High Court comes down hard on Gujarat govt over ban on cattle export

Ahmedabad, Apr 12: The Gujarat High Court has quashed three notifications of the state government aimed at stopping export of livestock from Tuna Port, terming it "colourable exercise of powers" to do something which cannot be done directly.

A division bench of justices Harsha Devani and Bhargav Karia passed the judgment last week.

The court noted that "with a view to appease a section of the society which is averse to export of livestock from Tuna Port, the government has...from time to time taken all steps to ensure that petitioners and other similarly situated persons are not able to export livestock from Tuna Port".

Several livestock exporters had knocked the high court's doors after the state government issued various orders in December 2018 which in effect banned export of animals from Tuna in Kutch.

Chief Minister Vijay Rupani had announced in December that his government will not allow export of animals from the port, noted the high court.

On the same day the Agriculture Department issued a notification under the Gujarat Essential Commodities and Cattle (Control) Act, prohibiting movement of cattle from outside into any drought-affected area. Kutch was already declared as drought-affected region then.

Then the Director of Animal Husbandry informed the Commissioner of Customs that the state government has decided to withdraw the services provided for health check-up of animals to be exported.

"He further urged the Commissioner of Customs not to allow export of live animals from Tuna...until specified (check-up) facility is established", the HC noted.

On the same day, the Home Department directed Kutch police to set up check posts to keep a watch on transportation of animals, the high court said.

"What cannot be done directly by the State Government is sought to be done indirectly under the guise of exercise of powers under section 4(1)(b) of the (Cattle Protection) Act... notification, therefore, clearly has been issued in colourable exercise of powers and deserves to be struck down", it said.

The intention was to prohibit export "which is otherwise not a state subject", the judges opined.

Though the state government requested the court to stay its order so that it could move the Supreme Court, no stay was granted.

Chikmagalur, April 5: BJP Lok Sabha MP from Udupi Chikmagalur Shobha Karandlaje on Saturday claimed that "efforts to spread coronavirus throughout the country" began at Tablighi Jamaat event in Delhi and termed it as "corona jihad".

"Efforts began at Tablighi Jamaat event in Delhi to spread coronavirus throughout the country.

Most of the attendees of that event are untraceable. There seems to be 'corona Jihadi plan' behind that meeting," she said while speaking to reporters here.

Meanwhile, according to officials, out of the seven new cases from Mysuru, two cases are connected to the Jubilant Generics cluster while the rest five cases have a travel history to Delhi.

Total positive cases of COVID-19 in India stand at 3072.

Bengaluru, Aug 4: Muzrai Department of Karnataka on Tuesday issued a circular requesting all temples in the state to perform special puja on Wednesday following the 'bhoomi pujan' for Ram Temple in Ayodhya.

The circular was issued on the directions of Chief Minister BS Yediyurappa, Commissioner's Office, Hindu Religious Institutions and Charitable Endowments Department Karnataka said.

Prime Minister Narendra Modi is scheduled to lay the foundation stone of the Ram temple in Ayodhya on August 5.

The construction of Ram temple will begin in Ayodhya after the foundation ceremony in which various dignitaries from political and religious fields are scheduled to participate.

The apex court, on November 9 last year, had directed the Central government to hand over the site at Ayodhya for the construction of a Ram temple.

The formation of Shri Ram Janmabhoomi Teertha Kshetra Trust was announced on February 5 for the construction of Ram temple at Ayodhya. The Trust has been mandated by the Central government to oversee the construction of Ram temple in Ayodhya.

Bengaluru, Apr 21: The Karnataka Government may spare its employees from salary cuts this month despite severe resources crunch it faces following steep fall in revenue collection due to the ongoing lockdown to fight the coronavirus, official sources said on Tuesday.

As of now, there is no problem with April salary and we can manage. But if May also turns out to be a wash-out (in terms of revenue collection), then the situation is going to be very tough, a senior Minister said.

Ministers and members of Karnataka Legislature are taking a 30 per cent pay-cut for a year from April 1 this year. Opposition Congress in the state has vehemently opposed any possible move to cut salaries of government employees.

You just cant even imagine, the Chief Minister B S Yediyurappa had told news agency in an interview earlier this month on the economic impact of the lock-down on the state's finances. Yediyurappa had also said that the government is now not in a position to implement Budget proposals, barring important ones, with all kinds of revenue collections having completely stopped following the lockdown.

The government recently said it proposes to regularise unauthorised properties in the state by imposing penalty, and also auction more than 12,000 corner sites belonging to the Bengaluru Development Authority, as part of resource mobilisation drive.
