Allahabad, Apr 25: The Allahabad high court on Wednesday granted bail to Dr Kafeel Khan, who had been booked in connection with the death of children due to lack of oxygen at the Gorakhpur BRD Medical College last August.

Earlier, Dr Kafeel Khan - who has been in jail in the BRD Medical College case involving death of 63 children due to disruption in oxygen supply - had been brought to Gorakhpur district hospital for medical checkup under strict security on April 19.

Dr Khan was brought to the hospital two days after his wife had alleged that her jailed husband was being denied medical care.

The district hospital's cardiologist Dr K K Shahi had tested his blood pressure, carried out other tests and advised him to undergo complete lipid profile test to ascertain risks of heart ailments.

'Being framed'

After the tests, the police tried to take him away without any media interaction but on the way from cardiology department to the police vehicle, he told reporters present there that he was being framed.

"It is complete administrative failure and I have been framed. When the budget was not released from higher level, where from the payment could have been made (for oxygen cylinders)?" he asked.

Asked if the jail administration was providing medicines to him, he replied in the affirmative.

"Yes, they are giving (medicines)," he said.

Soon after, the police bundled him into the vehicle and drove away.

He is being denied medical care: Wife

Dr Khan's wife Dr Shabistan Khan on Tuesday had alleged at a press conference at her home that her husband and other doctors were being denied medical care in jail.

The district prison authorities, however, had rejected the charges.

In her press conference, Dr Shabistan had apprehended that the doctors lodged in the prison might be "killed."

She said her husband suffered a heart stroke on March 29 but was not given proper treatment.

"Former BRD Medical College principal, Dr Rajiv Mishra, is suffering from liver disease and diabetes but he is also not getting proper medical attention," she had claimed.

She had also said another accused, Dr Purnima Shukla, who is suffering from a hairline fracture, was also not getting the requisite medical attention.

Dr Kafeel is among the nine accused in the BRD Medical College and Hospital case involving death of 63 children, including infants, in August 2017 due to disruption in supply of oxygen owing to non-payment of dues to the vendor.

The state-run medical college is the single largest government-aided facility in Gorakhpur which also attends to the patients from nearby areas like Maharajganj, Deoria, Kushinagar, Basti, Siddharthnagar, Sant Kabirnagar, Ballia, certain areas of Bihar like Gopalganj and Siwan, besides border areas in neighboring Nepal.

Aligarh, Feb 11: Paediatrician Dr Kafeel Khan, who was arrested from Mumbai on January 29 after he delivered a speech at Aligarh Muslim University (AMU) against communalism and politics of hate, will be released from jail on Tuesday after he was granted bail by an Aligarh court.

Khan will be released from Mathura jail on Tuesday after legal formalities are completed.

Chief judicial magistrate Karuna Singh granted bail to Khan on Monday on a bail bond of Rs 60,000. Two surety bonds of Rs 60,000 each would also be furnished by the guarantors.

Dr Khan's lawyer, Mohammad Irfan Gazi, told reporters, "The court was told that Khan was falsely implicated by police under political pressure. After hearing the arguments, the court granted him bail."

The suspended doctor was arrested by special task force (STF) of the UP police from Mumbai on January 29, when he reached the city to attend a protest against the Citizenship (Amendment) Act.

He was arrested in connection with a case registered against him in Aligarh under section 153-A (promoting enmity between different groups on ground of religion) of the Indian Penal Code at Civil Lines police station on December 13

The case was filed after his speech at Aligarh Muslim University (AMU).

According to the FIR, while addressing students, without naming anyone, Dr Kafeel Khan said that 'Mota Bhai' is teaching everyone to become Hindu or Muslim but not a human being. "This is a fight for our existence. We have to fight."

The FIR also said that Dr Kafeel Khan made an attempt to vitiate the peaceful atmosphere and disturb the communal harmony with his speech.

Dr Khan was in the news in 2017 when he was named as one of the nine accused in a case involving deaths of several children due to alleged disruption in supply of oxygen at the BRD Medical College in Gorakhpur. Though he was granted clean chit in a departmental inquiry, his suspension has not yet been revoked.

New Delhi, Feb 28: The Congress on Friday reacted sharply to the petition in the court seeking registration of a First Information Report against Sonia Gandhi, Rahul Gandhi and Priyanka Gandhi Vadra for alleged hate speeches. It said the petition was to save BJP leaders Pravesh Verma, Anurag Thakur and Kapil Mishra, referring to the trio as "PAK".

Congress leader Jaiveer Shergil told news agency, "It is political interest litigation to hide the failure of the government and to put a lid on the BJP's involvement in fuelling the fire in Delhi riots.

"This is to hide and save BJP's PAK -- Pravesh, Anurag and Kapil," said Shergil.

The BJP has two parameters, the laws for the common man and citizens of the country are different from those for the BJP leaders, added Mr Shergil.

The Delhi High Court on Friday issued notices on a petition for the registration of an FIR against Sonia Gandhi, Rahul Gandhi, Priyanka Gandhi Vadra and others on charges of delivering hate speeches.

Congress said that the PIL was politically motivated and the inaction on the hate speeches made by the BJP leaders, which led to the riots, was shocking.

"When there are 48 cases registered, why three cases against the BJP leaders are not registered," asked Mr Shergil.

A Bench of Chief Justice DN Patel sought responses from the Central and Delhi governments apart from Delhi Police on a petition filed by Lawyers Voice. The matter will again be heard on April 13.

The petition also sought a case against Aam Aadmi Party leaders Manish Sisodia and Amanatullah Khan, All India Majlis-e-Ittehadul Muslimeen leaders Akbaruddin Owaisi and Waris Pathan, and lawyer Mehmood Paracha.

"Issue directions to constitute an SIT to look into these hate speeches and take appropriate action. Issue direction to register an FIR against those named in the petition," the petition said.
