H-1B visa programme faces onslaught of Congressional bills

Washington, Mar 9: With the Trump administration seriously mulling H-1B visa reforms, at least half a dozen bills have been tabled in the US House of Representatives and the Senate, contending that the programme that is popular among Indian IT firms eats into American jobs.

visaAuthors of all these bills from both the Republican and the Democratic parties believe that H-1B work visas, which are highly popular among Indian techies and Indian IT companies, tend to replace American workers.

Even though this argument is disputed by research scholars, economists and Silicon Valley executives, these legislations are based on the premise that Indian techies are eating into American jobs.

In less than a week of Trump being sworn in as the 45th US President, Republican Senator Chuck Grassley, and Assistant Senate Minority Leader Dick Durbin, introduced the "H-1B and L-1 Visa Reform Act" to prioritise American workers and restore fairness in visa programmes for skilled workers.

Grassley is Chairman of the powerful Senate Judiciary Committee. Among other things, the H1-B reform bill proposes to eliminate the lottery system and give foreign students educated in the US priority on visas.

The bill would prohibit companies with more than 50 employees, of which at least half are H-1B or L-1 holders, from hiring additional H-1B employees.

It also explicitly prohibits the replacement of American workers by H-1B or L-1 visa holders. The bill among other things would also crackdown on outsourcing companies that import large numbers of H-1B and L-1 workers for temporary training purposes only to send the workers back to their home countries to do the same job.

Specifically, it would prohibit companies with more than 50 employees of which at least half are H-1B or L-1 holders, from hiring additional H-1B employees, a statement said.

It explicitly prohibits the replacement of American workers by H-1B or L-1 visa holders. These provisions address the types of abuses that have been well-documented in recent press reports.

Democrat Zoe Lofgren -- who represents a Congressional district in California that includes Silicon Valley -- introduced 'The High-Skilled Integrity and Fairness Act of 2017'.

As soon as the bill, which proposes a skill and wage- based system for allocation of H-1B visas and seeks to more than double the minimum wage for an H-1B visa holder to USD 130,000, was introduced, stocks of major Indian information technology went down and rattled the USD 150-billion outsourcing industry.

"It's near-impossible to design an immigration system that selects only the highest-paid and still protects the inventiveness and meritocracy that has made Silicon Valley the centre of the tech world," said Ridhika Batra, US-head of the Federation of Indian Chambers of Commerce and Industries.

"Like all forms of protectionism, these measures by (the) US government would only lower standards and reduce productivity, eventually causing the US to lose the edge -- and the income -- that comes with being the undisputed champion of innovation," she said.

The bill among other things proposes setting aside 20 per cent of the annual allocation of H-1B visas for small and start-up employers with 50 or fewer employees.

Utah Republican Representative Jason Chaffetz, and his party colleague in the Senate Senator Mike Lee, have introduced identical bills in the House and the Senate -- Fairness for High-Skilled Immigrants Act of 2017 -- which proposes to eliminate the per-country immigration caps with a first-come-first-served system.

On February 2, Senator Sherrod Brown joined by Joe Donnelly and Kirsten Gillibrand, introduced the "End Outsourcing Act," which aims to ensure that federal contracts are awarded to companies who hire American workers.

Two Republican Senators Tom Cotton and David Perdue unveiled the Reforming American Immigration for Strong Employment (RAISE) Act on February 7, which proposes to lower overall immigration to 637,960 in its first year and to 539,958 by its tenth year -- a 50 per cent reduction from the 1,051,031 immigrants who arrived in 2015.

Cotton and Perdue met Trump at the White House on Tuesday, after which they said that H-1B and employment-based Green Card is likely to be reformed to attract the best and the brightest from across the world.

The White House yesterday said the Trump Administration has a natural desire to have a comprehensive look at the H-1B, spousal visa and students visas. Last week, Indian-American Congressman Ro Khanna joined a bipartisan group of three other lawmakers to table a legislation to reform the current H-1B and L1 work visas and end its abuse by foreign companies.

The bill, if passed by both the House and the Senate and signed into law by the US President, would require employers to make a good faith effort to recruit and hire American workers before bringing in foreign workers.

It also prohibits employers from replacing American workers with H-1B and L-1 workers or giving preference to H-1B visa holders when they are filling open positions. It will modify existing H-1B wage requirements, and establishes wage requirements for L-1 workers.

