HC quashes obscenity case against Big Boss makers, Colors TV

Mumbai, Sept 27: The Bombay High Court has quashed a case of obscenity, indecency and indecent representation of woman registered in 2008 against entertainment television channel Colors TV, and Endemol India Pvt Ltd, producers of reality show "Big Boss".

An FIR was lodged against the channel and producers of the show in October 2008 at suburban Andheri police station for offences punishable under IPC sections 292 and 294 (obscenity) and relevant sections of the Indecent Representation of Womens Act.

The case was lodged by Sunil Ahire, president of the Mumbai Pradesh Youth Congress, alleging that he had been watching the show and found that the participants were spreading "indecency, vulgarity and also propagating indecent representation" of women.

Ahire also stated in his complaint that he had received communication from various party workers and the public at large complaining about the show.

The channel and the producers later approached the high court seeking quashing of the case.

A division bench of Justices Ranjit More and Sadhana Jadhav last week quashed the FIR and said there were several shortcomings in the complaint, and that despite the time given on two occasions, the police could not inform the court about the progress made in the investigation.

"Perusal of the complaint makes it abundantly clear that the respondent No.3 (Ahire) has not given the dates on which the reality show Big Boss was aired and viewed by him. The respondent No.3 has also not given particulars in respect of the indecency and vulgarity alleged by him. Also, the names and particulars of the participants who exhibited vulgarity are not given," the court said in its order.

"The complainant has made ominous and general allegations. On the basis of these allegations, in our considered view, continuation of investigation into such FIR would be futile and also it would be abuse of process of law," the court said.

Mumbai, Jan 18: Actor Shabana Azmi was injured in an accident on Saturday afternoon on the Mumbai-Pune Expressway in Maharashtra's Raigad district, an official said.

The incident took place around 3.30 pm near Khalapur, over 60 km from Mumbai, when the car in which she was traveling rammed into a truck, said Raigad Superintendent of Police Anil Paraskar.

She was rushed to MGM hospital in Navi Mumbai and was undergoing treatment, he said.

Mumbai, Aug 2: None of the sim cards that actor Sushant Singh Rajput was using was registered under his name, said the team of Bihar Police, probing his death case, on Sunday.

The team also informed that one of the sim cards that the late actor was using was registered the name of his friend Siddharth Pithani.

"We are now tracking the call detail records (CDRs)," the police said.

The team also said that they will interrogate the family of Sushant Singh Rajput's former manager Disha Salian, who died few days before Sushant's death.

"Even after constant attempts to connect with them on phone, we have failed to establish any contact," it said.

Earlier today, while talking to news agency, the Director-General of Police (DGP) of Bihar Gupteshwar Pandey hinted at the non-cooperation of Mumbai police with his team in their investigation.

"We don't have post-mortem report details, CCTV footage or any information that has been collected by Mumbai Police during probe till now. Our Chief Minister has requested the Maharashtra Chief Minister to ask his police force to cooperate with us," the DGP added.

When asked if Bihar Police want CBI probe into the case, he said, "We are more than capable of doing an unbiased investigation. We hope that Mumbai Police will cooperate with us and we'll conclude the investigation."

Rajput was found dead at his Mumbai residence on June 14. Mumbai Police who was investigating the case had earlier informed that they have recorded the statements of 41 people, including filmmaker Mahesh Bhatt, film critic Rajeev Masand, director-producer Sanjay Leela Bhansali, and filmmaker Aditya Chopra so far.

A team of Bihar Police is in Mumbai to probe the actor's death after an FIR was filed by Rajput's father KK Singh against late actor's girlfriend Rhea Chakraborty in Bihar in connection with the death case under several sections including abetment of suicide.

The Enforcement Directorate (ED) had also registered an Enforcement Case Information Report (ECIR) in Rajput's death case. ED registered the report after an FIR was filed by his father against Chakraborty.

Mumbai, Jan 28: A 33-year-old woman has written to the National Commission for Women (NCW) alleging that Bollywood choreographer Ganesh Acharya used to make her watch porn videos whenever she visited his office in Mumbai.

In a complaint filed with the police, the woman, an assistant choreographer, has alleged that Acharya and two women assaulted her during a function of the Indian Film and Television Choreographers Association (IFTCA) held in suburban Andheri on Sunday.

Besides Acharya, the complainant, Divya Kotian, has named Jayashree Kelkar and Preeti Lad in her complaint for assault, a police official said on Tuesday.

Calls made to Acharya for his reaction remained unanswered.

In her letter to the NCW, Kotian, a resident of suburban Bhayandar, claimed that Acharya forced her to watch adult videos whenever she visited his office.

In her complaint with Amboli police station, Kotian alleged that Acharya was demanding a commission from her for working in the film industry.

Kotian is also a member of the IFTCA.

Acharya, who was elected as a general secretary of the IFTCA, used to frequently call the complainant at the office in Andheri, the police official said quoting the complaint.

On January 26, when Kotian reached the IFTCA office, Acharya shouted at her and announced that she was being "suspended", he said.

Acharya grew furious after Kotian told him that she is a member of the IFTCA and allegedly asked his team member, Jayashree Kelkar, to slap her, the police official said.

"Kelkar and Preeti Lad hit me in public view which was captured on the CCTV," the complaint stated.

Police have registered a non-cognisable (NC) offence and investigating, the official added.
