How new US visa rule, starting next week, will impact H-1B holders

Washington, Sept 28: From Monday, the US would start implementing a new rule which allows initiation of deportation process of people whose legal status to stay in America has expired for reasons such as denial of visa extension application or change in status, officials said.

However in a relief to H-1B visa holders, a federal agency tasked with this said that for the time being this policy will not be implemented with respect to employment-based petitions and humanitarian applications and petitions.

US Citizenship and Immigration Services (USCIS), tasked with granting visa or its extension to non-immigrants, said Wednesday they will start taking an incremental approach to implement the new rule from October 1.

Under the new rule, they will issue notices to appear (NTA) to people whose applications regarding visa extension or changes in status have been denied.

NTA, in immigration law parlance, is considered the first step towards deportation of foreign nationals who do not have valid papers to legally stay in the US. It is a document that instructs an individual to appear before an immigration judge.

Given that in recent months, applications of extension of H-1B visa holders have been denied, a significant number of whom are Indian nationals, the new rule could have a major impact on Indians living in the US. But for the time being, issue of NTA to those categories have been put on hold.

USCIS said it will send denial letters for status-impacting applications that ensures benefit seekers are provided adequate notice when an application for a benefit is denied.

It said it will provide details on how applicants can review information regarding their period of authorised stay, check travel compliance, or validate departure from the US.

The federal agency will continue to prioritise cases of individuals with criminal records, fraud, or national security concerns.

“There has been no change to the current processes for issuing NTAs on these case types, and USCIS will continue to use its discretion in issuing NTAs for these cases,” it said.

Washington, Mar 27: The United States has seen a record 18,000 new confirmed coronavirus cases and 345 deaths over the past 24 hours, according to a Johns Hopkins University tracker.

There are now 97,028 declared virus cases in the country and there have been 1,475 deaths, Johns Hopkins said.

Jul 11: UK’s Prince Charles, at the ongoing India Global week 2020, has praised India’s sustainable way of life, as he emphasised on sustainable development amid the ongoing coronavirus pandemic. Addressing the summit through a video link from London, Prince Charles said, “The country’s (India’s) diversity and resilience is a personal inspiration for him and much to teach all,” reported the All India Radio.

The three-day summit is getting held on a virtual platform from July 9 to July 11 due to the ongoing COVID-19 pandemic. Around 75 sessions on subjects such as geopolitics, business, emerging technologies, banking, finance, pharmaceuticals, defence and security, and arts and culture are getting held. The summit is expected to bring together over 250 speakers and more than 5,000 participants for incisive discussion and lively debate over the three days.

During his address, Prince Charles said India’s philosophies and values have emphasised a sustainable way of life and a harmonious relationship between humanity and nature, the AIR report said.

He also informed that he spoke to Prime Minister Narendra Modi about the importance of sustainable living.

In his address, he also spoke about the ancient yogic concept of ‘Aparigraha’. “It’s the time when the world learnt this ancient wisdom from India as it seeks revival amid the pandemic, he said as reported by the AIR news.

As the countries across the globe are reeling under the corornavirus pandemic, he emphasised on sustainable development to overcome the crisis. He said, “We have an unparalleled opportunity to put people and planet at the heart of global value creation and move to sustainable markets for long-term value, balancing natural, social, and physical capital.”

Apr 11: The number of global coronavirus deaths has increased to 102,753, while the total number of cases worldwide has surpassed 1.6 million, according to the latest update by the Washington-based Johns Hopkins University.

As of Saturday morning, the overall number of infections increased to 1,698,416, while the tally of those who recovered from the deadly disease stood at 376,677, according to the varsity's Center for Systems Science and Engineering (CSSE).

In terms of cases, the US had the highest in the world at 501,301, followed by Spain 158,273, Italy 147,577 and France 125,931.

Italy accounted for the highest death toll at 18,849, with the US in the second place with 18,769 fatalities.

Other countries with more than 10,000 deaths include Spain (16,081) and France (13,197).

Although the pandemic originated in China last December, it now only accounts for 3,343 deaths with 83,003 confirmed cases.
