HC refuses to restrain Arnab from airing Pushkar death news

New Delhi, Sept 8: The Delhi High Court today refrained from passing any interim order restraining TV journalist Arnab Goswami and his news channel Republic TV from airing any news or debate in connection with Shashi Tharoor's wife Sunanda Pushkar's death case.

Justice Manmohan issued a notice to Goswami and the channel and sought their responses on Tharoor's plea to restrain them from allegedly misreporting the contents of court proceedings related to Pushkar's death.

The court said the matter required a detailed hearing and only after that, a detailed order could be passed on it.

It also observed that the Congress leader has not shown any law by which investigation cannot be done by the journalist.

"Show me that after the first date of hearing (May 29), he (Goswami) has called you a murderer," the judge said, adding "I cannot dictate what should be the editorial policy of a news channel".

"Not (any interim order) at this point," the court said and directed Goswami, Republic TV to file their responses with regard to Tharoor's application seeking direction not to make any defamatory publication against him in any manner.

The Congress leader has alleged that after the last date of hearing on August 16, the journalist and his channel continued to indulge in misreporting and had broadcast an 8- hour programme on September 4 related to his wife's death.

Tharoor moved a fresh application through advocate Gaurav Gupta in the pending Rs 2 crore civil defamation suit filed against Goswami and the Republic TV for allegedly making defamatory remarks against him while airing news on the death of Pushkar.

Senior advocate Sandeep Sethi, appearing for Goswami and the channel, opposed Tharoor's fresh application saying "we have not made any accusations while airing the news."

Pushkar was found dead in a suite of a five-star hotel in South Delhi on the night of January 17, 2014. The matter is still under investigation.

In their affidavit filed before the high court, the journalist and the channel said they have neither "condemned" Tharoor, nor suggested that he was involved in the death of his wife Pushkar.

They have also denied that Tharoor was called "the killer" of his wife by him or the channel, as alleged by the Congress MP.

The politician has alleged that despite assurances given in the court on May 29 by the counsel for Goswami and Republic TV, they were engaged in "defaming and maligning" him.

The Congress leader had also sought direction to them that they should not mention the expression "murder of Sunanda Pushkar" anywhere since it is yet to be established by a competent court whether her death was "murder".

The court had on May 29 said the journalist and his news channel could put out stories stating the facts related to the investigation of Pushkar's death, but could not call the Lok Sabha MP from Thiruvananthapuram a "criminal". It had also told their counsel to reduce the rhetoric.

Arnab Goswami seems to be on PMO assignment, no court can restrict him. On the other hand court is asking Maya Kodnani to bring Amit Shah, the fugitive who is untraceable. Why does court not order the police to bring Amit Shah to court?

Bengaluru, Mar 18: Karnataka Congress President DK Shivakumar on Wednesday met the Director-General of Police in Bengaluru and demanded police protection for Madhya Pradesh Congress MLAs and the removal of BJP workers from the hotel in Bengaluru, where the legislators are currently lodged.

"The (Madhya Pradesh) legislators have come here and have requested police protection, that is all. Let the police give them protection, our candidate (Digvijaya Singh) has come, let him meet the legislators. Why are BJP workers protecting them? We know that they are under threat and hence we need to vacate them (BJP workers)," Shivakumar told reporters here after the meeting.

"We will give protection to our men and that is why we are telling them they cannot stop us. They should be in a free and fair position. I have communicated to DGP that BJP needs to vacate," he added.

Earlier today, Congress' Rajya Sabha candidate from Madhya Pradesh and former chief minister Digvijaya Singh was placed under preventive arrest after he sat on a dharna near Ramada Hotel here, allegedly for not being allowed by police to meet the 21 Congress rebel MLAs lodged in a hotel.

"I am a Rajya Sabha candidate from Madhya Pradesh, voting is scheduled for March 26. My MLAs have been kept here, they want to speak to me, their phones have been snatched, the police is not letting me speak to them saying there is a security threat to MLAs," Singh told reporters.

Singh who sat on the dharna with a face mask on said: "We were expecting them to come back, but when we saw they're being held back, messages came from their families...I personally spoke to five MLAs, they said they're captive, phones snatched away, there is Police in front of every room. They're being followed 24/7," Singh said.

The development comes amid the political crisis in Madhya Pradesh after the exit of Jyotiraditya Scindia from the Congress party.

Scindia's departure was followed by 22 Congress MLAs resigning from the party as well as from the state legislative Assembly.

The resignation of these MLAs has left the Kamal Nath government below the majority mark.

Kalaburagi, Mar 16: A family member of the 76-year-old man from Kalaburgai who died of COVID-19 on March 10 has been tested positive for the virus.

Kalaburagi Deputy Commissioner B Sharat said, "One member of the family of the 76-year-old man from Kalaburgai, who died due to coronavirus has tested positive for the virus."

The disease which originated in China's Wuhan city in December last year has so far spread to more than 100 countries, infecting over 1,30,000 people.

The World Health Organisation (WHO) has declared coronavirus a pandemic.

Kolkata, Feb 2: A protester at Park Circus, known as Shaheen Bagh of Kolkata, died last night after she fell ill during her agitation against CAA, NRC and NPR.

The woman has been identified as Sameeda Khatun (57) who was a resident of Entally area of the city. According to protesters, Khatun who was asthmatic patient died after suffering a cardiac arrest. She is survived by husband and eight children.

Around 250 women from Kolkata have been holding a peaceful sit-in at Park Circus Maidan since January 7 to protest against CAA, NRC and NPR and demanding the withdrawal of the new citizenship law.

Research Scholar at Rabindra Bharati University, Nousheen Baba Khan who has been spearheading the Park Circus protest since the beginning, told the newspaper, “Sameeda Khatun was a regular face at the protest and she was not well as she had asthma.

Last evening she came to me complaining that she is having trouble in breathing. We immediately took her to Chittaranjan Hospital where doctors said she had suffered a cardiac arrest. We later took her to Islamia Hospital where doctors declared her brought dead,” said Khan.