The bill proposes to prohibit employers from outsourcing H-1B and L-1 visa holders to other sites unless the employer obtains a waiver which is available only in limited circumstances when the rights of American workers are protected.

Congressional experts note that it might not be easy to pass a bill on H-1B visas unless there is a consensus or broader agreement on comprehensive immigration reform.

Batra said it is important to deal carefully the underlying shortage of STEM-skilled workers. According to a latest Brookings study by 2020, demand for skilled technologists will exceed the number of qualified applicants by 1 million, leaving USA vulnerable in key areas such as technological innovation, economic development and cybersecurity.

"Moving the allocation decision from an arbitrary process to a market-clearing auction should settle the debate over our economy's demand for skilled immigrant labour, and an incremental success in our highly controversial immigration debate might help break the immigration reform impasse in other areas, as well," Batra said.

Houston, Jun 10: George Floyd was fondly remembered Tuesday as “Big Floyd” — a father and brother, athlete and neighborhood mentor, and now a catalyst for change — at a funeral for the black man whose death has sparked a global reckoning over police brutality and racial prejudice.

More than 500 mourners wearing masks against the coronavirus packed a Houston church a little more than two weeks after Floyd was pinned to the pavement by a white Minneapolis police officer who put a knee on his neck for what prosecutors said was 8 minutes and 46 seconds.

Cellphone video of the encounter, including Floyd’s pleas of “I can’t breathe,” ignited protests and scattered violence across the U.S. and around the world, turning the 46-year-old Floyd — a man who in life was little known beyond the public housing project where he was raised in Houston’s Third Ward — into a worldwide symbol of injustice.

“Third Ward, Cuney Homes, that’s where he was born at,” Floyd’s brother, Rodney, told mourners at the Fountain of Praise church. “But everybody is going to remember him around the world. He is going to change the world.”

The funeral capped six days of mourning for Floyd in three cities: Raeford, North Carolina, near where he was born; Houston, where he grew up; and Minneapolis, where he died. The memorials have drawn the families of other black victims whose names have become familiar in the debate over race and justice — among them, Eric Garner, Michael Brown, Ahmaud Arbery and Trayvon Martin.

After the service, Floyd’s golden casket was taken by hearse to the cemetery in the Houston suburb of Pearland to be entombed next to his mother, for whom he cried out as he lay dying. A mile from the graveyard, the casket was transferred to a glass-sided carriage drawn by a pair of white horses. A brass band played as his casket was taken inside the mausoleum.

Hundreds of people, some chanting, “Say his name, George Floyd,” gathered along the procession route and outside the cemetery entrance in the mid-90s heat.

“I don’t want to see any black man, any man, but most definitely not a black man sitting on the ground in the hands of bad police,” said Marcus Brooks, 47, who set up a tent with other graduates of Jack Yates High School, Floyd’s alma mater.

In the past two weeks, amid the furor over Floyd’s death, sweeping and previously unthinkable things have taken place: Confederate statues have been toppled, and many cities are debating overhauling, dismantling or cutting funding for police departments. Authorities in some places have barred police from using chokeholds or are otherwise rethinking policies on the use of force.

Dozens of Floyd’s family members, most dressed in white, took part in the four-hour service. Grammy-winning singer Ne-Yo was among those who sang.

The mourners included actors Jamie Foxx and Channing Tatum, J.J. Watt of the NFL’s Houston Texans, rapper Trae tha Truth, Rep. Sheila Jackson Lee, Houston Police Chief Art Acevedo and Houston Mayor Sylvester Turner, who brought the crowd to its feet when he announced he will sign an executive order banning chokeholds in the city.

“I know you have a lot of questions that no child should have to ask, questions that too many black children have had to ask for generations: Why? Why is Daddy gone?” former Vice President Joe Biden, the Democratic presidential candidate, said, addressing Floyd’s 6-year-old daughter in a video eulogy played at the service. “Now is the time for racial justice. That’s the answer we must give to our children when they ask why.”

Biden made no mention of his opponent in November. But other speakers took swipes at President Donald Trump, who has ignored demands to address racial bias and has called on authorities to crack down hard on lawlessness.

“The president talks about bringing in the military, but he did not say one word about 8 minutes and 46 seconds of police murder of George Floyd,” said the Rev. Al Sharpton, the civil rights activist. “He challenged China on human rights. But what about the human right of George Floyd?”

