HC stays rustication of JNU student who accused warden of sexual harassment

New Delhi, Jul 3: The Delhi High Court has put on hold the rustication of a JNU student who had accused a hostel warden of sexual harassment, saying the university did not follow the prescribed procedure while taking the decision.

JNUJustice Sanjeev Sachdeva stayed the May 30 decision of Jawaharlal Nehru University to rusticate the female student for one semester saying the varsity did not provide sufficient time to her to respond to the show cause notice and order appeared to have been passed without carrying out an inquiry.

The court also issued notice to the university and sought its response on the plea of the student, who was rusticated for one semester on the basis of a report of a Gender Sensitization Committee against Sexual Harassment (GSCASH) which had held that the girl had made a false complaint against the warden.

"Prima facie, I am satisfied that the respondent No.1 (JNU) has not complied with the provisions of the rules and procedures prescribed. The show-cause notice dated May 20, 2016 appears to have been served on the petitioner (student) on May 27 which did not provide sufficient time to her to respond to the said show-cause notice.

"Consequent to the show-cause notice, prima facie, there does not appear to have an inquiry conducted and the impugned order has been passed. In view of the above, issue notice. Renotify on August 23. In the meantime, the order dated May 30 shall remain stayed," the court said.

The student, in her plea, had contended that procedure as prescribed under the Rules and Procedures of the GSCASH has not been followed, as even the time required for filing an appeal was not provided to her since the show cause notice of May 20 was given to her on May 27.

She has also contended that even without awaiting her response, the rustication order was passed.

The student further alleged that even the report of the committee was not given to her.

The committee had carried out an enquiry pursuant to the girl lodging a complaint against the warden at Vasant Kunj police station on November 22, last year. A FIR was registered pursuant to her complaint.

The GSCASH had exonerated the warden and recommended the student's rustication for defaming him.

May 28: Congress President Sonia Gandhi on Thursday asked the central government to unlock its coffers and help the needy affected by the coronavirus-induced lockdown.

In a video message posted as part of the Congress' 'Speak Up India' campaign, she lamented that even though the country is passing through a serious economic crisis with loss of livelihood due to the pandemic and the lockdown, the central government has not heard the cries of pain and trauma of people.

"We again urge the Centre to unlock its coffers and help the needy. Put direct cash of Rs 7,500 per month in the account of every family for the next six months and provide Rs 10,000 immediately; ensure safe and free travel of labourers back home, employment opportunity and rations; and also increase the number of work days under MNREGA to 200 days to facilitate jobs in villages," Gandhi said.

"Instead of loans, provide financial relief to small and medium industry so that crores of jobs are saved and the country progresses," she said in her video message on the party's social media handles.

New Delhi, May 23: On the occasion of Jumat-ul-Vida, the last Friday of the ongoing holy month of Ramzan, a select group of people offered namaz at Delhi's Jama Masjid ahead of Eid-ul-Fitr, while adhering to social distancing following relaxations in the fourth phase of the COVID-19 lockdown.

"A large number of people wanted to offer prayers today but we told them they should do so from their homes. Only the staff of the mosque and a few members of the family offered prayers here," Shahi Imam of Jama Masjid said.

The coronavirus pandemic has also marred the excitement of Eid for the vegetable and fruit vendors in neighbouring Daryaganj.

The fourth phase of nation-wide lockdown extended till May 31, began from Monday in which markets and shops were allowed to open. However, due to persisting fear of COVID-19, the sale of products is yet to pick pace.

Unlike each year, the market lacks the sheen this Eid with no bustle and people cautious about venturing out.

Salim, who has been selling cheese and curd in the market for the last 35 years, told ANI, "I have never seen such an Eid. There is an atmosphere of fear in the minds of people."

Another fruit seller Haseen Malik said that "During the month of Ramadan, most people relish fruits such as musk melon, sweet lemon and watermelon so there is some demand for it. But there is no excitement for Eid this year. The sale has been at an all-time low because of the lockdown."

In the wake of the festival and to ensure social distancing, Delhi Police has made elaborate security arrangements.

New Delhi, Mar 9: Petrol and diesel prices registered a drop across the country on Monday as global oil prices plummeted around 30 per cent after Saudi Arabia slashed prices and set plans for a dramatic increase in crude production in April.

In New Delhi, petrol price fell by 24 paise intra-day and stood at Rs 70.59 per litre. Diesel in the national capital was retailed at Rs 63.26 per litre on Monday as against Rs 63.51 on Sunday.

The retail price of petrol in Kolkata saw a drop of 23 paise to Rs 73.28 per litre. The diesel price fell by 25 paise in the eastern metropolitan city to retail at Rs 65.59 per litre.

In Mumbai, petrol price was Rs 76.29 per litre as against Rs 76.53 a day earlier. Diesel was retailed at Rs 66.24 per litre, 26 paise lower than on Sunday.

In Chennai, petrol was retailed at Rs 73.33 per litre, 25 paise lower than a day earlier. Diesel price saw a fall of 26 paise to retail at Rs 66.75 per litre in the southern metropolitan.

Global crude oil prices fell by as much as a third following Saudi Arabia's move to start a price war with Russia amid worries over the spread of coronavirus.

Brent crude futures were down 13.29 dollars or 29 per cent at 31.98 dollars a barrel by 04:33 hrs GMT after earlier dropping to 31.02 dollars, their lowest since February 12, 2016.

Brent futures were on track for their biggest daily decline since January 17, 1991 at the start of the first Gulf War.
