is the need of the hour especially in the backdrop of a significant pendency that the courts are tackling with. There are innumerable areas where pre-litigation mediation could solve the problem."

He also stressed that the position of a judge is very unique under the constitution and they have to deal with a variety of problems.

"The foundation of civilisation rests on the law. Judicial officers have to deal with a variety of problems...Judges without adequate knowledge, skills and experience may cause distortion, delay and miscarriage of justice", he said.

Earlier in the day, Chief Justice of India Bobde inaugurated the phase-1 of the new building of the Karnataka Judicial Academy on Crescent Road in Bengaluru.

The new building has three floors, besides, the ground floor and two basement floors.

Bengaluru, Apr 20: A ruckus erupted in Padarayanapura on Sunday allegedly over shifting of suspected COVID-19 persons to quarantine facility by the Bruhat Bengaluru Mahanagara Palike (BBMP) officials.

The incident occurred in the late evening at Padarayanapura which is recognized as a 'Red Zone' when BBMP officials went to bring 15 secondary contacts of corona positive patients.

However, some people and youth created ruckus and broke the barricade and removed police post which was stalled in the area.

Soon after receiving the information, Bengaluru South Deputy Commissioner of Police reached the spot and brought the situation under control.

"Lockdown continues, please remain indoors.Tomorrow will be as it was till today. We Understand your situation and appreciate your cooperation," tweeted Commissioner of Police, Bengaluru City, Bhaskar Rao.

In Karnataka, 384 people have detected positive for COVID-19, of which 14 people have succumbed to the infection, as per the Union Health Ministry.

Mumbai, June 9: A 45-year-old doctor posted in the 108 ambulance service at Malad railway station in Mumbai died of COVID-19 after two hospitals refused admission, in spite of the fact that he was a frontline warrior against coronavirus.

The victim is Dr Shaukat Ali, who was working with the 108 ambulance service for the last four years. A few days ago, he got his blood tests done after his health deteriorated. The result stated typhoid fever following which he started getting treatment at home in Malwani.

Ali's family ran from pillar to post to get him hospitalised in either a private or government hospital, to no avail.

"On Friday, his condition worsened and he started feeling breathless. Despite us calling the 108 ambulance service, no one picked up the call. So after waiting for a while, I and uncle's colleague, Dr Nigam, rushed him to SK Patil hospital in Malad East in an auto. But they refused us stating they were admitting only COVID-19 patients.”

“Then we took him to Desai Hospital, where doctors were initially ready to admit him but later refused stating lack of beds. They said we could take him home as his condition was fine," Zubair Shaikh, Ali's nephew said.

"But his condition worsened. So, I called Dr Nigam and we managed to admit him in Shatabdi hospital. On Sunday, when his results came out stating that he had COVID-19, doctors had already put him on a ventilator, where he passed away in the evening," he added.

Zubair further said, "Had the doctors at Desai Memorial Hospital admitted him, my uncle would have been alive today. It is a matter of great regret that a doctor, who was risking his life during this pandemic, could not get help from his own government hospitals."

Ali's wife and his two children's are in UP, while he was staying with his elder daughter who had recently appeared for HSC exams and preparing for NEET.

My condolence to him and his family. Please don't divide Hindu and Muslims in such way, not only Muslims but Hindu also died due to such reasons and one more thing here in Maharashtra, BJP is not ruling party. Thanks..

this is indian not italy and now current ruling government is very very bad...they want indian to be slave.
also today you help your hindu brother but tommorow they will vote for same people BJP who is giving touble to muslim..GOD given chance to develop muslim community not our enemy,
india is divided alreday, my 20 year old hindu friend become my enemy now after NRC and CAA..
we will see where it will end. may the justice and peace prevail.