Most of the pews were full, with relatively little space between people.

“So much for social distancing today,” the Rev. Remus Wright told mourners, gently but firmly instructing those attending to wear face masks.

Texas has no limit on how many people can gather in places of worship during the pandemic, though Republican Gov. Greg Abbott has encouraged churches to follow federal health guidelines.

Although the church service was private, at least 50 people gathered outside to pay their respects.

“There’s a real big change going on, and everybody, especially black, right now should be a part of that,” said Kersey Biagase, who traveled more than three hours from Port Barre, Louisiana, with his girlfriend, Brandy Pickney. They wore T-shirts printed with Floyd’s name and “I Can’t Breathe.”

Floyd served nearly five years in prison for robbery with a deadly weapon before becoming a mentor and a church outreach volunteer in Houston. He moved to Minnesota several years ago through a program that tried to change men’s lives by helping them find work in new settings.

At the time of his death, Floyd was out of work as a bouncer at a Minneapolis club that had closed because of the coronavirus outbreak. He was seized by police after being accused of passing a counterfeit $20 bill at a convenience store.

Four Minneapolis officers were arrested in his death: Derek Chauvin, 44, was charged with second-degree murder. J. Alexander Kueng, Thomas Lane and Tou Thao were charged with aiding and abetting. All four could get up to 40 years in prison.

Some of the mostly peaceful demonstrations that erupted after Floyd’s death were marked by bursts of arson, assaults, vandalism and smash-and-grab raids on businesses, with more than 10,000 people arrested. But protests in recent days have been overwhelmingly peaceful.

May 14: The UN’s children agency has warned that an additional 6,000 children could die daily from preventable causes over the next six months as the COVID-19 pandemic weakens the health systems and disrupts routine services, the first time that the number of children dying before their fifth birthday could increase worldwide in decades.

As the coronavirus outbreak enters its fifth month, the UN Children’s Fund (UNICEF) requested USD 1.6 billion to support its humanitarian response for children impacted by the pandemic.

The health crisis is “quickly becoming a child rights crisis. And without urgent action, a further 6,000 under-fives could die each day,” it said.

With a dramatic increase in the costs of supplies, shipment and care, the agency appeal is up from a USD 651.6 million request made in late March – reflecting the devastating socioeconomic consequences of the disease and families’ rising needs.

"Schools are closed, parents are out of work and families are under strain," UNICEF Executive Director Henrietta Fore said on Tuesday.

 “As we reimagine what a post-COVID world would look like, these funds will help us respond to the crisis, recover from its aftermath, and protect children from its knock-on effects.”

The estimate of the 6,000 additional deaths from preventable causes over the next six months is based on an analysis by researchers from the Johns Hopkins Bloomberg School of Public Health, published on Wednesday in the Lancet Global Health Journal.

UNICEF said it was based on the worst of three scenarios analysing 118 low and middle-income countries, estimating that an additional 1.2 million deaths could occur in just the next six months, due to reductions in routine health coverage, and an increase in so-called child wasting.

Around 56,700 more maternal deaths could also occur in just six months, in addition to the 144,000 likely deaths across the same group of countries. The worst case scenario, of children dying before their fifth birthdays, would represent an increase "for the first time in decades,” Fore said.

"We must not let mothers and children become collateral damage in the fight against the virus. And we must not let decades of progress on reducing preventable child and maternal deaths, be lost,” she said.

Access to essential services, like routine immunisation, has already been compromised for hundreds of millions of children and threatens a significant increase in child mortality.

According to a UNICEF analysis, some 77 per cent of children under the age of 18 worldwide are living in one of 132 countries with COVID-19 movement restrictions.

The UN agency also spotlighted that the mental health and psychosocial impact of restricted movement, school closures and subsequent isolation are likely to intensify already high levels of stress, especially for vulnerable youth.

At the same time, they maintained that children living under restricted movement and socio-economic decline are in greater jeopardy of violence and neglect. Girls and women are at increased risk of sexual and gender-based violence.

The UNICEF pointed out that in many cases, refugee, migrant and internally displaced children are experiencing reduced access to protection and services while being increasingly exposed to xenophobia and discrimination.

“We have seen what the pandemic is doing to countries with developed health systems and we are concerned about what it would do to countries with weaker systems and fewer available resources,” Fore said.

