Hindu widow won’t lose husband’s property after remarriage: Karnataka HC

Bengaluru, Jun 23: A Hindu widowcan’t be divested of the property of her deceased husband on her second marriage.

The high court made this observation while dismissing a petition filed by AN Amruth Kumar, a resident of Challakere town in Chitradurga district, and son of Nagaraj Setty.

Amruth and his widowed-stepmother AN Vanitha were parties to a suit in a civil court for partition and separate possession of Setty’s properties. After Vanitha remarried, Amruth moved the civil court saying after his father’s death, she can’t claim a share in the family property. The court on November 22, 2019 rejected his application.

Amruth challenged the verdict in the high court. He claimed his application for re-adjudication of rights of the parties under the decree couldn’t have been rejected and a cost of Rs 5,000 shouldn’t have been imposed on him.

According to him, as his stepmother had contracted a second marriage after his father’s death, there should have been fresh adjudication regarding her share.

However, Justice Krishna S Dixit dismissed his claim. “If unchastity or remarriage of a Hindu widower is not a ground to divest the property vested in him, it strikes at the root of law, at reason and justice to divest a Hindu widow of the property vested in her only because she has contracted a second marriage, especially when the Constitution of India mandates gender equality,” the judge observed in the order.

A widow becomes the full owner of the share in her husband’s property that may devolve on her by succession under the present section. Her remarriage, which would evidently be after the share is vested in her on her husband’s death, would not divest her of such a share, the judge noted.

Bengaluru, July 31: Denying irregularities in covid-19 equipment purchase by the Karnataka government, the state unit of the BJP has issued legal notices to Congress leaders Siddaramaiah and D K Shivakumar demanding that they apologize or face a defamation suit. 

The notices seek a public apology for the allegations levelled against the government on irregularities in the procurement of Covid-19 equipment and supplies. 

Both Siddaramaiah and Shivakumar, the Karnataka Congress president, have been doggedly pursuing allegations of corruption against the BJP government and have demanded a judicial inquiry. 

BJP general secretary N Ravi Kumar said that while the Congress leaders claimed that Rs 4,157 crore was spent during Covid-19, they also allege that the government has not responded to any of the 20 letters written by them. "If the government has not provided any answer to the Opposition, where did they get the figures from," he said.

None of the allegations of corruption is specific and the statements made are factually incorrect. "These statements, without any basis, have been issued calculatedly to lower the image and damage the reputation of the government, the Bharatiya Janata Party, representatives of the party and the ministers in the government," the notice issued on behalf of Ravi Kumar read.

Bengaluru, May 15 Reformed underworld don N Muthappa Rai died battling cancer at a private hospital here on Friday, hospital sources said.

Rai, 68, was suffering from brain cancer for the past one year and was admitted at Manipal Hospital on Old Airport Road, where he died at 2.30 am, the sources said. Rai is survived by two sons.

Born into a Tulu-speaking Bunt family in Dakshina Kannada''s Puttur town, Rai entered the crime world at a very young age.

Karnataka police issued arrest warrants against Rai in eight cases, including murder and conspiracy.

In 2002, Rai was deported to India from the United Arab Emirates. On arrival, he was questioned by various investigation agencies such as the Central Bureau of Investigation (CBI), Research and Analysis Wing (RAW) and Intelligence Bureau (IB), and by the Karnataka police. He was later acquitted due to the lack of evidences.

In his reformed years, Rai founded charitable organisation ''Jaya Karnataka''.

Rai has appeared in Tulu film ''Kanchilda Baale'' in 2011 and Kannada film ''Katari Veera Surasundarangi'' in 2012.

Bollywood director Ram Gopal Varma wanted to make a movie based on Rai''s life. The film roped in actor Vivek Oberoi for the lead role and was shot in Bengaluru, Mangaluru, Mumbai, Dubai and London. However, it has not been released due to production delays.

Rai was enthusiastic about the film and even celebrated his birthday with Varma and Oberoi.

After his cancer diagnosis, Rai withdrew from public life and resigned from Jaya Karnataka.

His last rites are likely to be performed at Bidadi on Friday, family sources said.

Udupi, Mar 11: An elderly woman, who had recently visited Saudi Arabia has been admitted to an isolation ward at KMC in Manipal, here with symptoms of fever, cough and breathlessness.

The 68-year-old woman hails from Sagar taluk in Shivamogga district of Karnataka.

The patient had travelled to Saudi Arabia in the last week of February and was treated for fever cough and breathlessness there.

After recovery, she had travelled back to Bengaluru, where she was screened at the airport. 

Later, she reached Shivamogga where she was treated at Nanjappa Hospital for symptoms of fever, cough. 

As she has symptoms of coronavirus, she is quarantined and is under observation. The samples will have been sent to Bengaluru and the result is awaited.
