Election Commission can now inquire into paid news allegations

New Delhi, May 5: The Supreme Court Monday said that the Election Commission was empowered to inquire into the allegation of paid news if the expenses for the same are not being reflected in the election return filed by the candidate.supreme_court

The apex court bench of Justice Surinder Singh Nijjar and Justice Fakkir Mohamed Ibrahim Kalifulla said this while dismissing a plea by former Maharashtra chief minister Ashok Chavan.

Having held that EC can inquire into the allegation, the court dismissed the plea by Chavan who had challenged the Delhi High Court order, holding that the commission can inquire into the allegations of paid news if same was not disclosed by the candidate in his election expanses returns.

The court said that EC will hold day to day hearing and decide the complaint in 45 days.

Chavan, in 2009 assembly election had won from Bhokar assembly seat in Nanded, by a margin of 1.25 lakh votes. His opponent, independent candidate Madhav Kinhalkar, filed a complaint with EC, accusing him of hiding expenses on a 'paid' supplement titled 'Ashok Parva' (The era of Ashok) in a leading Marathi daily.

Chavan and the daily's management denied the allegation saying that the supplement was not a paid one.

EC probed into Kinhalkar's allegations. Delhi High Court in 2010 declined Chavan's plea seeking the stay of the Election Commission proceedings. He then moved the apex court in November 2011.

New Delhi, Feb 11: Votes between Hindus and Muslims were ''completely polarised'', said Congress party's Alka Lamba, as she trailed at Chandni Chowk assembly seat on Tuesday.

"I accept the result, but don't give up. Hindu-Muslim votes were completely polarised. The #Congress Party will now have to prepare for a new fight with new faces and a long struggle for the people of #Delhi. If you fight today, you will also win tomorrow," Ms. Lamba tweeted in Hindi.

As per the Election Commission (EC) website, Ms. Lamba is in third position with just 1,229 votes so far. AAP's Parlad Singh Sawhney is ahead with 23,281 votes followed by Suman Kumar Gupta of BJP.

Ms. Lamba, who had won from Chandni Chowk on an AAP ticket in the 2015 polls, was expelled from AAP last year after she joined Congress, citing differences with Delhi Chief Minister Arvind Kejriwal.

As per the EC official trends, AAP is maintaining a strong lead on 58 seats, while the BJP is far behind at 12. Congress has failed to open its account so far.

The counting of votes for 70 seats of the Delhi Assembly began at 8 am today amid tight security.

Delhi went to polls in a single-phase on February 8. AAP, BJP, Congress are the main political parties in the fray.

New Delhi, Feb 11: As the counting of votes for the Delhi Assembly polls began, Congress leader Digvijaya Singh on Tuesday raised doubts on EVMs, alleging that no machine having a chip is tamper-proof.

He called upon the Election Commission and the Supreme Court to take a fresh look at the use of EVMs in the country.

"No machine (which) has a chip is tamper-proof. Also please do for a moment think, why no developed country uses EVM," Singh said in a tweet.

"Would CEC and Hon Supreme Court please have a fresh look on EVM voting in India? We are the largest democracy in the world, we can't allow some unscrupulous people to hack results and steal the mandate of 1.3 billion people.

"If they match the votes in the counting unit. Declare the result. If they don't match then count the ballots of all polling booths in the assembly. It would convince everyone and save time also as this has been the consistent argument of CEC in favour of EVM," the Congress leader said.

Polling for the 70-member Delhi Assembly polls was held on Saturday.

The Election Commission on Sunday announced that the final voter turnout was 62.59 per cent, five per cent less than 2015.

New Delhi, July 1: In a terrific incident with chilling echoes of the 2015 Dadri mob lynching, a Muslim man, who was carrying meat, was savagely attacked by a mob belonging to a saffron outfit in the presence of in BJP ruled Haryana on the eve of Eid al-Adha. 

The incident occurred at around 9 a.m. on Friday, July 31 at Badshahpur village in Haryana’s Gurgaon, when Lukman was transporting meat in a pic-kup truck. 

The attack was captured on mobile phones by onlookers and the video clips of the incident are now spreading on social media. 

A group of saffronite cow vigilantes chased the truck for about 8 km managed waylay it. Lukman, who was driving the truck was pulled out and brutally assaulted on the suspicion that he was transporting cow meat.

Just like Dadri, the police were faster at sending the meat to a lab for testing than catching any one of the suspects. One of the assailants - Pradeep Yadav- has been arrested. 

After being beating to an inch of his life, Lukman was bundled into the pick-up truck and taken back to Gurgaon's Badshahpur village where the goons started thrashing him again.

This is when the police stepped in and stopped them - only to find the assailants fearless enough to even take on them.

Lukman was taken to a hospital and the police filed a case against "unidentified individuals" even though the video of the incident recorded by witnesses shows the faces of the assailants.

The owner of the vehicles said that the meat was buffalo and he has been in the business for 50 years.

The police have so far refused to give a statement on record on the incident and explain their inaction as seen on video.
