Govt drops UPA attempt to challenge fiat on Vodafone

New Delhi, Jan 29: In a clear signal to global investors that India has moved to a fair and transparent tax regime, the government on Wednesday revoked the former United Progressive Alliance (UPA) government’s decision to challenge in the Supreme Court a Bombay High Court ruling in favour of Vodafone.

The decision not only gave the world’s second largest telecom firm a relief of Rs 3,200 crore in a tax dispute case with the government, but also sought to harbour hopes among 20 such multi-national companies facing similar disputes in India.

The Cabinet decision came just two days after Prime Minister Narendra Modi in the presence of US President Barack Obama assured the world investment community that India was moving fast on removing all ambiguities in its tax regime.

“This fruitless litigation could have been avoided by the previous government. We are only correcting the legacies of the past,” Telecom Minister Ravi Shankar Prasad told reporters after the Cabinet meeting.

In a 2010 case, the Income Tax (I-T) department had asked Vodafone to pay additional tax of Rs 3,200 crore stating that the telecom firm had undervalued its shares in its Pune BPO, Vodafone India Services, while transferring them to the parent company in Britain.

The tax authorities later issued a show cause notice against the company in January 2014 and passed an order asking it to pay the tax.

Vodafone then moved the Bombay High Court against the I-T department decision. The court said in its order in October 2014 that the UK-based telecom firm was not liable to pay income tax demanded in the case relating to transfer pricing.

Vodafone, the largest corporate investor in India, is facing several other tax disputes in the country.

“Investors’ confidence has been shaken in the past because of the very fluctuating tax policy. The government wants to convey a clear message to investors world over that this is a government where the decisions will be fair, transparent and within the four corners of the law,” the telecom minister said.

Reacting to the decision, Vodafone’s counsel said: “The government’s change of heart is a good massage to global investors”. But he maintained that the people were actually waiting to see a change on the ground and a change in the “mind set” of the tax department.

After talking to hundreds of CEOs at the India-US Business Summit two days ago, Finance Minister Arun Jaitley had said that he and the prime minister took pains to explain it to investors that India was seriously working on a investor-friendly tax administration.

New Delhi, Jan 28: Kolkata Metro Rail Corp expects to complete its East-West project, which runs partly under the city’s iconic Hooghly river, by March 2022 after a delay of several years doubled costs.

The authority is awaiting a final installment of Rs 20 crore ($2.8 million) over the next two years from the Indian Railway Board, said Manas Sarkar, managing director at KMRC. A soft loan of Rs 4,160 crore from Japan International Cooperation Agency helps fund 48.5% of the project.

India’s oldest metro, which started in 1984 with a North-South service, was due to expand by 2014 but faced problems including squatters on the planned route. These issues have contributed to the total project cost rising to about Rs 8,600 crore for some 17 kilometers from Rs 4,900 crore for 14 km.

“About 40% of total transport demand will be tackled by these two metro services,” Sarkar said in an interview at his office in Kolkata. “It will be a relief for environmental pollution and the city should be much more decongested.”

The new line is expected to carry about 900,000 people daily, -- roughly 20% of the city’s population -- and will take less than a minute to cross a 520-meter underwater tunnel. Depending on the time of day, it takes some 20 minutes to use the ferry and anywhere upward of an hour to cross the Howrah bridge.

KMRC will repay the JICA loan over 30 years after an initial six-year moratorium. The interest rate is between 1.2% to 1.6%. The East-West metro project is 74% owned by the railway ministry and 26% by the ministry of housing and urban affairs.

“We don’t anticipate any further cost escalation now,” Sarkar said.

Kochi, Jan 11: Two of the four illegal apartment complexes were brought down by controlled implosion here on Saturday.

However, the other two apartments-- Golden Kayaloram and Jain Coral-- will be demolished on Sunday.

The demolition of the first building Holy Faith H2O, slated to be carried out at 11 am, was delayed by 18 minutes while the twin towers of Alfa Serene, which is surrounded by 36 houses, were brought down at 11.43 am.

As per authorities, as many as 343 kgs of explosives were used for the demolition of twin towers of Alfa Serene, which had 80 apartments and 16 floors each.

Section 144 has been imposed within a 200-metre radius of the complexes on Saturday and Sunday. Moreover, traffic has been halted on land, water and air in the evacuation zone during the process.

There are concerns that some concrete pieces of the second tower of the building may have fallen into the lake nearby. It is yet to be estimated if the debris or concrete pieces have affected the buildings nearby.

The four apartment complexes in Maradu were ordered to be demolished by the Supreme Court for violating the Coastal Regulation Zone (CRZ) norms.

Jaipur, July 13: Amid deepening political crisis in Rajasthan, a crucial meeting of the Congress Legislature Party (CLP) will be held at the chief minister's residence here on Monday.  

The Congress has issued a whip to all party legislators mandating their presence during the meeting which will be convened at 10.30 am by Chief Minister Ashok Gehlot.

Deputy Chief Minister Sachin Pilot has made it clear that he is not going to attend the meeting.

In a statement issued on Sunday night, Pilot had claimed that the Ashok Gehlot government was in minority and more than 30 Congress and some independent legislators have pledged support to him.  

By doing so, he has openly displayed rebellion against the leadership of Gehlot.

However, All India Congress Committee (AICC) general secretary Avinash Pande has said that 109 MLAs have expressed confidence in the Ashok Gehlot-led Congress government in the state and have signed a letter in support.

Pande said a whip had been issued asking all the MLAs to attend the CLP meeting and that action will be taken against those who skip it.

In the 200-member Rajasthan Assembly, the Congress has 107 MLAs and the BJP 72.

The Congress has the support of 10 out of 13 independents, and other party MLAs like Rashtriya Lok Dal (1), which is its ally. The Congress also considers Bhartiya Tribal Party (2) and CPI(M) (2) MLAs as their supporters.

BJP ally Rashtriya Loktantrik Party (RLP) has three MLAs in the assembly.
