H-1B cap reached, majority of applications by Indian companies

Washington, Apr 8: The US government is believed to have received about 250,000 petitions for H-1B visas –- the most sought after American work visas -– with a majority of them being from either Indian companies or having huge footprint in India.

passportThe US Citizenship and Immigration Services yesterday said it has reached the Congressional mandated cap for H-1B visas in the general category and also the 20,000 for those who completed higher education from inside the US in STEM (science, technology, engineering and mathematics) subjects.

USCIS did not give the number of H-1B petitions it received since April 1, when it started accepting applications for this most coveted visa for the fiscal year 2017 beginning October 1, this year. But, it says the successful petitions would be determined by a computerised draw of lots.

"We had 230,000 H-1B visa petitions last year. I think, this year it is going to be higher. We think 250,000 H-1B petitions were filed this year," Bill Stock, incoming president of American Immigration Lawyers Association (AILA) and a founding partner of Klasko Immigration Law Partners told media in an interview.

Stock's estimates are based on his experience and interaction with lawyers and those groups who mostly file H-1B visas. This is fourth consecutive year that the Congressional mandated cap has been reached in the first five days of the filing. "Unless the economy changes again, we would continue to see it," he said.

Majority of these estimated 250,000 H-1B visa applications are "certainly" either by companies that have Indian owner like TCS or companies that have substantial operations or development centres in India like IBM, Stock said in response to a question.

The recent increase on certain category of H-1B visas, he said, "may have had a little impact" on Indian companies. "But I think their business so much depends on H-1B and being able to send people on projects, they (Indian companies) are going to pay fees on those petitions," Stock said.

President of the American Immigration Lawyers Association (AILA) Victor Nieblas Pradis said the "avalanche" of petitions for H-1B visas mean that USCIS will once again randomly determine which of those petitions will actually be considered for one of the 85,000 available visas.

Each petition not selected is a business need unfulfilled and a growth opportunity that is delayed or thwarted. "However, artificial limits established more than a generation ago are again hobbling the economic potential of this great nation," Pradis said, calling for lifting this visa cap.

"Why do we continue to artificially limit this program? In a reasonable system, market demand should factor into how many business visas are granted, and indeed, demand for H-1B visas slowed when the economy took a downturn. But each year that we cap these visas when demand outweighs supply, all we're doing is creating obstacles to economic growth. We're losing out on shared prosperity for no good reason," he said in a statement.

The US is one of the most important economies in the world, but its full potential is going unrealised, he said.

"We live in a wireless world, but our visa system is a relic from the days of the dial-up modem. It's long past time for Congress to lead on this issue and reform the H-1B program in a way that addresses the needs of American businesses, US workers and our economy. Congress must bring our immigration system out of the last century and into this one," Pradis said.

New Delhi, Mar 22: The total number of novel coronavirus cases in India rose to 341 on Sunday after fresh cases were reported from various parts of the country, the Union Health Ministry said.

The total includes 41 foreign nationals and five deaths, the latest being reported from Maharashtra, taking the death toll in the state to two.

Delhi, Karnataka and Punjab have reported one death each so far. Twenty-four others have been cured/discharged/migrated.

The figure of 341 cases include 63 cases in Maharashtra, which has reported the highest number of COVID-19 cases, including three foreigners.

Kerala has reported 52 cases, including seven foreign nationals.

Delhi has reported 27 positive cases, including a foreigner, while Uttar Pradesh has recorded 25 cases, including a foreigner.

Telangana has reported 21 cases, including 11 foreigners. Rajasthan has reported 24 cases, including two foreigners.

In Haryana, there are 17 cases, which include 14 foreigners.

Karnataka has 20 coronavirus patients. Punjab and Ladakh have 13 cases each. Gujarat has 14 cases while Tamil Nadu has 6 cases, which includes 2 foreigners. Chandigarh has five cases.

Madhya Pradesh, Jammu and Kashmir, and West Bengal reported four cases each. Andhra Pradesh and Uttarakhand have reported three cases each. Odisha and Himachal Pradesh reported 2 cases each.

Puducherry and Chhattisgarh have reported one case each.

Jan 18: Days after the arrest of Deputy SP Davinder Singh along with two Hizbul Mujahideen terrorists, Shiv Sena on Saturday questioned the role of police in the Kashmir Valley.

"Cross border infiltration is ongoing in Kashmir. But the police machinery is being used to help the terrorists in Kashmir to safely cross the border (to Pakistan) and a President's medal awarded Deputy SP was arrested for doing so. In Kashmir (it seems), the government is using the police for some other purposes, what will the country's Home Ministry say if somebody has a doubt in connection with the Pulwama attacks," Sena mouthpiece, Saamna, read.

This was in reference to the incident in which Jammu and Kashmir police intercepted a vehicle on Sunday and arrested DySP Davinder Singh along with two top Hizbul Mujahideen terrorists, who were travelling together.

The Sena mouthpiece asserted that the impact and acceptance of the Centre removing Article 370 should be visible "through the people" during the upcoming Republic Day celebrations.

"Jammu and Kashmir is now a Union Territory. It is being ruled by the Centre through President's Rule. The government had removed Article 370 in a historic decision...The joy and excitement in the people over the removal of 370 should be visible in the Republic Day celebrations this time. The tricolour should be seen flying over all houses in Kashmir, it is the least that can be expected," it added.

The Sena mouthpiece further said that with the arrest of terrorists in the recent days, it hoped that "Republic Day will be celebrated safely in Delhi, Jammu and Kashmir".

New Delhi, Feb 4: Leader of Congress in Lok Sabha, Adhir Ranjan Chowdhury, on Tuesday attacked the BJP over Anantkumar Hegde's controversial remark on Mahatma Gandhi and termed the party as "Ravan ke aulad" (children of Ravana). "Aaj ye Mahatma Gandhi ko gaali dete hain. Ye Ravan ke aulad hain. Ram ke pujari ka ye apmaan kar rahe hain (Today, they abuse Mahatma Gandhi. They are children of Ravan. They are insulting Lord Ram's devotee)," Chowdhury said.

Later, BJP lawmakers object to Chowdhury's statement. Hegde, who is a Lok Sabha MP from Uttara Kannada, had on Saturday said that the freedom struggle led by Mahatma Gandhi was a "drama".

"None of these so-called leaders were beaten up by the cops even once. Their independence movement was one big drama. It was staged by these leaders with the approval of the British. It was not a genuine fight. It was an adjustment freedom struggle," Hegde had said while addressing a public event in Bengaluru. While several Congress leaders, including Karti Chidambaram and BK Hariprasad, have condemned Hegde's remark, BJP leaders too have distanced themselves from it.

Top leadership in BJP is unhappy with Anantkumar Hegde over his controversial remark on Mahatma Gandhi, party sources had said on Monday, adding that he has been asked to issue an unconditional apology.
