India mulls action against heads of WhatsApp, Facebook on failure to check fake news

Abide by law or face prosecution -- this is the tough message likely to be sent to the India heads of social media platforms if the recommendations of a high-level government panel, which discussed steps to curb fake news and misinformation besides child pornography, are accepted.

The issue was discussed by a committee of secretaries, which was constituted following lynching of nearly 40 people in last one year suspectedly due to circulation of fake news in popular social media platforms like WhatsApp, an official privy to the development said.

The panel, headed by Union Home Secretary Rajiv Gauba, submitted its report to a Group of Ministers headed by Union Home Minister Rajnath Singh, which in turn will submit its recommendations to Prime Minister Narendra Modi.

"There are country representatives of all global social media platforms in India. Action may be initiated against them if they do not comply to remove objectionable contents and video from their sites," the official said. 

The top officials of different ministries and departments deliberated the issue in the wake of reports of many incidents of lynching, communal tension and abuse following circulation of fake news and communally sensitive contents and videos.

During recent meetings with the representatives of the Twitter India, Facebook, WhatsApp and Youtube, the government officials made it clear that the social media platforms have to comply with the directives without delay, and if not done, action under law would be initiated against them.

The law enforcement agencies have been maintaining that the social media platforms cannot remain aloof to the spread of "irresponsible and explosive messages" and they cannot evade their responsibilities.

Another official said that the India representatives of the social media platforms have promised to cooperate and the law enforcement agencies will closely monitor their actions.

The committee held consultations with a cross-section of society and other stakeholders before submitting its report to the GoM.

It is understood that they have suggested tightening the law by inserting clauses in the Indian Penal Code and the Code of Criminal Procedure through parliamentary approval.

The panel report will now be discussed by the GoM comprising External Affairs Minister Sushma Swaraj, Transport Minister Nitin Gadkari, Law Minister Ravi Shankar Prasad and Social Justice and Empowerment Minister Thawar Chand Gehlot. The home minister heads the GoM.

Last month, the Home Ministry issued advisories to states and Union Territories following the Supreme Court's directives to check incidents of lynching.

The Centre asked them to appoint an officer in each district at the level of Superintendent of Police, set up a special task force to gather intelligence, and closely monitor social media contents to prevent mob attacks on suspicion of being child-lifters or cattle smugglers.

In its communique to states and UTs, the ministry had said incidents of violence and lynching by mobs in some parts of the country fuelled by various kinds of rumours and unverified news such as child lifting, theft, cattle smuggling etc, are a matter of serious concerns.

Such instances of persons taking the law in their hands run against the basic tenets of the rule of law, it said.

"All state governments, UT administrations and their law enforcement agencies are requested to implement the directions of the Supreme Court in letter and spirit," it said.

Lucknow, Jan 12: The controversy over renowned Pakistani poet Faiz Ahmad Faiz's iconic poem 'Hum dekhenge' may have caused an upheaval in the literary world but it has also helped in resurrecting the famous poet for the young generations.

Students and young professionals are making a beeline for books on Faiz, his biography and his poems and book sellers are ordering supplies of Faiz books.

"Earlier, we sold hardly one book in a month or on Faiz but after the controversy, people are curious to know more about the poet and his poems. We have placed orders for the entire literary range on Faiz Ahmad Faiz," said a leading book seller in Hazratganj in Lucknow.

The bookseller said that the highest demand was for books written in Devnagri script.

"Not many in the young generation can read or write Urdu so they prefer Devnagri," the book seller said.

In Kanpur, most of the leading bookshops have already run out of stocks and book stalls in the ongoing Handloom Expo are drawing huge crowds for Faiz books.

Suchita Srivastava, B.Ed student in Kanpur said, "I have never been fond of Urdu poetry because I do not understand much of the language but after the controversy, I want to read poems of Faiz to understand what he wanted to say. I am taking help of Google to understand difficult words in Urdu."

Krishna Rao, another student at the Chandra Shekhar Azad University of Agriculture and Technology, said that since books on Faiz had been sold out, he had ordered a Kindle edition and was reading them.

"Reading his poems actually widens one's perspective of things and becomes even more precious if you take into account the time and context in which they were written," he said.

Chennai, Jan 19: Amid ongoing nationwide protests against Citizenship (Amendment) Act, 2019, finance minister Nirmala Sitharaman on Sunday said that as many as 2838 people from Pakistan were given citizenship during the last six years.

"In the last six years, as many as 2838 Pakistani refugees, 914 Afghan refugees, 172 Bangladeshi refugees including Muslims have been given Indian citizenship. From 1964 to 2008, more than 4,00,000 Tamils (from Sri Lanka) have been given Indian citizenship," Sitharaman said at 'Programme on Citizenship (Amendment) Act, 2019' event here.

She added, "Till 2014, over 566 Muslims from Pakistan, Bangladesh and Afghanistan were given Indian citizenship. During 2016-18 under Modi government, around 1595 Pakistani migrants and 391 Afghanistani Muslims were given Indian citizenship."

The minister, further, said, "It was also during the same period in 2016, that Adnan Sami was given Indian citizenship, this is an example."    

Sitharaman added that people who came from East Pakistan have been settled at various camps in the country.

"They are still there and it's been 50-60 years now. If you visit these camps, your heart will cry. The situation is the same with Sri Lankan refugees who continue to live in camps. They're barred from getting basic facilities," she said.

Asserting that the government is not snatching away anyone's citizenship, the BJP leader said: "This Citizenship (Amendment) Act is an attempt to provide people with a better life. We are not snatching away anyone's citizenship, we are only providing them that."

"The National Population Register (NPR) will be updated every 10 years and is not involved with the National Register of Citizens (NRC). Some are involved in raising false allegations and triggering people unnecessarily without any base," she added.

New Delhi, Jan 5: Senior Congress leader P Chidambaram on Sunday sàid it was "shameful" that Sadaf Jafar, SR Darapuri and Pavan Rao were arrested by the Uttar Pradesh Police for violence without any evidence against them.

He also said that it was a shocking admission by the police that there is no evidence of their involvement.

"Sadaf Jafar, S R Darapuri and Pavan Rao Ambedkar released on bail after police ADMITTED no evidence of their involvement in violence. Shocking admission," he said on Twitter.

"If that were so, why did the police arrest them in the first place? And how did the Magistrate remand them to custody without looking at the evidence," he asked.
"The law says 'find evidence, then arrest'. The reality is 'first arrest, then search for evidence'. Shameful," Chidambaram tweeted.