In countries suffering from humanitarian crises, UNICEF is working to prevent transmission and mitigate the collateral impacts on children, women and vulnerable populations – with a special focus on access to health, nutrition, water and sanitation, education and protection.

To date, the UN agency said it has received USD 215 million to support its pandemic response, and additional funding will help build upon already-achieved results.

Within its response, UNICEF has reached more than 1.67 billion people with COVID-19 prevention messaging around hand washing and cough and sneeze hygiene; over 12 million with critical water, sanitation and hygiene supplies; and nearly 80 million children with distance or home-based learning.

The UN agency has also shipped to 52 countries, more than 6.6 million gloves, 1.3 million surgical masks, 428,000 N95 respirators and 34,500 COVID-19 diagnostic tests, among other items.

London, Feb 19: UK Home Secretary Priti Patel today announced the launch of the Britain's new points-based visa system, aimed at attracting the "brightest and the best" from the world, including from India, and cutting down numbers of cheap, low-skilled workers coming to the country.

The new system will come into force from January 1, 2021 at the end of the transition period after the UK's exit from the European Union (EU) last month, which will formally end free movement of people within the economic bloc for the UK as a non-member.

The new post-Brexit system, which will apply equally to the EU and non-EU countries like India, is based on assigning points for specific skills, qualifications, salaries and professions, with visas only awarded to those who gain enough points.

"Today is a historic moment for the whole country. We're ending free movement, taking back control of our borders and delivering on the people's priorities by introducing a new UK points-based immigration system, which will bring overall migration numbers down," said Ms Patel, the senior-most Indian-origin Cabinet minister.

"We will attract the brightest and the best from around the globe, boosting the economy and our communities, and unleash this country's full potential," Ms Patel, in charge of the UK's visa and immigration system, said.

The UK Home Office said the new system is a direct response to the 2016 referendum in favour of Brexit, which was seen as a vote to end the country's reliance on cheap migrant labour and reduce overall levels of migration with tighter security.

"The new single global system will treat the EU and non-EU citizens equally. It will give top priority to those with the highest skills and the greatest talents, including scientists, engineers and academics," the Home Office said.

The Global Talent Scheme, a fast-track visa to be in operation from Friday, will also apply to the EU citizens from next year to allow highly-skilled scientists and researchers to come to the UK without a job offer.

Professor Alice Gast, President of Imperial College London, said: "British science is global. The new post-study work and Global Talent visas will help us to attract the world's brightest students and researchers, wherever they come from."

"From the race to develop a coronavirus vaccine to clean energy, British science's international collaborations drive innovation and excellence."

The government said the points threshold for the new system will be carefully set to attract the talent the UK needs. Skilled workers will need to meet a number of relevant criteria, including specific skills and the ability to speak English, to be able to work in the UK. All applicants will be required to have a job offer and, in line with the Migration Advisory Committee''s (MAC) recommendations, the minimum salary threshold will be set at 25,600 pounds - lower than the previous 30,000 pounds level for Tier 2 work visas.

The new points-based system will also expand the skills threshold for skilled workers.

Those looking to live and work in the UK will need to be qualified up to A-level or equivalent, rather than degree-level under the current system. This will provide greater flexibility and ensure UK business has access to a wide pool of skilled workers, the Home Office said.

In line with the British Prime Minister Boris Johnson's manifesto commitment in the December 2019 General Election, there will be no specific route for low-skilled workers.

"It is estimated 70 per cent of the existing EU workforce would not meet the requirements of the skilled worker route, which will help to bring overall numbers down in future," the Home Office said.

Student visa routes will also be points-based and be opened up to EU citizens from next year.

Those wishing to study in the UK will need to demonstrate that they have an offer from an approved educational institution, that they can support themselves financially and that they speak English.

To address the specific labour concerns of the agricultural sector reliant on seasonal workers from the EU, the Seasonal Workers Pilot will be expanded in time for the 2020 harvest from 2,500 to 10,000 places.

EU citizens and other non-visa nationals will not require a visa to enter the UK when visiting the UK for up to six months.

However, the use of national identity cards will be phased out for travel to the UK and the Home Office highlighted that as part of its post-Brexit offer, those EU citizens resident in the UK by December 31 2020 can still apply to settle in the UK through the EU Settlement Scheme until June 2021.
